Supreme Court Gives Woman “Free” Houses

A woman owned a huge farm in Ndeke - Lime Area - in Ndola. She had Certificate of Title to the land, which was legally given to her by Ministry of Lands.

Unknown to her, Ndola City Council (NCC) decided to offer people plots on the same farm between 2004 to 2006. Those that accepted the offers, paid and also had their building plans approved by the Council before they started constructing houses.

When the woman visited her farm, she was perplexed to find houses and some people had even moved in (fifty four houses). She demanded that they vacate her land but they refused saying they were given the land by the Council. The matter ended up at the Ndola High Court.

After a protracted trial, the Judge ruled that the houses could not be demolished or the owners removed because of the developments and some of the houses were even completed. The Judge ordered that Council should instead compensate the woman for having taken her land.

Unhappy with the Judgment, she appealed to the Supreme Court, arguing that she could not be forced to sell her land nor removed to pave way for the “squatters” whom she did not allow on her land.

Three Supreme Court Judges heard the case and held that the woman owned the land and that she cannot be forced to sell to pave way for “squatters”.

“The appellant, as the title holder to the property in question, is entitled to quiet possession and enjoyment of the whole property,” the Judges said, ordering the developers to vacate the land forthwith.

“The development on the land having become part of the land shall, in keeping with the law as we have explained it, now vests in the appellant landowner,” the judges said.

Simply, the Supreme Court ordered that the houses now belong to the woman who will decide what to do with them as they were built by squatters on their own risk.

The Court further ordered that those who built the houses should compensate the woman for trespassing on her farm and for loss of use of land to be assessed later.

“What is clear is that the appellant was not selling her property. She is entitled to quiet enjoyment of the whole of her farm,” the Judges noted, adding that the High Court Judge made a grave mistake to protect the trespassers.

“We entertain no doubt whatsoever that the lower court’s reasoning in coming to its decision was demonstrably wrong. It finds no support in law and just a little in reason,” they said, adding that the Judge used morality and not law.

The Judges also took a swipe at the Ndola City Council whom they accused of being corrupt.

“The Present dispute is also in many respects paradigmatic of the rot in the administration of many local government authorities in the country; breakdown of orderly systems, epitomized by a highly casual and suspiciously corrupt manner that animates land allocation by these authorities in many instances,” the Judges said.

Case citation - Prisca Lubungu v Obed Kabango and Others and Ndola City Council (Appeal No. 216/2016).

What a brilliant judgement. The Court used the Roman Law doctrine “quicquid plantatur, solo solo cedit” which simply means that whatever is fixed to the land becomes part of the land and therefore the owner of the land owns everything on it!

CAMNET TV REMOVED FROM DSTV

It must be noted that this is not the first time that the channel has faced the termination from the platform. The pay TV shared a notice that CAMNET TV will no longer be on its platform starting 1st February, 2025

Below are criteria to meet in order to sustain the slot on the DSTV decoder:

1. The channel must be able to pay the fees required.

2. The channel must reach the threshold of number of viewers per 24 hour cycle.

Failure to meet any of these, the channel will be removed from the platform and the decision is made by the owners of the platform.

A Zambian channel, Hope TV, owned by the Seventh Adventist, was removed and the owners were told that they failed to meet the requirements and they have since moved on.

At some point, there were a number of channels that could not be put on DSTV because the platform was full.

It's not easy to be on DSTV without viewership, even if you are paying your required amount.

In South Africa alone, there are over 50 channels that compete for space and only 2 or 5 make in two years. Example of these is Newsroom Afrika and eNca which fought tough competition.

Dandy Krazy’s daughter and I have a child, confirms Triple M

TRIPLE M, real name, Misheck Musonda has confirmed social media reports of having a child with late celebrated artiste Dandy Krazy’s daughter, Comfort Chibambo.

The artiste confirmed this on the Zed Podcast, and after the interview was posted, Triple M later revealed on his socials that he will be releasing a song titled Mwana Wanga (my child) this morning.

In the interview, Triple M disclosed that he has a five month old daughter with Comfort stating that he had taken full responsibility for the child contrary to social media rumours.

Barely a day after Dandy Krazy’s burial, social media went awash with reports that Triple M had impregnated the late musician’s daughter whom some people alleged that it even affected her education as she dropped out of university.

But Triple M has dismissed some social media reports suggesting that the daughter of the legend had dropped out of school because of him.

He mentioned that the two have been together for years and Comfort is old enough to make her own decisions.

“I won’t put that as a rumour, she’s not pregnant. Me and her have a child. We have had a child for a long time. Our baby is five months now. We have a baby girl,” stated the young artiste.

“I’m not too young to have a child and I can’t deny a child. Comfort is big and she has her own life.”

He further questioned what was wrong with him having a child with the girl he had been seeing for quite a long time.

Triple M added that people should understand that love doesn’t choose whom to fall in love with stating that love is a feeling that just happens which one cannot control.

“If that’s my girl, we have been dating for years. What’s wrong about me impregnating her and I keep the child? I’m supporting the child and she’s a blessing to us. Do you know how old Comfort is? What’s wrong about King Dandy having a granddaughter?” Wondered the artiste.

Triple M further stated that just because his fans didn’t know about his child and relationship doesn’t mean he didn’t want them to know.

"This should be the last time people will be hearing about my personal life because I don’t like people getting into my personal life despite being a public figure I also have family, personal issues. I’m not too young to have a child and I can’t deny a child. She’s big and she has her own life."

“I want people to have a sense of humanity in them, this person just lost her father, how do you talk about such,” said Triple M.

He added that some people on social media are lacking wisdom despite being educated.

January 14, 2025-The Zambia Police Service through Garden Police Post is investigating a shocking case of murder reported today, January 14, 2025, at approximately 16:30 hours.The report was lodged by Mr. Emmanuel Kalaba, aged 55, of House Number 1295 Chelstone Extension, who informed the police that his young brother’s wife, Mrs. Sylvia Mutoba Kalaba, had consistently refused him and other family members access to his younger brother, Mr. George Kalaba, on multiple occasions between July 2023 and January 2025.According to Mr. Kalaba, his concerns escalated when he visited the residence at approximately 06:00 hours this morning. Upon arrival, he found the house locked, with Mrs. Sylvia Kalaba and her children inside. He further interviewed the one of tenants, who revealed that he had not seen Mr. George Kalaba for the past two years and that Mrs. Sylvia Kalaba had been preventing anyone from visiting him.Acting on this report, police officers rushed to the scene. Upon gaining entry, they made a gruesome discovery: the remains of Mr. George Kalaba were found lying on a bed, reduced to a skeleton, suggesting he had been dead for a significant period.Mrs. Sylvia Kalaba, aged 51, and her children, identified as Natasha Kalaba (19), Sandra Kalaba (22), Wendi Kalaba (27), and a female juvenile (15), were found inside the house and had locked themselves in. They have since been apprehended and are in custody to assist with investigations.The skeletal remains of Mr. George Kalaba have been collected and deposited at the University Teaching Hospital (UTH) Mortuary, where a postmortem will be conducted tomorrow, January 15, 2025, to ascertain the cause of death.A docket of case has been opened, and investigations are ongoing

Pupils should not pay anything in government schools, warns government

GOVERNMENT has warned that no school head teacher or administration should ask pupils or parents to pay for anything in government schools.

Speaking at a press briefing in Lusaka yesterday, Ministry of Education spokesperson K***a Mando confirmed that government has taken up the full responsibility of paying for all expenses including books and uniforms for those who cannot afford it.

Mando warned that those schools purported to be charging pupils for aptitude tests will face disciplinary action once found guilty.

She said government had disbursed over K700 million school grants for the first term of 2025 throughout the country to over 13,000 schools.

Mando revealed that the grants were signed off last week and the money reached all school accounts yesterday.

She added that over K300 million has been allocated to secondary schools while K200 million has been given to primary schools.

Furthermore, she stated that Colleges of Education and the District Education Boards have been allocated K200 million.

“The Ministry of Education has taken up the amount of money paying on behalf of all Zambians through the free education policy.
We are not expecting any school to charge any pupil with anything. Every learner has the right to free education. We have heard that some schools are charging for aptitude tests. They are not supposed to pay and we have a social protection programme for the poor who can’t afford uniforms and other things,” she said.
