Islamabad High Court acquits Imran Khan, Shah Mahmood Qureshi in Cipher case | Khabar Nagar
The Islamabad High Court (IHC) on Monday acquitted the Pakistan Tehreek-e-Insaf (PTI) founding chairman Imran Khan and PTI leader Shah Mehmood Qureshi in the Cipher case.
The court suspended their 10 year sentence as it heard the appeals by the incarcerated ex-PM Imran and former foreign minister Shah Mehmood Qureshi.
Chief Justice Amir Farooq and Justice Miangul Hassan Aurangzeb announced the verdict.
On January 30, the special court established under the Official Secrets Act awarded Imran and Qureshi 10 years imprisonment in the high-profile cipher case.
On March 19, the IHC noted that the speeches delivered by Imran and Qureshi at a public rally in Islamabad on March 27, 2022, "appear to be political in nature."
A division bench comprising the IHC Chief Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb hear the appeals.
The PTI's lawyer informed the court that in the case, Imran and Qureshi were accused of illegally possessing the secret document, disclosing classified information to the public, and manipulating it for personal gain.
“However, even the special court judge [who convicted the PTI leaders] was not shown the said diplomatic cipher,” he said.
Chief Justice Farooq remarked "If the information has been twisted, then it should be known what the information was."
Barrister Safdar stated that the PTI leaders were accused of holding and misusing classified information for their purposes. However, in this case, the prosecution failed to link the alleged crime with revealing secrets concerning the armed forces and sensitive areas to foreign powers.
Justice Aurangzeb inquired, "What was written in the cipher?"
The lawyer replied, "I haven't seen the cipher, so I can't tell what is written in it." He said the cipher code or its text has not been shared anywhere.
“On one hand, it is said that the PTI founder has made everything public; on the other hand, it is said that if the cipher is shown, it will become public."
The court asked what was communicated from Washington in the cipher. It said the person who had sent that communication must have pinpointed what might compromise our security if it fell into the hands of India. The bench noted there was nothing unusual in the information shared with the court.
The FIA prosecutor reminded the court that they were awaiting the court's permission to present arguments against the maintainability of the appeal.
The bench noted that it would deliver a verdict on the merit of the appeals as well as their maintainability at the same time.
At the next hearing, Imran Khan’s counsel Barrister Salman Safdar contended before the IHC that registering the cipher case only against his client was an ‘act of retaliation’ as others had not returned the copies of the diplomatic cable until it was filed.
Safdar maintained that the requirements of a fair trial under Article 10A had not been fulfilled. The lawyer told the court that the diplomatic cable was not shown to the investigation officer (IO) terming it ‘secret’.
The bench observed that the judge could have ordered under the Official Secrets Act that the document should be shown after removing all the people from the courtroom.

The cypher
The case originated from Imran's public display of a paper during a rally in Islamabad on March 27, 2022, claiming it as evidence of an "international conspiracy" before a vote of no-confidence led to his government's ouster.
The FIA initiated its probe into the so-called “cypher-gate” on July 19, 2023, after the previous coalition government announced an official inquiry against Imran and his close associates for violating the OSA.
Imran was arrested on August 5, following his conviction in the Toshakhana case by a local court of Islamabad. Later, he was also arrested in the cypher case on August 29.
As per the challan papers, both Imran and Qureshi, the former foreign minister, were charged under sections 5 and 9 of the OSA. These provisions entail the possibility of the death penalty or life imprisonment.
Previously, the cypher trial had started inside the Adiala jail but an IHC division bench later annulled all those proceedings, ordering a fresh open court trial.

No verdict in Iddat case today as judge seeks transfer of appeals to another court
PTI supporters, lawyers angry at Maneka's 'delaying tactics' assault him in and outside courtroom

In a dramatic turn of events, the sessions judge hearing the Iddat case sought its transfer to another court on Monday without announcing the reserved judgment many thought would overturn the incarcerated premier Imran Khan and his wife Bushra Bibi’s conviction.
Judge Shahrukh Arjumand left the courtroom after complainant Khawar Maneka expressed no confidence in him. The complainant made emotional arguments after asking the court to grant him 10 minutes to speak.
Shortly after, the judge wrote to the Islamabad High Court (IHC) requesting it to fix the case for hearing in some other court.
Judge Arjumand wrote in the letter “Though earlier application of complainants has already been dismissed in this regard on April 30, 2024, but I think it will not be appropriate to decide the lis when specific objection has been raised on the Presiding Officer.”
It added “As arguments at length were heard in the matter, therefore, it is humbly submitted to transfer the appeals to any other court of competent jurisdiction.”

“It is further submitted that complainant and his counsel always tried to frustrate and delay the proceedings on one pretext or other, therefore, time frame may be fixed for disposal of appeals,” the judge wrote.

Today’s hearing

As the hearing commenced, an hour later than scheduled, Maneka appeared before the court along with his counsel Rizwan Abbasi.

The judge observed that prosecutor Abbasi was yet to present arguments on two points, following which he stepped onto the dais. However, Maneka requested the court for some time to present his arguments. At this, the judge asked him to let his counsel speak first. “My lawyer will not be able to explain my suffering. I will speak myself,” replied Maneka.

At this point, Bushra Bibi’s counsel Usman Gill urged the court to issue contempt notices to Maneka for interrupting court proceedings.
Maneka asked for 10 minutes of speaking time, saying he belonged to a village and that rumors were being spread about him and his daughter's divorce every day. “Fake divorce letters are being made and spread on social media,” the complainant maintained.
Maneka’s interruption irked the PTI counsels who got into a heated argument with the former. Judge Arjumand then intervened asking the lawyers if they wanted to create scene.
“Today, respect is being demanded for a person who has served as the former premier. Why not grant a poor man the same respect too?” asked Maneka as he compared himself to Imran.
“I am being threatened. Listen to this poor man. I don't believe in this court. I only believe in the Almighty. Think of me as a poor person, and realize what my family has suffered. My house has been destroyed,” he lamented.
He then asked the judge to not make a decision, alleging that he appeared to have been “influenced”.
Judge Arjumand remarked that it was not possible for him to transfer the case at this stage. However, he observed that any decision he now makes would be controversial. The judge then left the courtroom.

Maneka assaulted
Angry at Maneka for using "delaying tactics", PTI women members inside the courtroom began sloganeering against him. Some threw water bottles at him and even slapped him.
He was then assaulted outside the courtroom by a man said to be a PTI lawyer as a group of his counsels escorted him outside the court premises.

Decision reserved
An appellate court last week reserved its decision on the appeals filed by Imran and Bushra against their conviction in a case concerning their marriage during the iddat period.
In February this year, after a jail trial, senior civil judge Qudratullah sentenced former premier Imran and his wife to seven years in jail, along with a Rs0.5 million fine each, for “contracting marriage during the ‘Iddat’ (period of waiting)” of the former first lady.
During the last hearing of the case in the court of Islamabad District and Sessions Judge Shah Rukh Arjumand, Bushra Bibi's lawyer, Usman Riaz Gill, argued that Bushra’s former husband Khawar Maneka filed a complaint against the couple after a significant delay of six years.
He stated that initially, an unknown individual, Muhammad Hanif, filed a complaint, accusing Imran and Bushra of marrying without the completion of Bushra’s mandatory iddat period. Gill noted that Muhammad Hanif did not appear in the trial court and had no connection to the case.
In May 2023, a district and sessions court in Islamabad declared Hanif's petition inadmissible.
According to Gill, Maneka later filed a similar petition through the same counsel, Raja Rizwan Abbasi Advocate, who had filed the first plea.
“The court has to examine evidence from both complaints. During the trial, some questions were posed to M***i Muhammad Saeed—the cleric who solemnized Imran’s marriage with Bushra on January 1, 2018—to clarify his role,” he added.
Gill said the allegation is that the second marriage took place during the iddat period following a divorce. However, the document presented to the court was a photocopy. He provided guidelines to the court on determining the authenticity of the document.
He asserted that by the time the complaint was filed, the iddat period had already been completed, making the marriage lawful. He said Bushra Bibi, in her statement, mentioned the divorce occurred in April 2017, and she completed the iddat period before remarrying.
Defending the trial court’s order, Deputy District Prosecutor Adnan Ali argued that completing the iddat period is essential for the validity of the marriage.
He mentioned that Khawar Maneka and Bushra Bibi were happily married for 28 years with five children until PTI's founder interfered in their lives, leading to the divorce. “Maneka intended to reconcile, but Bushra Bibi remarried during the iddat period.”
A judicial magistrate on February 3 sentenced Imran Khan and Bushra Bibi to seven years imprisonment in the iddat case. Senior civil judge Qudratullah, while announcing a reserved verdict, also imposed a Rs500,000 fine each on the PTI founding chairman and his wife.
Maneka, in his complaint, had alleged that Bushra violated the Islamic practice of observing the mandatory pause, or iddat, before marrying Imran. He had also accused his ex-wife and Imran of having an adulterous relationship before their marriage. Iddat is a mandatory waiting period that a Muslim woman must observe on account of the death of her husband or the dissolution of the marriage.

PTI’s Raoof Hasan attacked by transgender persons in Islamabad

Raoof Hasan, the central spokesperson for Pakistan Tehreek-e-Insaf (PTI), was attacked by a group of transgender individuals in Islamabad on Tuesday.
Sources reveal that Hasan had just finished recording a segment for a private TV channel and was leaving the premises when the incident occurred. Four transgender individuals launched the assault.
The assailants used a blade to target the PTI leader, inflicting injuries on his face. Following the attack, the perpetrators managed to flee the scene with ease.
In response to the assault on Hasan, PTI staged a walkout from the Senate, condemning the attack and demanding swift action from the authorities.
Hasan has been transferred to a hospital for medical treatment.
This incident was raised in the Senate by PTI Senator Shibli Faraz, who informed the upper house during a session, calling the incident “unacceptable.”
“The spokesperson for the largest party of Pakistan has been attacked. This is shameful and unacceptable,” he added.
Federal Information Minister Attaullah Tarar responded, stating, "The opposition leader has just shared this matter. Who attacked, where the attack occurred – these issues will be examined as per law. Raoof Hasan should file a report, and action will be taken according to the law."
He also assured that he would inform the house after obtaining a report from the IG Islamabad or the relevant officials.
According to the spokesperson for Islamabad Police, Hasan was attacked with a blade outside a private TV office. “Eyewitnesses reported that transgender individuals struck Raoof Hasan on the face with a blade,” he added.
He said that the police officials were present at the scene and collecting evidence. “Strict action will be taken against the transgender individuals involved in this attack,” he further said.

Iran helicopter crash updates: President Raisi, FM Amirabdollahian die
A helicopter carrying Iran’s President Ebrahim Raisi and other officials was involved in a “crash upon landing” in the mountainous Varzaqan region of the country under poor weather conditions on Sunday, state media Islamic Republic News Agency (IRNA) reported, with search and rescue efforts underway but no news yet on his condition.
Foreign Minister Hossein Amirabdollahian, Governor of East Azerbaijan province Malek Rahmati and others were also onboard the convoy, which comprised of three helicopters, of which the other two have landed safely.
The accident occurred when Raisi was returning from his visit of East Azerbaijan province where he inaugurated a dam project in the company of his Azeri counterpart, Ilham Aliev, on the border between the two countries.
