Cracking Down on Password Sharing- Are Estates Prepared?

Netflix’s recent password policy change is causing a stir. A recent article in the Washington Post calls out that the upcoming change for users accessing an account from a different location than the account's primary location for more than 31 days must create a separate account or pay additional fees. Otherwise, those who share their passwords violate the “agreed” Terms of Service and are subject to permanent lock. While this affects Netflix's subscriber base, it also raises serious concerns for advisors and clients who plan on relying on password sharing as a solution for handling estate matters.

Digital properties, such as the come with subscription payments, hold time-sensitive materials and employ inactive account data auto-deletion policies are an ever-increasing component to a client’s asset portfolio of a client's estate. The very same security protections and privacy policies demanded from content providers are the very same elements that can be disastrous for an estate or trusts administration.

Netflix's new password-sharing policy raises questions for digital property succession management. For instance, if a deceased client shares a Netflix account with a family member, the policy may create problems for survivors looking to access data or the service. Unlike a standard password, which can be easily compromised, a passkey uses public-key encryption to create a highly secure and unique identifier that is nearly impossible to breach.

Major companies like Google are adopting passkeys, utilizing public-key encryption to enhance security against data breaches and negate the need for additional two-factor authentication. However, this new approach introduces challenges. For instance, some passkey systems incorporate biometric requirements, which can't be fulfilled when the account holder is deceased. This adds complexity to managing clients' accounts and doesn't necessarily solve the issue of account holder impersonation; it might even make it more difficult. Thus, there's a greater need for the DCS platform.

Transitioning from passwords to passkeys could also require adaptation to new technology, necessitate updates to legal documentation, and demand additional training to ensure compliance with industry standards and regulations.
