BY-ELECTIONS SET FOR 3 FEBRUARY 2024 IN SIX CONSTITUENCIES FOLLOWING THE RECALL OF MPs WHO CEASED TO BE CCC MEMBERS

President Emmerson Dambudzo Mnangagwa has today issued Statutory Instrument 235 of 2023, under Proclamation 10 of 2023, ordering new elections on 3 February 2024 for the constituencies of Pelandaba, Goromonzi South, Seke, Chegutu West, Zvimba East and Mkoba North.

Vacancies in these six constituencies occurred after the recall of MPs who ceased to be members of the CCC, under which they were elected on 23/24 August 2023.

The nomination courts for the six by-elections shall sit on 18 December 2023.

ESWATINI REJECTS MUMBA'S APPOINTMENT AS SADC OBSERVER

In a surprising turn of events, Eswatini has voiced strong reservations against Dr Nevers Mumba's appointment as the Head of Southern African Development Community (SADC) Election Observer Mission for that nation's forthcoming elections scheduled for 29 September 2023.

A credible source informed our publication that the initial appointment of Dr Mumba was made by Zambian President, Hakainde Hichilema.

President Hichilema who is presently serving as the Chair of SADC Organ on Politics, Defence and Security Cooperation, however, was compelled to reverse this decision due to mounting concerns from the people of Eswatini.

According to the source, the objection stems from Mumba's recent involvement in Zimbabwe's elections held last month. His credibility as an impartial observer came under scrutiny after he delivered a contentious election report.

The source said that there were growing apprehensions within Eswatini that Mumba might compromise their electoral process similarly, endangering the democratic foundation of the nation.

The source revealed, "The people of Eswatini are fiercely protective of their democratic rights. They believed Mumba's appointment could potentially jeopardize the integrity of their election, given the controversies surrounding his recent report in Zimbabwe."

Responding to these concerns, President Hichilema was quick to act and promptly replaced Mumba with Enock Kavindele, former Vice President of Zambia.

The SADC Secretariat verified this change in leadership for the observer mission by announcing on their X (formerly Twitter) page, that, ", Chair of Organ on Politics, Defence & Security Cooperation appoints H.E Enock P. President Mnangagwa Appoints Another Chunk of Deputy Ministers

In a move aimed at strengthening and enhancing the efficiency of the Zimbabwean government, His Excellency President Emmerson Dambudzo Mnangagwa has appointed another batch of deputy ministers to oversee key sectors of the economy and society. The appointment of these individuals is in accordance with Subsection 2 of Section 104 of the Constitution of Zimbabwe, which grants the President the power to select deputy ministers.

▪️One of the appointed deputy ministers is Hon. Polite Kambamura, who will be Deputy Minister of the Mines and Mining Development portfolio. This appointment is expected to bring a fresh perspective in the mining sector, one of the country's critical industries, as the government continues its efforts to harness the potential of natural resources for economic growth and development.

▪️Another important appointment is that of Hon. Chido Sanyatwe, who will be Deputy Minister for Home Affairs and Cultural Heritage. With this appointment, the government aims to promote a safer and more secure environment for all citizens, while also recognizing the importance of preserving and promoting the cultural heritage of Zimbabwe.

▪️Lastly, Hon. Roy Bhila has been appointed as the Deputy Minister of Industry and Commerce. This appointment comes at a crucial time when the government is striving to boost industrial growth and create a favorable business environment, ultimately fostering economic prosperity and attracting investment to the country.

▪️These appointments are a testament to the government's commitment to addressing the specific needs and challenges faced by different sectors. PRESIDENT ED MNANGAGWA NARRATES HIS LIFE HISTORY AT HIS 81TH BIRTHDAY... 🇿🇼✍️

Yesterday on the occasion of his 81st birthday celebrations at state house, His Excellency President Emmerson Dambudzo Mnangagwa spoke about his life.

▪️Here is a man who was born some 81 years ago in Zvishavane to peasant farmers Mafidi Mnangagwa and Mhurai. Mafidi the father was a son to Mubengo / Kushanduka a fighter who served under the Mzilikhazi regiment.

▪️The grandfather Mubengo gave his grandson a Ndebele name Nhlupeko which the father changed to vernecular and named him Dambudzo. According to President ED Mnangagwa’s narration he named himself Emmerson after he read a book with a character Emmerson. While at Hodgson college in Zambia, he was involved in student politics and was a member of the United National Independence Party (UNIP) Youth league structures as early as 1959.

▪️Together with fellow youth members they protested against colonial administration and were expelled from school. He worked at the UNIP Headquarters in Zambia Lusaka where Zimbabwe nationalists frequented. Since he was the only UNIP member who could speak shona, chichewa and english he became a go between ZAPU officials from Zimbabwe and UNIP officials. One of ZAPU leaders whom he interfaced with was the late Willie Musarurwa who recruited the then young ED to join ZAPU.

▪️ZAPU organised military training for the new recruits briefly at Iringa in Tanzania and Egypt. While in Egypt, back home in Zimbabwe there were contradictions in the nationalist ZAPU resulting in the formation of splinter group under the leadership of Reverend Ndabaningi Sithole. The group of students in Egypt also split into two groups with some supporting the leadership of Dr Nkomo and the other group fully supporting the new splinter group. President ED supported the newly formed ZANU.

▪️They returned from Egypt and proceeded for another military training in China under ZANU. On their return they were deployed in different areas of Rhodesia to conduct sabotage missions against the racist colonial administration. Unfortunately President ED was betrayed by some of his colleagues and escaped death sentence due to young age. Instead he was sentenced to 10 years in prison as a D class.

▪️He utilised his time in prison to further his studies through distance learning. He served at khami prison in solitary confinement. Upon his release he went to independent Zambia where he stayed with the Cde Tongogara and eventually ended up in Mozambique where he was elected Special Assistant and to the late RG Mugabe.He was also responsible for Intelligence and Security.

▪️Post Independence, he occupied many positions in government from State Security, Justice, Legal and Parliamentary Affairs, Acting Minister of Finance, Speaker of Parliament, Rural, Housing and Social Ammenities, Defence, Vice President of the Republic of Zimbabwe.

▪️Here is a veteran of Zimbabwe's politics, a master of statecraft, a polished leader. With this history, it will be foolhardy for anyone to underestimate this grandmaster of Zimbabwe's politics. Those who want to lead should take a que from this decorated veteran who started his political journey in 1959 and only became President decades later.

ZYGYDF Legal Department Speaks....

Article 2 (1) of the UN Charter, Article 3 (b) of the Constitutive Act of the African Union, Article 4 (a) of the SADC treaty recognize the principle of sovereignty of nations. Sovereignty of nations is the bedrock of international relations. This principle provides that countries get to control what happens inside their borders and can’t interfere which what happens elsewhere.

In light of this internationally recognized principle, it is important to note that the harmonized elections in Zimbabwe are a domestic process established in terms of our law. The human right to vote is provided for in terms of section 67 of the Constitution. Chapter 7 of the constitution is further dedicated to elections and its processes. The Electoral Act [Chapter 2:13] establishes the administrative bodies and procedures for elections. These laws that provide for elections are domestic laws that are interpreted by our domestic courts. It therefore follows that anyone with grievances relating to breach must approach the courts for redress. Domestic laws must be interpreted by domestic courts and such domestic remedies are final.

Invitation of SADC to observe elections was done in terms of the SADC principles and guidelines Governing Democratic elections. The SADC through the SEAC division certified that pre-election period was within the SADC standards. Any other comments on the pre-election period after the SEAC report are an afterthought. The invitation of international community is not a waiver of the right to being a sovereign nation but a way to promote transparency of the process. The international community can not interfere with internal processes. It offers recommendations that are not legally binding.

The declaration of the result of Presidential election in terms of section 110 (3) (1) (ii) of the Act gives rise to the presumption of validity of an election result. An election is presumed to have been regularly conducted. In terms of section 93 of the constitution, an aggrieved party can challenge the election through a petition or an application to the Constitutional Court. The burden of proof of allegations of invalidity or irregularity lies with the aggrieved.

It is a settled position of law that he who alleges must prove. In the previous election challenge in Chamisa v Mnangagwa and Ors CCZ 21/19 Chamisa lost the suit because he failed to show that there were irregularities and further that if there were irregularities, such irregularities were of such a nature and effect that they were substantially undermined the electoral process thereby disabling the commission from delivering a free and fair and credible Presidential election. A precedence was set and apparently Chamisa is disputing the election on the same grounds as last time. If the script remains the same as in 2018, he is bound to lose.

The general rule is that an election is not declared invalid by reason of any act or omission by returning officer or any other person in breach of his or official duty in connection with the election. The court must however be satisfied that the election was conducted in terms of the law governing elections and that the act or omission did not affect the result.

The exception to the general rule is that a court will declare an election void where it is satisfied from evidence provided by the aggrieved party that the legal trespasses are of such magnitude that they have resulted in substantial non-compliance with the existing electoral laws as at the day of polling not what the laws should have been. Any challenge must show breach of present laws.

In terms of s 64(1) of the Act, after counting of ballot papers is conducted, the presiding officer at a polling station shall without delay, in the presence of such candidates and their election agents as are present, record on the polling station return (the V11 Form) the votes obtained by each candidate and the number of rejected ballot papers in such a manner that the results of the count for each ballot box are shown on the return.

The presiding officer is obliged to display the completed polling station return to those present and to afford each candidate or his or her election agent the opportunity to subscribe their signatures thereto. He or she must provide each candidate or his or her election agent with a copy of the completed polling station return.

If the above provision of law is applied to the facts, it becomes apparent that if CCC had polling agents across the country, such V11 must be signed by their agents and they must have a copy similar to that of ZEC. However, CCC was appealing to the public to take pictures of V11s displayed at polling stations. There would be no reason to ask the public for help if they had polling agents in all the polling stations. V11’s are some of the proof required in the challenge of a Presidential result, which without one can not be successful.

In conclusion it is clear that;

(a) Elections are a domestic process and have domestic remedies. The international community can not declare the election invalid.

(b) The election must be declared void by our courts before any fresh election. An election can only be declared invalid if there is evidence of legal breaches that go to the root of the election after proof to such allegations has been provided. Without cogent proof as apparent in the case of Chamisa in 2023, approaching the courts is a futile exercise.

(c) The courts follow the reasoning in the previous decisions if premised on the similar facts in a doctrine called stare decisis. The same grounds in 2018 suit are fundamentally the same being relied upon in challenging the present election.
