Ang isa ay para sa bagay, para sa pera at kapital. Ang isa ay para sa tao, na may dangal at dignidad.

Ang isa ay para sa nagmamay-aring iilan. Ang isa ay para sa nakararaming lumilikha ng yaman at mga pangangailangan ngunit naghihirap.

Filinvest strike shows union-busting -- Labor NGO

The Center for Trade Union and Human Rights (CTUHR), an NGO that seeks to empower workers in the formal and informal siionectors to claim their labor and human rights, raises concerns over union-busting in Dreambuilders Pro Inc. -- the construction arm of well-known real estate developer Filinvest.

Dreambuilders Pro Inc retrenched the leaders and members of Dreambuilders Equitable Alliance of Labor or DEAL -- the workers’ union and shifted from direct hiring to subcontracting through a manpower agency when it found out about the union’s existence since last year.

Most of the workers have been with the company since the start of the development of the Manna East warehouse, with employment ranging from three to five years. Many workers were forced to work for more than 20 hours a day, even under scorching heat or rains. There are also cases where overtime work, night shift differential, and other benefits were not properly compensated. Personal protective equipment were not maintained in a timely manner to ensure workers’ safety.

The Dreambuilders Pro Inc workers were left with no choice but to go on strike on March 18, 2024 at the company warehouse in Manna East, Barangay Dalig in Teresa, Rizal.

The strike shows how Filinvest uses contractualization to prevent contractuals from forming unions -- and prove again that contractualization truly violates workers’ right to self-organization and to collective bargaining. It shows that despite former President Rodrigo Duterte’s promise, contractualization persists under the government of President Bongbong Marcos Jr despite its promises to uphold labor and human rights.

We condemn this yet another case of union-busting through retrenchments. The Dreambuilders Pro Inc workers’ case only shows Filinvest’s greed and refusal to reduce its profits when workers assert improvements in working conditions. The government should immediately investigate the case and work for the reinstatement of the workers who were retrenched. Unionization is never a legitimate reason for retrenching workers.

The violations of labor rights are unacceptable. The Dreambuilder Pro Inc workers’ strike shows that despite the expansion of real estate business in the country, construction workers grapple with extreme exploitation and repression. Despite its slogan “We build the Filipino dream,” top real estate company Filinvest left its construction workers to live in a nightmare while it reaps multi-billion profits. It also contributes to joblessness and hunger in the country.

We support the Dreambuilders Pro Dreambuilders Equitable Alliance of Labor (DEAL) -- Solidarity of Unions in the Philippines for Empowerment and Reforms (SUPER) -- Bukluran ng Manggagawang Pilipino (BMP). DEAL-SUPER-BMP deserves the broadest support, as all workers when they form unions to improve their working conditions. # # #

We stand in solidarity with the Dreambuilders workers on strike!

Last week, the Dreambuilders Equitable Alliance of Labor (DEAL) started their strike. DEAL is the union of construction workers under Dreambuilders Pro Inc., which is owned by the corporate giant and real estate developer, Filinvest. More than 100 workers are on their picket line in Teresa, Rizal.

The unionists are fighting for their rights and dignity as workers and human beings. Dreambuilders-Filinvest is complicit in union-busting, by unjustly terminating officers and rank-and-file members of the union. Behind these terminations is the intent to replace its workforce of regular employees with contractual hires instead. Corporations are known to make use of contractual workers as they can be paid more cheaply and are unable to establish unions.

Furthermore, the striking workers have also experienced intimidation tactics from Dreambuilders-Filinvest. Police and private security forces have been caught circling the workers and using verbal intimidation. By law, police are not allowed to approach more than 50 meters to the strike zone, under the 2012 DILG memorandum “Guidelines on the Conduct of the DOLE, DILG, DND, DOJ, AFP and PNP relative to the Exercise of Workers’ Rights and Disputes.”

As a student political party that believes in and acts upon the solidarity between students and workers, Partido Pandayan steadfastly supports the DEAL union workers in their strike. Their right to organize and unionize must be protected. By cracking down on the union, Dreambuilders-Filinvest is attacking the workers’ lawful capacity to defend and forward their own interests and well-being against profit and greed. The same way we always stand with the workers on our own campus such as in AEWU, we must also support workers beyond our university.

We join the union in requesting for media coverage on the strike. We request campus publications, The GUIDON Matanglawin Ateneo The Citizen - Ateneo to report on the issue. We also amplify the union’s call for donations in-kind for the strike fund. Any amount would be appreciated to help sustain the strike for as long as it needs.

Respect unions and the right to unionize!
End contractualization!

Si Renato ang Bise Presidente ng unyon ng Dreambuilders Equitable Alliance of Labor DEAL , apat na taon na siyang manggagawa ng DPI/ FIlinvest habang ang kanyang anak na si Niño ay tatlong taon at limang buwan na sa DPI/ Filinvest .

Tatlo ang anak ni Niño, ang kanyang bunso ay kinailangan operahan para i-repair ang cleft palate. Kaya humataw siya ng overtime, sinagad ang katawan para matustusan ang pangangailangan ng pamilya. Sa isang linggo, 45 hours ang kanyang OT na pumapatak sa Php 8,000. Pero ni piso ay wala siayng natanggap.

Kumuha ng salary loan sa SSS si Renato mula pa sa luma niyang pinapasukan. Noong lumipat siya sa DPI/ Filinvest, kinakaltasan ang kanyang sahod para sa pambayad sa loan. Pero nang i-check niya sa SSS ay wala palang naibabayad sa SSS. Nasa mahigit siyam na libo ang kinaltas sa kanya na hindi ni-remit sa SSS.

Ilan lamang ito sa malawakang pagbabalewala sa dignidad ng paggawa sa loob ng DPI/ Filinvest na nagtulak sa mga manggagawa na ikasa ang kanilang welga.

Ang dinaranas ng mannggagawa ng DPI/Filinvest na panggigipit ay bahagi ng araw-araw na dahas at pananamantalang dinaranas ng uring manggagawa sa ilalim ng malupit na kapitalistang kaayusan.

Nanawagan ang SPARK sa kabataan na siyang manggagawa ng hinaharap, suportahan at makiisa sa laban para sa karapatan at kagalingan.

“Tatlo po ang anak ko, mga nag-aaral na.Yung bunso ko ay kinder at yung panganay ay magge-Grade 6 sa susunod na taon. Pagsamantala, naroon muna sila sa biyenan ko. Kahit mahirap, pero kinakailangan para sa pamilya.

Apat na taon na po ako sa Dreambuilders. Nung nagsimula ako ay 630 po ang sahod ko, hindi na yun tumaas.

Sapilitan minsan ang overtime. Kapag hindi ka nag-OT, kung anu-anong maririnig mo na masakit. Sasabihin ng mga namumuno, “pumasok ka pa, uuwi ka rin pala.” Minsan bayad ang OT, minsan hindi.

Yung sa SSS ko po, mayroon pong kinakaltas sa akin na “emergency loan.” Hindi naman po ako kumuha ng loan, pero kinakaltasan ako - nasa 8k po iyun. Yung sa iba ko naman pong kasamahan, may kaltas sa Philhealth, makikita sa payslip, pero hindi pala hinuhulugan yung Philhealth.

Sa loob po ng apat na taon ko dito, naka tatlong kontrata po yung pinirmahan ko. Masakit doon yung pinapirma pa kami ulit ng kontrata tapos kasunod ENDO na pala.”

Filinvest Dreambuilders: Destroying Filipino Dreams

Sa ika-11 na araw ng welga ng Dreambuilders Equitable Alliance of Labor, patuloy ang pagmamatigas ng management ng DPI-Filinvest sa pagtatanggal ng mga manggagawa. Sa kabila ng init, gutom sa piket line, at pangangamba ng kanilang mga pamilya nanatiling handa na tumindig at lumaban ang mga unyonista ng DEAL para sa kanilang karapatan sa regular na trabaho at pag-oorganisa.

Ngayong mahal na araw, iginugunita ang pagpapako sa krus kay Hesus na tumindig laban sa inhustisya at di pagkakapantay-pantay. Nawa'y pagharian ng habag at katwiran ang management ng Filinvest upang mabigyang-katarungan ang mga manggagawa na ang tanging ipinaglalaban lamang ay kabuhayan at karapatan.

“Dati akong nagta-tricycle. 2020 nang natigil akong mag-tricycle. Pumasok ako dito - sinubukan ko kung kayang makabuhay ng happy family. Pero wala, kapos pa rin.

Sumasahod ako ng tatlong libo sa isang linggo. Pero yung gagastusin namin ng pamilya ko, aabutin rin ng tatlong libo. Ano na lang matitira? Kasi ang isang libo ngayon, akala mo, isang daan na lang. Ano lang mabibili mo sa isang libo sa mahal ng bilihin? Ang bilis tumaas ng presyo ng bilihin. Pero simula nung nagtrabaho ako dito hanggang sa magwelga kami, iyun na ang sahod namin.

Kaya kami nag-unyon kasi sinasabi ng management sa amin, project-based raw kami. Paano kami naging project-based eh taon na kami dito - pagkatapos ng isang project, kami pa rin ang nagtatrabaho sa susunod na project. Mababalitaan na lang namin, mae-ENDO kami at papalitan na lang raw kami ng subcon.

Hanggang sa umabot kami sa welga. Nakailang hearing na, pero matigas pa rin ang kalaban. Hindi sila nakikipag-negosasyon. Wala silang pake kung magutom kami.”

FILINVEST CONSTRUCTION WORKERS ARE ON STRIKE!

Over a hundred employees of Dream Builders Pro Inc., the construction arm of real estate developer Filinvest, will go on strike on midnight tonight (March 18, 12MN).

The legal basis of the strike is “union busting”, triggered by the unjust and sudden dismissal of union leaders and active members. The employment practice at Filinvest/Dream Builders was previously “direct hiring”. Now, it is resorting to subcontracting with a manpower agency, upon knowledge of the formation of a duly-registered union by its workers.

The workers will set up their strike camp at the company’s site warehouse at Manna East, Barangay Dalig in Teresa, Rizal.

Media coverage is humbly requested. Your presence may help avert violence and harassment to the workers’ exercise of their Constitutional rights to strike and to self-organization. #

Sa ikalimang araw ng welga, dumating sa picket line ang mga kasama mula sa CEED - Center for Energy, Ecology and Development upang magpaabot ng suporta at pakikiisa sa laban ng DEAL union. Nagbigay sila ng solar panels, genset, at mga ilaw para agad na magamit ng mga manggagawa sa ating picket line.

Kaisa ang DEAL at BMP sa ating adhikain ng malinis at abot-kayang enerhiya na magsisilbi sa uring manggagawa.
