End Hazara Persecution

This client came to BR Legal with a Notice of Intention to Consider Cancellation of his visa by the Minister’s delegate. We saved his visa despite the complex nature of his identity documents (two sets of each ID document containing inconsistent information), conflicting details of his life story and scientifically disproven family composition.

Around the same time he received a lengthy Citizenship adverse information letter seriously questioning his identity and character. We submitted a comprehensive response with plausible explanations, sound reasons and country information mounting arguments in favour of his character and identity. Credit to the Department, they saw the merits of our compelling reasons and approved our client’s Citizenship.

We are pleased to have assisted this vulnerable client finally seeing the brighter side of the Department illuminating his life with hope and certainty confirmed by the Minister’s letter. This is the kindest letter he has ever received from the Australian Government. Fearing cancellation of his visa and potential deportation to Afghanistan, this client was so fearful of the Government that he has not traveled to see his family for the last 13 years.

BR Legal is proud of being the source of soul solacing service. At long last, this powerless client will be able to derive the courage from the power of his citizenship and travel to see his family, and likewise his wife and children will have the opportunity to see him. We are extremely thrilled to belatedly announce that Stephanie Margush has been promoted to an Associate to the firm. She is a lynchpin of our small team. We have watched her develop from an intern to a paralegal and now a highly competent young lawyer with an impressive record of achievement. However, what places her above the cohort of bright young lawyers is the way she combines her talent, skill and creativity with a passion for her work and compassion for her clients. In 2022, Stephanie was named as a finalist in the Lawyer’s Weekly 30 under 30 Awards for Migration Law.

Stephanie has achieved so much in her short career so far and has developed into an exceptional young lawyer working on many complex cases. Stephanie has a great track record of success in the AAT with reviews of citizenship refusals, visa cancellations and visa refusals, citizenship adverse information responses, judicial review matters in the Federal Court, commercial disputes, IAA reviews and Partner Visas. Stephanie has successfully challenged the Immigration Department’s citizenship procedural instructions at the AAT. This is a major achievement in the administration of justice as Stephanie brought the interpretation and proper application of the law at the centre of attention, which continues to impact the outcome of subsequent cases mainly for clients who normally find it hard to establish their identity.

Stephanie is the head of our Citizenship, Natural Justice, Protection Visa and Ministerial Intervention practice areas and provides supervision of our junior staff. We are confident that our Associate will continue to be a shining star of the Australian legal industry for many years to come.

خسته نشوید؛ هشتگ بزنید!


این هشتگ به مرز ده ملیون نزدیک شده، و صدای دادخواهی، تا دورترین گوشه‌های جهان هم شنیده می‌شود. اکنون باید مطمین شده باشیم که رسانه‌های اجتماعی، چه قیامت و چه محشری است. ده ملیون هشتگ یعنی ده میلیون صدا، و این دستاورد بزرگی است.

اما این تازه آغاز کار است. صداهای ملیونی برای رسیدن به هدف، سرگرم هموار کردن مسیر و بستر مناسب استند. یادتان است این صداها - که از چهارراهی دهمزنگ آغاز شده بودند - موعود، کوثر، دانش، لیسه‌ی سیدالشهدا، غزنی، زابل و گلوی بریده‌ی تبسم را فریاد می‌زدند. تا بدانجا که بالاخره این صداها فراتر از مرزهای افغانستان، شروع به جهان‌نوردی کردند. از پارلمان اروپا تا پارلمان امریکا و آسترالیا و هالیوود و کجا و کجا و کجا را گرفتند و دوباره به نیت همصدایی، از این‌جاها هم بازفریاد شدند.

اکنون اما به قول رفیق “دریابی”، روز جواب به سوال های اصلی است:

مثلن اگر بنده‌زادی از ناکجا آباد بیاید و از شما بپرسد که: (څه شي غواړئ؟) حد اقل این سه جواب باید داده شوند:

۱ - به رسمیت شناختن نسل‌کشی هزاره‌ها توسط سازمان ملل
۲ - تحقیق و بررسی همه‌جانبه و بی‌طرفانه از سوی یک نهاد معتبر بین‌المللی
۳ - ارایه‌ی راهکار از سوی سازمان ملل برای جلوگیری از این جنایات ضد بشری

به قول حبیب خان:
“به رسمیت شناختن نسل‌کشی‌ هزاره‌ها، به هیچ قوم افغانستان آسیب نمی‌رساند. فقط شهروندان هزاره‌ی ما محافظت می‌شوند، و تنها ضرر آن به تروریستان و دشمنان افغانستان است.”

بنیاد بابه مزاری استرالیا توزیع کمکهایش را برای آوارگان جنگ بلخاب شروع نمود.
بنیاد از 16- 26 جولای 2022 توزیع کمکهایش برای بیجا شده گان جنگ بلخاب را با حضور داشت همکاران رضا کارش داکتر ضیا حسنی، حسن اخلاصی و مدیر انکشاف دهات ولسوالی نمبر ۱ یکاولنگ شروع نمود. داکتر ضیا حسنی ابتدا با مراجعه به نهاد های حکومتی محلی امر توزیع کمک را از این نهاد ها اخذ نموده سپس به سروی و توزیع کمکها اقدام نمود.
• در مرحله اول برای 20 خانواده آواره که در سرخ قول بالا از نواحی مرکز بامیان، لرسی و چمن یکاولنگ موقتا جابجا شده بودند یک بسته کمکی شامل یک بوری آرد 50 کیلویی، روغن 5 لیتره، برنج سیله 20 کیلویی، 12 بسته مکارونی، یک کیلو پودر لباسشویی و یک کیلو چای می شود را توزیع نمود.
• در مرحله دوم برای 80 خانواده آواره، بسته های کمکی درایلاق بیک علی توزیع گردید. چون سرک مواصلاتی در تمامی ایلاقهای که آواره ها جابجا شده بودند وجود ندارد، تیم بنیاد ایلاق بیک علی را مرکز توزیع کمک تعیین نموده سپس با آواره ها هماهنگی لازم صورت گرفت. درنتیجه برای 80 خانواده از ایلاقهای، سرسنگ و زرد تاله از مربوطات یکاولنگ نمبر 2 و ایلاقهای بلخاب ماننده انبورک، راه گردان، تخت سنگ، روم، سرسنگ ها، آب قول ، خارزرک ، کمریخ ، کته ولنگ، سنگ چاک ، تورگان و سایر ایلاق های ولسوالی بلخاب و ولسوالی یکه ولنگ آمده بودند بسته کمکی شامل دوتخته کمپل، آرد 50 کیلوی ، روغن 5 لیتره، برنج 20 کیلوی ، 12 بسته مکارونی، یک کیلو چای سبز ، یک کیلو پودر لباسشوی ، یک کیلو نمک بود توزیع گردید.
بنیاد به منظور موثریت کمک ها و مطابق نیازمندیهای خانواده های بیجا شده پیش از پیش جلسات هماهنگی را با موسسات ملی و بین المللی دخیل دراین امر برگزار نمود.
بنیاد همچنین 100 خانواده دیگر را نیز سروی می نماید و در مراحل بعدی برای شان کمک توزیع خواهد نمود.

Since the forceful takeover of Afghanistan by Taliban on August 15 2021, thousands of Hazara families are ordered to leave their homes and lands by the Taliban. In the province of Daykundi alone, up to 3,000 families are displaced. Just 2 days ago, in the district of Qubat Al-Islam in the city of Mazari Sharif, up to 4,000 families were ordered to evacuate their homes by this Saturday.

The Taliban are also driving thousands people out of their land in Panjshir and Kandahar.

Winter is approaching and these families have no where to go.

Please join us this Saturday, 16 October 2021, and raise your voice against Taliban’s brutality, and say no to the forced displacement of thousands of innocent families. We all have a moral obligation to defend and speak up for the millions of powerless and voiceless people of Afghanistan.
