Embu High Court Halts Muguka Ban in Mombasa and Kilifi Counties

The Embu High Court has issued conservatory orders halting the implementation of Executive Order No. 1, which sought to ban the sale of Muguka in Mombasa and Kilifi counties. The orders were handed down by Justice Lucy Njunguna in response to a legal challenge mounted by various stakeholders.

The case has been filed in the court by Kutherema Muguka Sacco, the Embu County Assembly, farmer Benjamin Njeru Joshua, and the Embu County Government. They were seeking judicial intervention to prevent the enforcement of the controversial ban, arguing it would have devastating effects on Muguka farmers and traders.

In the order Justice Njunguna said that the ban will remain halted until all parties involved reach an agreement. This decision is a temporary relief for Muguka farmers and traders, whose businesses had already begun to feel the adverse effects of the ban.

" It is hereby ordered that pending interpretes hearing and determination of this application a conservatory order be and is hereby granted restraining and /or stopping the respondent and or it's agents from effecting , implementing and or enforcing executive order number 1 issued on 22nd May 2024 by the 1st respondent and the 2nd and the 3rd respondent to last until 8th July 2024 when the application shall be heard interpates,"read the order.

The court ordered the application to be served upon the respondent within seven days from today.

Muguka farmers and traders hailed the decision as a significant victory for the farmers, who rely heavily on muguka for their livelihoods.

Mugo Mate, Chairman of the Kenya National Chamber of Commerce and Industry in Embu, expressed his satisfaction with the court's decision, emphasizing that muguka traders can now go on with their business without fear of legal repercussions. Mate highlighted the importance of muguka to the local economy, stating that the crop supports thousands of families and is integral to the region's financial stability.

The controversy surrounding muguka stems from concerns raised by coastal counties about the crop's impact on public health and social order. Despite these concerns, Embu farmers argue that muguka is a vital part of their economy and cultural heritage. They believe that rather than imposing a ban, a more balanced approach should be adopted to address the issues without undermining their livelihood.

Embu Philanthropist Jacob Ireri Alias MBAO had announced Mother of all protest over Muguka ban .

He was to meet Muguka farmers in Siakago over Muguka.

MBAO announce Mother of Protest over Muguka Ban in Coastal Counties

Mbeere North renown Philanthropist has announced demonstrations with Muguka Farmers and traders to express their disappointment over its ban in coastal counties. The protests are scheduled for Tuesday at Siakago Market and Thursday at Ishiara.

Leading the protests will be Jacob Ireri, known as Mbao, a respected figure from Mbeere North who is deaf. Mbao has become a prominent advocate for Miraa farmers and will spearhead the demonstrations to highlight the severe impact of the ban on their livelihoods.

The farmers argue that the ban on Muguka, a variant of Miraa, has caused significant economic hardship. Coastal counties have been key markets for their produce, and the restrictions have resulted in substantial financial losses. The demonstrations aim to pressure authorities to reconsider the ban and support the farming community.

Organizers are calling on all Miraa farmers and supporters to turn out in large numbers at the demonstrations. They believe a strong showing will underline the urgency of their plight and the need for immediate action. Local leaders and stakeholders have been invited to join and address the gatherings.

The protests at Siakago Market and Ishiara are seen as critical events for the Miraa farming community. The farmers urge the local population to participate and stand in solidarity, hoping their collective voice will lead to the lifting of the Muguka ban and the restoration of their livelihoods.
