Notice how the Ohio House Democrats have amnesia over the fact that 26 of them voted for Larry Householder for Speaker. Wonder why Householder is still a member of the House after being indicted? Read Rep. Koehler’s post below. Ohio House Dems complicated this matter by giving Householder a pass in November’s election.
Yesterday, we removed Larry Householder as Speaker of the Ohio House, installed Rep. Bob Cupp as our new Speaker… but we did NOT remove Larry Householder from office.
Many have asked “Why not?”. Here is the reason…
In Ohio law, an elected official is automatically removed if they are convicted of a crime. Larry Householder has only been accused and indicted. Like you and I, he is innocent until proven guilty.
Any Representative can be expelled from office by a vote of 2/3rds majority based on issues that are not related to a conviction. BUT, and very important, they cannot be expelled TWICE for the same issue.
We wisely removed him from his position as Speaker yesterday because we don't believe he could or should be leading the House under current circumstances. Democrats made an unwise attempt to expel him from his position as state representative as well. Here is why it was foolish…
Because Larry Householder is on the ballot for November 3rd in an unopposed race... he is going to be re-elected to the Ohio House again in less than 100 days NO MATTER WHAT.
If we expelled him yesterday, he will be back in January for another term. The “double-indemnity” provision is there to say that if the House expels him once for a particular issue and the voters re-elect him anyhow... the House members cannot over-rule the consent of the voters.
Again, if we expelled him yesterday, because he is unopposed, he will automatically be back in January and we would be forbidden by law to expel him again.
I know that sounds crazy but it is how the law works and it is there to give voters the ultimate authority.
I voted to "table" the move to expel him because this option needs to remain available for next January if needed. I hope this all makes sense.
