The importation of pre-owned automobiles that have been in use for more than a decade since their manufacturing date has now been completely prohibited. Individuals who bring such vehicles into the country will be obligated to bear the expense of sending them back to their country of origin.

On the 54th Statutory Instrument of 2024, titled as Control of Goods (Import and Export) (Commerce) (Amendment) Regulations, 2024 (No. 10), which was published by Industry and Commerce Minister Mangaliso Ndlovu , the previous requirement for an import license for older vehicles in 2021 has been removed and replaced with an outright ban along with a mandatory re-export provision.

According to the new regulation, "Second-hand vehicles aged 10 years and above from the date of manufacture shall not be imported. Any second-hand vehicle prohibited under this subsection shall be re-exported by the owner of the said vehicle at his or her expense."

However, the ban does not apply to the importation of commercial vehicles, tractors, haulage trucks, earth-moving equipment, and other specialized vehicles used in mining and construction sectors.

In his budget statement for the period of 2020-2021, Finance, Economic Development, and Investment Promotion Minister Mthuli Ncube explained that the prohibition on importing older used cars was implemented to reduce the import bill and support the domestic automotive industry.

Minister Ncube highlighted that Zimbabweans had spent approximately US$1.3 billion on the importation of buses, light commercial vehicles, and passenger motor vehicles from 2015 to September 2020.

"This is despite the local motor industry's capacity to assemble the aforementioned range of motor vehicles," he stated.

"Moreover, due to the lack of effective standards and regulations, unroadworthy vehicles that fail to meet environmental and safety standards sometimes find their way into the market.

"In accordance with the National Development Strategy 1, which emphasizes value addition, I propose the exclusion of second-hand motor vehicles aged 10 years and above, from the date of manufacture at the time of import, from the open general import license."

Consequently, each imported vehicle will now require a special import license.

A tragic incident unfolded when a teenage boy, who was on the verge of taking his O' Level exams, was fatally shot in the head. The shooter, Humphrey Gara, mistakenly believed the boy to be an intruder at a house where the boy had previously worked. Gara was found guilty of culpable homicide but claimed he acted in self-defense.

Following a full trial presided over by High Court Judge Justice Cathrine Bhachi-Muzawazi, Gara has been sentenced to an effective 12 months in prison. Initially, he was handed a three-year sentence, but one year was suspended on the condition of good behavior. An additional year was suspended on the condition that he compensates the victim's family with an agreed-upon amount.

The unfortunate incident occurred while Gara was at his mother-in-law's house, where he fired multiple shots that resulted in the unarmed teenager's death. Justice Bhachi-Muzawazi determined that the force used was disproportionate to any perceived attack, if one had indeed occurred.

The judge stated, "In our reasoning, a gun is a lethal weapon matched only to another gun or modern weaponry. In that regard, we made a finding that by discharging five bullets into the deceased's head, the accused exceeded any possible limit of self-defense, if any, and displayed recklessness and negligence in causing the death of the victim."

Furthermore, the judge noted Gara's lack of remorse, as he failed to provide assistance during the teenager's funeral. "From the inquiry, it was evident that he never made any meaningful efforts to engage or compensate the deceased's family even three years after committing the offense. Representatives of both families should have been involved to facilitate traditional compensation or restorative justice mechanisms. Additionally, the severity of the victim's injuries, with several wounds resembling bullet entry points on his chest and one on his forehead, further aggravates the situation."

An employee from the N Richards Group went to court last Friday after being accused of stealing more than US$17,000 from the cash office and creating a counterfeit payment voucher for US$18,800, which was supposedly made by a customer. The employee in question, Simba Shelton Piroro, works as a customer help desk consultant at the wholesaler.
