সোর্স ও ফোরনেটশা বাংলাদেশ লিমিটেড -এর বিরুদ্ধে কপিরাইট দ্বন্দ্বে প্রথম প্রফেশনাল বাংলাদেশি মাঙ্গা আর্টিস্ট শান্তনা শান্তুমা’র অবিস্মরনীয় জয়:

মাঙ্গা বা জাপানি কমিক্স আর্টফর্ম বর্তমানে তরুণ প্রজন্মের কাছে ব্যাপক সমাদৃত ও পরিচিত। সারা বিশ্বে মাঙ্গার বাজার প্রায় ১২ বিলিয়ন মার্কিন ডলারের। মাঙ্গা জাপানে শুরু হলেও বর্তমানে জাপানের গণ্ডি ছাড়িয়ে আমেরিকা, ইন্দোনেশিয়া, ফ্রান্স, অস্ট্রেলিয়াসহ বিভিন্ন দেশে নিজস্ব শিল্পী দ্বারা দেশীয় মাঙ্গা প্রস্তুত হচ্ছে। এরই ধারাবাহিকতায় ২০১৬ সালে শান্তনা শান্তুমা শিল্পীযুগল প্রথম বাংলাদেশি মাঙ্গা প্রকাশ করেন। তারা ২০১০ সাল থেকে মাঙ্গার চর্চা করতেন। ২০১৮ সালে তারা দেশীয় মাঙ্গা চর্চা ও প্রকাশের জন্য মাংগা স্টেজ নামে কেবল মাঙ্গার জন্যই একটি প্রকাশন চালু করেন। পাশাপাশি স্বনামধন্য বেশ কিছু পাবলিকেশন তাদের অঙ্কিত মাঙ্গা নিয়মিত প্রকাশ করে আসছে।

হঠাৎ ২০২৩ সালে ফোরনেটশা বাংলাদেশ লিমিটেড নামক একটি প্রতিষ্ঠান সোর্স নামক একটি ম্যাগাজিন প্রকাশ করে এবং সেখানে প্রকাশিত মাঙ্গাগুলোকে দেশের প্রথম মাঙ্গা বলে দাবী করে। ব্যাপারটি শান্তনা শান্তুমা’র দৃষ্টিগোচর হলে তারা সোর্সকে মিথ্যা দাবী থেকে সরে আসতে বলে। সোর্স কর্ণপাত না করলে শান্তনা শান্তুমা বাংলাদেশ কপিরাইট অফিসের নিকট সোর্সের বিরুদ্ধে অভিযোগ দাখিল করে। ফলশ্রুতিতে, সোর্স তাদের অন্যায় স্বীকার করে ক্ষমা প্রার্থণা করে। পাশাপাশি, তারা আর এধরণের দাবী ও প্রমোশন করবে না স্বীকার করে একটি সমঝোতা চুক্তিপত্র স্বাক্ষর করে। কিন্তু গতবছর ২০২৪ সালে তারা পুনরায় নিজেদের বাংলাদেশি মাঙ্গার প্রণেতা দাবী করে নানা মাধ্যমে বিজ্ঞাপন প্রচার শুরু করে এবং সোর্স -এর মাঙ্গাই বাংলাদেশের প্রথম মাঙ্গা এরূপ মিথ্যা বক্তব্য বিজ্ঞাপনগুলোতে প্রচারিত হয়।

এর প্রতিক্রিয়ায় শান্তনা শান্তুমা পুনরায় বাংলাদেশ কপিরাইট অফিসের কাছে ২১ অক্টোবর ২০২৪ তারিখ অভিযোগ দাখিল করেন। বাংলাদেশ কপিরাইট অফিস অভিযোগটি অত্যন্ত গুরুত্বের সহিত আমলে নেয় এবং ২০ জানুয়ারি ২০২৫ তারিখে অভিযুক্ত ফোরনেটশা বাংলাদেশ লিমিটেড এর ব্যবস্থাপনা পরিচালক এস এম নাসির হোসেন নয়ন ও প্রমোটার হিশাম ইকবাল এবং অভিযোগকারী শান্তনা শান্তুমার উপস্থিতিতে বাংলাদেশ কপিরাইট অফিসে একটি শুনানি অনুষ্ঠিত হয়। শুনানিতে উপস্থিত পক্ষদ্বয়ের বক্তব্য থেকে সংশ্লিষ্ট অভিযোগটির সত্যতা পাওয়া যায় যে, শান্তনা শান্তুমা -ই স্বীকৃত প্রথম বাংলাদেশি মাঙ্গা আর্টিস্ট কিন্তু সোর্স অবৈধভাবে নিজেদের প্রথম দাবী করে আসছিল। এছাড়াও প্রমান হয় যে, সোর্স ও ফোরনেটশার কর্মকাণ্ড দ্বারা বাংলাদেশি মাঙ্গার প্রণেতা শান্তনা শান্তুমা ভোগান্তি, অসম্মান, মানসিক চাপ ও আর্থিক ক্ষতির শিকার হয়েছেন।

শুনানির পরিপ্রেক্ষিতে গত ৩০ এপ্রিল ২০২৫ এ সিদ্ধান্ত হয় যে, কপিরাইট আইন ২০২৩ এর ১০ ধারার ক্ষমতাবলে সোর্স ও ফোরনেটশা’র মিথ্যা দাবিমূলক সকল কটেন্ট অবিলম্বে অপসারণ করতে বাধ্য থাকবে।

আরো আদেশ হয় যে, শান্তনা শান্তুমা সোর্স -এর বিরূদ্ধে কপিরাইট আইন ২০২৩ এর ৭৭, ৮৪, ১০৬ ও ১০৭ ধারায় দেওয়ানি এবং ফৌজদারি মামলা দায়ের করার অধিকারী।

Bangladesh’s First Professional Manga Artist Shantona Shantuma Won the Copyright Battle against SOURCE? by Fournetsha:

Nowadays, Manga, the Japanese comic art-form is one of the most popular topics for young generation and comic book lovers. The global market for manga is currently around 12 billion USD. Although manga originated in Japan, it has become an international trend in recent decades. Now, manga is being created by many nations including the USA, Indonesia, France, Australia and so on in their own native format and language. Following that, Shantona Shantuma published the first Bangladeshi Manga in 2016. They initially started to draw manga in 2010. In 2018, they founded a manga publication called Manga Stage to publish and promote native manga. At the same time, several other renowned publications have been publishing manga created by the manga artist duo.

Despite the active presence of Shantona Shantuma in the pop culture community as both creators and manga educators, in 2023, Fournetsha Bangladesh Ltd came up with a magazine called Source and promoted the manga from the magazine as the first Bangladeshi manga. Noticing their false promotion, Shantona Shantuma alarmed Source to take down those promotional materials. Denying the warning, Source continued their promotion. To resolve the issue, Shantona Shanuma filed a complaint against Source by Fournetsha in the Bangladesh Copyright Office. As a result, Source admitted their wrongdoing and sought forgiveness. Both parties then signed a MOU where Source clearly declared that they will never claim to be the first manga publisher of Bangladesh and their manga is not the first Bangladeshi manga. Shantona Shantuma took down the complaint afterwards.

However, last year in 2024, Source once again claimed to be the creator of the first Bangladeshi manga and started enormous promotion using online social media promoters. In response to their fraud activities, Shantona Shantuma again filed a second complaint in the Bangladesh Copyright Office on 21 October, 2024. In 20 January, 2025, with the presence of the convicted party’s Managing Director S M Nasir Hossain Nayan and promoter Hisham Iqbal aka Hisham Talks About Anime as well as Shantona Shantuma, a hearing was held in the Copyright Office and Source was proven guilty. Also it was clear from the hearing that, Source falsely claimed their manga to be the first on purpose and Shantona Shantuma is the rightful first manga artist of Bangladesh and inventor of Bangladeshi Manga. It was also proven that, Source created financial damage and defamed the manga artist duo.

On 30 April, 2025, a decision was made by the Copyright Office that ordered the removal of all false promotions made by Source and Fournetsha Bangladesh Ltd. at once. At the same time, complainant Shantona Shantuma reserves the authority to file both Civil and Criminal cases against Source by Fournetsha under sections 77, 84,106 and 107 of the Copyright Act 2023.
