"More than half of Native American women experience sexual violence at some point during their lifetimes, and one out of three are r***d. On some reservations, people say they do not know a single woman who has not been r***d, and they tell their daughters what to do when - not if - they are r***d, according to legal scholar and advocate Sarah Deer. Most disturbing: Non-Indigenous perpetrators commit an estimated 86-96 percent of the sexual abuse of Native women and are rarely brought to justice."

Understanding today’s violence against Native American women requires confronting our brutal past.

This is awful.

A minimum of SEVEN YEARS after a violent incident in January 2018, three teenagers charged with GBH will face trial. For the defendants, that means 7 years of their lives on hold, likely with stringent bail conditions. It also carries the possibility of a 7 year prison sentence, while if they had pleaded guilty they'd likely have been out in 2 or 3 years.

For the alleged victim, that means 7 years of his life on hold, waiting for this to be over. 7 years waiting to see justice.

Cases get worse with age, not better. Witnesses already have issues remembering events accurately, even more so after years and years of waiting for cases to reach trial. These delays will inevitably see guilty people walk out of court unpunished.

With Crown Court delays close to a record high, the BBC speaks to those who have waited years for justice.

Listening to the latest 20:20 episode, "Follow the Fingerprints" about the wrongful conviction of Leo Schofield, with the brilliant Brett and Alice from The Prosecutors Podcast.

I don't take claims of innocence at face value. But the fingerprints of a convicted murderer, Jeremy Scott, in Michelle Schofield's car, are incredibly strong evidence - as are his repeated confessions.

Brett explained that Scott's mention of Michelle's car stopping working matches the evidence in the car. The flex plate was cracked, and Scott said the car suddenly stopped working. My dad is a big car guy, so I asked him about it; he agreed with Brett. (For anyone who's seen "My Cousin Vinnie", my dad is my equivalent of Mona Lisa Vito!)

The timeline doesn't work for Leo to be guilty. Yes, he was abusive. The evidence still doesn't support him having anything to do with Michelle's murder; the evidence against Jeremy Scott is overwhelming. It's important to understand that wrongful convictions don't tend to happen to choirboys - they happen to people who are suspects for a reason. Leo was a suspect for a reason and he was convicted for a reason.

I'm glad Leo is finally a free man, I hope he is exonerated and Jeremy Scott is convicted.

Glenn Kirschner, the prosecutor who took on the unsuccessful case against Joe Price (now Joe Anderson), Dylan Ward (now Dylan Thomas) and Victor Zaborsky for obstruction of justice and conspiracy in connection with the murder of Robert Wone, revealed today in a session at CrimeCon that Price and Zaborsky have divorced within the past year. Price and Ward split up some time ago, but neither has spoken out since about what happened.

If there is a chance of real justice for Robert and his widow, Kathy Wone, it may only come from Zaborsky revealing what he knows about the night that Robert was murdered.

Chad Daybell has been sentenced to death for the murders of Tammy Douglas Daybell, JJ Vallow and Tylee Ryan. These murders were committed with the full knowledge and participation of his equally guilty, equally murderous wife Lori Vallow Daybell.

Daybell and Vallow were almost certainly involved in the murder of Vallow's fourth husband Charles, and the attempted murder of Brandon Boudreaux, Vallow's niece Melani's estranged husband.

Alex Cox - Vallow's brother - carried out these attacks on their behalf, before he in turn died suddenly. His death has been ascribed to natural causes, however it was very conveniently timed, coming immediately after Tammy's body was ordered to be exhumed as part of the investigation into the string of disappearances surrounding the couple and their doomsday cult.

Questions remain about the sudden death of Vallow's third husband, Joseph Ryan, which has also been ascribed to natural causes. Prior to his death Vallow was recorded saying she wanted to kill him "like the scripture says".

Tammy's family have asked that donations be made in her memory to the Tammy Douglas Daybell foundation, which provides books for children and promotes literacy.

She was taken from this world far too soon. The Tammy Douglas Daybell Foundation was established by Tammy's family and friends on the first anniversary of her passing to honor her Life and Legacy. Tammy was dedicated to helping children love to read, and to getting as many books as she could into th...

Former Baltimore City State's Attorney Marilyn Mosby has been sentenced to 12 month's home confinement for perjury and mortgage fraud. Judge Lydia Griggsby said Mosby displayed a "pattern of dishonesty" during her time in office.

Mosby was behind the controversial decision to drop murder charges against Adnan Syed for killing his ex-girlfriend, Hae Min Lee, in 1999. In this article from October 2022, I argued that Mosby's decision to vacate Syed's conviction was a political move designed to improve her career prospects - an appeal against this decision by Hae's family is still ongoing.

24/05/2024

"The siren call of conspiracy is not limited to those merely accused of crime. From Scott Peterson to Adnan Syed to Steven Avery, big budget documentaries and slickly produced podcasts may use misinformation, police conspiracy theories, and emotional manipulation to convince millions their subjects are innocent, victims of a rigged system.

The financial return is vast, but so are the consequences. The victims are forgotten, their families left to relitigate again and again the guilt of their loved ones’ killers. The faith of the general public in the judicial system is shaken, endangering our communities and making it harder to bring justice to those who deserve it. And it’s not just victims who suffer. Inundated with false innocence stories, many in the public become jaded, and real cases of false conviction are less likely to be heard and less likely to be believed. The voices of the truly innocent are drowned out by the cacophony."

Superb article by Brett and Alice of The Prosecutors Podcast

Thoughtful true crime creators can build a loyal and large listener base, but for some, resisting the siren song of shock journalism and quick audience growth is too enticing to ignore.

"Professor Turco's initial report from 2017 clearly states in the introductory Summary: "It is not self-evident that these markings are runic inscriptions, nor is it immediately clear what they would mean if they were."

(State's Response to Defendant's Third Motion for Franks Hearing)

Some people may recall that I posted an analysis of the Delphi defense's "runic" interpretation of the crime scene recently. My conclusions were, in brief, that the supposed runic formations, if indeed they were runic formations, used two different runic alphabets, and that while "hagal(l)" rune may literally mean "hail", it means mean "hail" as in "worship", it means hail as in the weather - "hailstones".

It turns out that Purdue professor Jeffrey Turco, an expert on Norse mythology and Germanic Paganism, said in his report that it was not "immediately clear what [the runes] would mean if they were [runes]".

Looking forward to hearing the fabulous Jayson Blair discussing journalistic ethics in true crime with Kevin and Áine of The Murder Sheet and Dana Poll of True Crime P.I.

Given some of the shameful legal reporting we see, in which every entry on a court docket is reported as a huge development even in the mainstream press, and the disturbing actions of certain true crime content creators risk the integrity of the legal process and the safety of those around them, this is a really important discussion. Starts at 8pm EDT, 7pm CDT, and 1am GMT for my fellow night owls!

25/03/2024

The defense theory in the Delphi case is that sticks in the shape of runes were left on Libby and Abby's bodies. I did some research into runes which people will hopefully find useful. At times this may read as if I agree with the defence that the sticks and the "F" were runes - I don't, but I've looked at their theory as if I do.

Get in touch with me here, on Twitter, or [email protected] if you are interested in working with me on Delphi or any other case!

"The pattern looks very similar to an asterisk consisting of 3 tree branches all joined in the middle. ... This stick configuration is a spot-on resemblance for the rune called “Hagal”. This rune is used to depict the word ‘Hail”. Therefore, the combination of the Hagal rune found on Abby and the Ansuz rune found on the tree when combined would proclaim “Hail Odin.”" (Memorandum in support of Franks motion, pp. 26-27)

The rune "hagal" the defence describes is probably a psuedo-rune developed in the early 1900s, as part of the Armanen runes - these pseudo-runes are widely used in the Volkisch/White Nationalist Odinist groups, a philosophy which Brad Holder apparently held (at least at one point). Guido von List, who developed these psuedo-runes, gave its definition as "the All Nurturing/Cherishing, to enclose; Hail, to destroy." The SS used this rune to refer to faith in N**i ideology.

It is derived from the Younger Futhark rune "hagall", which does indeed mean "hail" - but it refers literally to the weather, ie hailstones, not the verb "to hail" someone/something. Even if we accept that the rune is the "hagall" rune from the Younger Futhark and the defence simply misspelt it, which is possible, it still doesn't mean what it has been described as meaning.

If the sticks were staged in order to say "Hail Odin", their runic knowledge appears to be somewhat lacking - they are either saying "Enclose Odin", "Destroy Odin" or "Hailstones Odin".

"The F resembles a rune called “Ansuz” which stands for “Odin”." (Memorandum, p.27)

The "ansuz" rune is used to refer to "god" and often (but not solely) to Odin. However, neither the Armanen rune alphabet from which the "hagal" rune comes, nor the Younger Futhark, contain the "ansuz" rune. "Ansuz" comes from the Elder Futhark. If runes were being depicted at the crime scene, either two different runic alphabets were being used or the defence has misidentified a rune.

The Armanen runes are particularly widely used in the White Nationalist Odinist groups, with which the defence have associated their five suspects. In my opinion none of the Armanen runes (see first picture) look like an F.

It should be noted that White Nationalist Odinism reflects a particular sect that claims to embrace Germanic Paganism, but in fact is more like a racist prison gang. Germanic Paganism also includes Heathens, groups such as The Troth who are neo-Pagan blending elements of Wicca and Heathenry, Asatru, and the Asatru Folk Association. Of these, only the Asatru Folk Association ascribes to the belief that Germanic Paganism should only be practiced by white people, but unlike Odinists they are not a violent White Nationalist group. The vast majority of practitioners of Heathenry/Germanic Paganism are entirely non-violent and non-racist.

The Armanen runic set contains the rune "us", which is derived from the Younger Futhark rune "oss". "Oss" refers to "god" - again, not solely to Odin. "Oss" is the corresponding rune to the Elder Futhark rune "ansuz".

It is possible that if the "hagal" rune was in fact the "hagall" rune from the Younger Futhark, and the F was one of the variations of the "oss" rune, that the only alphabet used was the Younger Futhark and the defence has misidentified the runes. Either two alphabets were used, or the defence has made a mistake.

Clearly I'm saying this without having seen the crime scene, however logically one can see that if the "hagal(l)" rune was used that means the Armanen or Younger Futhark was used, as the rune shape for "haglaz" is completely different (see pictures), and if the "ansuz" rune was used that can only be from the Elder Futhark.

The defence makes a further claim regarding Brad Holder and the F symbol which is somewhat misleading: "This “F” symbol was the same “F” symbol found in many of Brad Holder’s pages which will be attached, including Holder’s creepy self-drawn illustration in which a red “F” rune was found at the base of a tree where a man appeared to be sacrificed on a tree." (Memorandum, p.27)

Holder's painting is of Odin hanging from Yggdrasil, the tree of life. It is, to an extent, a depiction of a sacrifice - Odin was making *self-sacrificial* actions, none of which killed him. He was not sacrificed by another individual. It is a religious painting, not dissimilar to a Christian having a crucifix on the wall.

None of this means that the crime scene 100% was or wasn't staged and runes were or weren't depicted. It does mean that if runes were used it was in a way that doesn't make sense - while it may literally say "Hail Odin" (more accurately "Hail God"), the "hail" refers primarily to the weather. It also means either two runic alphabets were used, or the defence misidentified "oss" as "ansuz" (they do look essentially the same).

18/03/2024

Court TV's Barbara MacDonald has reported that a defence witness - one of the YouTubers that David Hennessy planned to call in today's contempt hearing in the Delphi case - was "involved in some kind of scuffle" and was then removed from the courtroom. She also said that it's unclear whether he will still be allowed to testify.

MacDonald did not name the witness in question, but Rick Snay has posted a live video confirming that he was kicked out - link here: https://www.youtube.com/watch?v=MvQlLqnOFyc&ab_channel=DelphiAfterDark - claiming that "Noe got in [his] face and [he] kept [Noe] backed up". Snay also said he "got right up nose to nose with the little son of a b*tch and said 'I'm gonna hurt you Noe ... I'm gonna choke you out and rip that f**king ugly face of yours off.'"

Snay also claimed to have been "staring [Sheriff] Tobe Lazenby down ... made eye contact with him, I wasn't going to look away until he did." He then claims Noe provoked him - clearly with some success - by repeatedly saying "Ricky" in a mocking voice, at which point Snay sarcastically blew him a kiss. Noe then "took a couple of steps toward [Snay], so [Snay] took a couple of steps toward him, and then everybody's all in between [them] and stuff, and somebody pulled [Snay] away".

Snay was listed as a defence witness, and he posted a live video on his "Delphi After Dark" channel before the hearing in which he anticipated this confrontation, saying "I'mma see Noe on Monday ... I can approach him. He can put up stuff about my wife all weekend if he wants - I'll see you Monday Noe." I'm not sure what Snay is alleging Noe said about his wife. It would be very easy to focus on the Delphi circus today. It would be easy to think about the crime scene photos allegedly leaked by Mitch Westerman.

This is who I'll be thinking about. Libby and Abby.
