Lusambo petitions State over operationalisation of Economic and Financial Crimes Court

FORMER Kabushi member of parliament Bowman Lusambo has petitioned the State in the Constitutional Court over the decision by Chief Justice Mumba Malila to operationalise the Economic and Financial Crimes Court administratively at the Magistrate’s Court.

Lusambo said Justice Malila breached Article 120 of the Constitution to administratively operationalise the court.

He is seeking an order and a declaration that the setting up of the Economic and Financial Crimes Court administratively at Subordinate Court level is in breach of Article 120(3)(c) of the Constitution and is illegal.

The former Lusaka Province minister is seeking an order and declaration that the setting up of the Economic and Financial Crimes Court in the High Court, following pronouncements by President Hakainde Hichilema and supported by the judiciary, amounts to setting up courts targeted at a certain group of individuals.

Lusambo argues that the Economic and Financial Crimes Court is not in existence at the Subordinate Court level, as it has been effected administratively.

He said Statutory Instrument No.5 of 2022, under which the Court was promulgated by Justice Malila, does not state the rules and composition of the Court at High Court level.

“Following the creation of this Court (EFCC), the judge in charge of the High Court started transferring matters that were filed in the High Court principal registry to the new court administratively,” Lusambo stated.

He is further seeking an order and declaration that the transferring of 10 magistrates by the Judicial Service Commission (JSC), using Section 6 (e) of the Judicial Service Commission Act, contravened Article 122 of the Constitution of Zambia No. 2 of 2016.

Lusambo also wants a declaration that the setting up of the fast track court at High Court level, without stating its composition, is in breach of Article 129(3)(a) and (b) and therefore unconstitutional.

He also wants a declaration that the provision of amenities and social services is the duty of the executive and not the Judiciary.

What do you know about Nyami Nyami's Story during the Construction of Kariba Dam?

Tales of ancient gods and guardian angels are told vividly in the Zambezi region. It is here where you hear whispers of a great serpent-fish that is said to have the body of a snake and the torso of a fish. Whilst foreigners will say this creature is born of the imagination of the locals, the Tonga people will point to a lot of “signs” to justify its existence.

In 1955, a decision to tame the mighty Zambezi River and erect a dam wall was put forward. The Kariba Dam wall, as it was to be called, would create the largest manmade lake (in terms of volume but not surface area) in the world. The power stations that would be subsequently built would generate 700 megawatts of electricity; enough to satisfy over 90 percent of the country’s demand for power. Although this decision was largely seen to benefit everyone, it was not welcomed by everyone affected.



Arguably, the Tonga people were the worst affected as they were forced to uproot from their home for centuries and displaced to the higher safer ground that was less fertile and comfortable to live. After much resistance, the Tonga people reluctantly vacated their beloved home but vowed to return. It is said that the tribe elders, in their anger, summoned Nyami Nyami, the guardian of the river, to stop the project and pour out his wrath upon the people who had disturbed the peace of his people.

In 1956, the dam project commenced and the first bricks were laid. With the dam wall construction making good progress and the lake water levels already steadily rising, disaster struck in 1957. The Zambezi region witnessed a 1000-year flood in which a number of the builders were tragically killed. Some of those killed were foreign dam builders whose bodies disappeared mysteriously.

When efforts to recover their bodies failed, the elders of the Tonga tribe where approached and asked to lend their expertise and knowledge of the river to retrieve the bodies. The elders explained that Nyami Nyami had caused the disaster and if the builders wanted to appease the River god, they would need to make a sacrifice.

Initially, most of the builders and project managers laughed off the advice, but with the impending arrival of the deceased’s kin who would be expecting to bury their loved ones, the Europeans agreed.

A sacrifice of a white calf was made, as dictated by tradition. Come the next morning, the foreigners were awe-struck when the calf had disappeared and the bodies were left in its place. To this day, those events are shrouded in mystery with many conflicting explanations as to why and how things transpired.

During the next rainy season, the region saw even worse floods than those of the previous year. The Tonga people, as was to be expected, believed that the Nyami Nyami had struck again. This time, the floods swept away 11 Italian builders. Their bodies were later discovered in the partially wet cement of the dam wall.

It was at this point that, arguably, the bravest and most controversial, decision was made. After making his calculations, the Chief Project Engineer decided that it would be more structurally sound to leave the bodies plastered on the wall than to make attempts to remove them. Today, their bodies are part of the dam wall.

As explained by Narcissus Nhemachena, who was one of the construction workers present during construction of the dam wall, “It took five long years for the dam to be constructed because proper rituals had not been performed to ask for permission from Nyami Nyami to construct the dam. Cows were sacrificed and sack loads of money were thrown into the river to appease the Nyami Nyami. He caused some floods and loss of life, but at last he was kind enough to let the dam wall to be completed. It was the work of the Tonga elders and their spirit mediums to persuade the Nyami Nyami to allow the Zambezi to be tamed.”

Some members of the Tonga tribe believe that Nyami Nyami was separated from his wife during the dam wall construction. They say that he grows angrier with every passing year and it is just a matter of time before he unleashes his devastating power again so that he can be reunited with his love again. Fact or fiction? TRUCK BURNS TO ASHES IN MAZABUKA

A Heavy Duty Truck belonging to Shingalana which was laden with minerals has been burnt to ashes in Mazabuka, with the driver escaping unhurt, while the trailer also remained intact.

A check by a Byta FM News crews Thursday morning at Galaba House where the vehicle was stationed, found the entire cabin of the Truck completely burnt to ashes.

This incident is said to have happened between midnight and 01:00 hours Thursday morning.

The driver of the truck identified as Clever Samboko from Mazabuka’s Zambia Compound narrated to Byta FM News that he only saw fire at the dash board when he was sleeping.

Samboko explained that efforts to put off the fire using a Fire Extinguisher proved futile as the flame was big.

He said that he tried to contact the Fire Brigade unit from Mazabuka Municipal Council, who only arrived at the scene around 06:30 hours.

And an eye witness, Gift Mweemba, who could not state the source of the fire appealed to the Fire Brigade in Mazabuka to be quick in responding to fire emergencies.

Enoch Mwepu rushed to UTH after collapsing!

Zambian soccer star and former Brighton midfielder Enock Mwepu this morning experienced a suspected heart attack and fell off the car he was driving.

The 24-year-old, who was last October forced to retire from active soccer after being diagnosed with a hereditary heart condition, was picked by a good Samaritan who rushed him to the hospital.

Before the soccer star was seen falling off his car, the automobile was earlier swerving on Great North Road, an indication that the driver was in panic.

A source close to the story said the incident happened when Mwepu was driving towards Kabangwe when he experienced the discomfort.

"Mwepu was driving along Great North Road near Kabangwe area, he was heading out of town.

"So, its like he started having obviously heart issues. When he started having cardiac arrest. He started driving zig zag, so, the vehicle that was just driving behind him, when they saw kuti sa enza mushe uyu muntu(his not driving safely).

"Then he eventually parked, and came out of the vehicle and fell," the source said.

A man who was driving behind Mwepu picked him up and started driving toward Mums Hospital.

"He started driving to the hospital, Mums. So, he called Mums to say I've got a patient, its like he had a cardiac arrest and he i needs attention.

"Mums(staffers) advised to say just take him to UTH because we don't have capacity. But he said no, that's the nearest hospital am bringing him there," the informer said.

He was quickly seen by a doctor at Mums Hospital who stabilized him.

It was discover that he suffered a shock from his peacemaker, a device used to control an irregular heart rhythm. It has flexible insulated wires placed in one or chambers of the heart.

"So, what came out is that his got a ka peace maker that i think was put in the heart which helps him, now it seems probably it developed a fault or it started misbehaving so it's like it started giving him electric shocks to the heart, so. That doctor said its not really a cardiac arrest but it's like more of fear. Because of the electric shock," the source said.

"As of now, they have taken him to UTH.
They have taken him to the heart hospital at UTH. RTSA and police quickly moved in and escorted the patient to the hospital, UTH".

Last October, Mwepu, was forced to retire at the age of 24 as he has been diagnosed with a hereditary heart condition.

The Brighton and Zambia midfielder announced on as he hasn’t played for the Seagulls since September.
Per the statement released by the Premier League club, Mwepu fell ill on a flight to Mali last September as he was away on international duty with Zambia.

Subsequent tests discovered a hereditary heart condition which compelled Mwepu to retire from the game.

Brighton confirmed: “The condition, which can worsen over time, would put Enock at an extremely high risk of suffering a potentially fatal cardiac event, if he were to continue playing competitive football.” Part of the statement read.

Nicknamed ‘The Computer’ for his superb positional sense in midfield, Mwepu signed for Brighton from RB Salzburg in the summer of 2021.

He has made 27 appearances for the Seagulls, scoring three goals, one of which was a memorable strike at Anfield against Liverpool in October 2021.

ACC RENDERS PF INTERCITY COMMANDER HOMELESS

A HIGH-ranking former commander of the defeated PF, Francis Muchemwa who was second in command of the vicious Intercity Bus Terminus battalion says the Anti-Corruption Commission (ACC) has kicked him out of his properties and rendered him homeless.

At the height of the PF rule, Muchemwa led his troops to many bloody victories against opposition and dissidents with his only defeat in 2019 coming from the judo-strengthened hands of President Hakainde Hichilema's aide de camp Shaapa Wakunguma who was Sesheke District officer commanding at the time.

Muchemwa and his troops were beaten to pulp and rendered stretcher cases after they imported violence in the Sesheke by-election that was eventually won by UPND's Romeo Kang'ombe.

Despite the painful beating, Muchemwa and his soldiers got the last laugh as then President Edgar Lungu kicked Wakunguma and four other cops out of the Zambia Police Service as punishment for clobbering ruling party thugs.

However, trouble has been Muchemwa's close companion from the time PF left power.

Immediately the Electoral Commission of Zambia (ECZ) announced that his boss, Lungu, had tumbled at the polls and was to leave State House, Muchemwa fled into self-imposed exile and stayed as a fugitive in South Africa before he sneaked back in the country several months later.

Last September, the anti-graft body arrested the once-feared commander for possession of suspicious property worth over K12 million.

He was charged with five counts of possession of property suspected to be proceeds of crime which included a house in Silverest valued at K2.5 million
and apartments valued at K4.5 million in the same area which were all acquired between the period of 2015 to 2022.

Muchemwa is also being prosecuted for pocketing worth more than K1. 4 million as his gross earnings from June 2015 to August 31, 2021 as a Security Sergeant at Zesco Limited with the state arguing that he never worked for the loadshedding implementing power utility.

On Friday, Muchemwa cried to the Daily Nation Newspaper that the ACC had kicked him and his family on the wet streets of Lusaka after seizing his houses on Thursday evening.

Quoting him as a businessman, the Daily Nation reported that Muchemwa confirmed that that the ACC had seized his house and apartments in Chongwe’s Silverest area and ordered him to vacate them by 18:00 hours on Thursday.

“As I speak, I am homeless with my children and my wife and I am struggling to find where I will sleep and where I will get my next meal,” the 38 year old was quoted as saying.

It is reported that according to an ACC call-out dated January 9, 2023 Muchemwa was requested to report himself to the ACC on Wednesday, January 11, 2023.

However upon arriving at the ACC offices, Muchemwa was surprised to find
there was no interview scheduled but was later informed by law enforcement officers that they had to go with him to his apartments.

When Muchemwa asked he asked if he had been arrested, the officers told him he wasn't.

When the officers arrived at the apartments, they told him that they were given instructions to seize all his trucks properties because the restriction order had expired, Muchemwa told Daily Nation.

“My cry to the President is
that he [should] embrace young people
like me and encourage us, if we are wrong, control us , we are the future of the nation,” he said.

Muchemwa said this action by the ACC will affect 50 workers who will now struggle without jobs.

"I am just a young man aged 38 fighting my lungs out for a better future with determination to help others,” Muchemwa said.

K10.8 BILLION RELEASED FOR VARIOUS DEVELOPMENTAL, DEBT-SERVICE AND OPERATIONAL PROGRAMMES

Finance and National Planning Minister Dr. Situmbeko Musokotwane, MP, says the Government is pleased with the positive performance trajectory of the 2022 budget, which has seen the sustained financing of social sectors, installation of over 41, 000 new employees on the public service payroll, and meeting of several budget obligations for the current year.

He was speaking in reference to the November, 2022 budget expenditure whereby K10.8 billion was released to finance public service delivery.

Of the total amount, K2.9 billion was spent on debt service (domestic and external) and other liabilities and K3.3 billion was released towards the public service wage bill. Releases to transfers, subsidies and social benefits amounted to K2.9 billion.

With regard to subsidies, the Government released K1.7 billion towards 2022/2023 season Farmer Input Support Programme (FISP). We are confident that the logistical challenges of the past few weeks have been overcome and that all the remaining beneficiaries are now receiving their input supplies.

In the month under review, the Government also released K867.3 million for implementation of various developmental programmes and general operations.

K775.8 million went towards capital expenditure of which K478.6 million went to road infrastructure, K65.1 million for strategic fuel depots and the balance of K232.1 million went towards other infrastructure projects, sanitation inclusive.

A sum of K867.3 million was released by the Government to facilitate service delivery under various state institutions. Under this aspect, notable expenditure items included:

1)
K315.6 million for general operations in Ministries, Provinces and Agencies (MPA’s);

2)
K100 million to the Disaster Management and Mitigation Unit;

3)
K84.9 million to the Skills Development Fund; and,

4)
K28 million for various statutory by-elections.

Of the K2.9 billion which was released under the transfers (K1.2 billion) and subsidies (K1.7 billion) component:

1)
K605 million went to the community projects components under the Constituency Development Fund;

2)
K147.4 million was targeted for operations of Grant Aided Institutions under various Ministries;

3)
K111.6 million was for the Local Government Equalization Fund;

4)
K99.8 million for operations of public universities; and,

5)
K224.1 million went to the Zambia Revenue Authority to support operations and resource mobilisation.

Furthermore, in line with the Government’s commitment to reduce indebtedness, a sum of K2.7 billion was released towards the payment of both domestic debt and external debt owed to multilaterals. The Treasury also released K257.6 million for dismantling of arrears owed to suppliers of goods & services in order to help unlock liquidity and turn the wheels of the economy through SME’s.

We now take this opportunity to reiterate the call by the Minister of Finance and National Planning for Ministries, Provinces and Agencies to ensure that funds are absorbed and utilised on budgeted programmes - in a timely, efficient and effective manner in order to achieve the Government’s set transformational objectives outlined in the National Budget.

The Minister of Finance and National Planning will host a Symposium on the 2022 Budget and Economic Affairs Performance Review, on Thursday, 5th January, 2023.

PARLIAMENT RATIFIES PRESIDENTIAL APPOINTMENTS OF CHIPENZI, PHIRI, ZALOUMIS AND TWO OTHERS

Parliament has ratified the presidential appointments of Gilbert Phiri to serve as Director of Public Prosecutions (DPP), Patrick Kangwa as Secretary to the Cabinet and Tom Shamakamba to serve as Director-General of the Anti-Corruption Commission (ACC).

Others are Mwangala Zaloumis, Ali Derrick Simwinga and McDonald Chipenzi to serve as Chairperson,
Vice-Chairperson and Commissioner of the Electoral Commission of Zambia (ECZ) respectively.

This was after Members of Parliament scrutinised and debated a report submitted by the Select Committee.

Mover of the motion, Mafinga Member of Parliament Robert Chibinga says the appointments were made within the confines of the law and that there was no security concern on the appointees whom he described as competent.

Opposition Members of Parliament have urged the new office bearers to exercise professionalism and should desist appeasing the appointing authority but serve the interest of the nation.

Several others have been arrested and it is a matter of time that jail will be their home for these corruption activities.

Looking at these figures: 400 million dollars and over 120 million dollars given to Savenda systems and Elbit companies, it will be by luck if Stardy Mwale and all the companies mentioned will survive.

This money is what is making these PF thieves complain about the GULFSTREAM because they thought that funds used for security procurement cannot be audited or questioned.

Mwale did not work alone on this lubricant deal but with many PF officials and PF aligned companies.
