Community associations are upset and concerned about the Corporate Transparency Act (CTA) because it imposes new reporting requirements that many feel are burdensome. Boards are reluctant to provide personal information such as their full legal names, addresses, and Social Security numbers to the Financial Crimes Enforcement Network (FinCEN).

Many general liability insurance policies fail to fully cover the huge losses that often follow such events. Under-covered associations and boards could be left under-covered and left on the hook for what could be millions of dollars.

Other factors as counseling, communications, water damage from fire systems, medical and funeral costs for beneficiaries may not be covered or have gaps in coverage under the association's current coverage.

8 in-person events next week in SC and NY!

The seven South Carolina events will concentrate on South Carolina legislation. There are plenty of important issues to be discussed. One interesting item is a prohibition against clothing restrictions allowing owners to throw n**e keg parties in the common areas without an ability for an association to stop them! With seven opportunities over 7 locations there should be an in-person session near you.

At the one New York event, learn what to expect from a real case study of a major HOA fire. This fire even involved a loss of life. Our panel will discuss why, despite the association's covenants clearly prohibiting more than one single-family dwelling, they still lost the lawsuit.

Insurance - Lithium Batteries Pose Issue for HOA and High-Rises

In three short video interviews we explore the hazards, liabilities and possible obligations of boards to create rules and regulations in regard to resident's lithium-ion battery devices.

Because of the fire risks associated with lithium-ion batteries, insurers are scrutinizing the storage practices of associations and residents with their lithium-ion battery devices. While they may not be looking at smart phones, they may start looking for associations to regulate items like hoverboards, electric scooters and e-bikes (we discuss electric cars in another program).

Attorney David Byrne, Esq discusses the legalities of these issues. Some of the conversation involves the difficulty when boards have to juggle rule development with residents and maintain insurance. Plus, the discussion includes possible conflicts with scooters used for disabilities.
