The concept of personal liberty is that our rights come from our humanity.

If you believe in a Supreme Being, as I do, and as the Declaration of Independence presupposes, then you acknowledge these rights as a gift from the Creator.

If you doubt or reject the existence of a Supreme Being, you can still accept the personal origin of these rights.

Humans are rational beings and the essence of natural rights is the exercise of reason to seek the truth. The individual employment of unimpeded reason is the exercise of a natural right.

Either way --- whether divinely created or humanly adapted --- under the Natural Law, our rights come from within us. This is not a mere academic argument. Rather, it has profound everyday consequences.

A right is an unconditional claim against all others that does not require validation or approval. Thus, your right to the freedom of speech enables you to think what you wish and say what you think and publish what you say. Nature --- or as Thomas Jefferson said, "Nature's God" --- has given you that right.

The origin of natural rights is self-evident.

How is it self-evident that our rights are natural and not governmental in origin?

Because we have them in the absence of government.

Thus, when government, whether by legislation or executive command, purports to interfere with your natural rights, it does moral violence to you. The Framers of the Constitution — who had suffered such violence under British rule — understood this and provided for protection against government assaults upon natural rights.

That protection is called due process.

This is a complex area of the law. Yet, reduced to its essence, it means that the government can only interfere with life, liberty and property after a fair trial, before a neutral judge and jury, at which the government must prove fault on the part of the person whose life or property it wants or whose liberties it seeks to curtail.

I offer this primer to address a troubling issue now facing Americans: voluntary servitude. After nine months of the COVID-19 pandemic-induced experiment in totalitarian-leaning governments, many of us still live in cities or states where — to paraphrase University of Sydney Professor John Keane — the popularly attractive exercise of arbitrary power has produced a level of comfort in popular compliance, and this comfortable compliance is voluntary servitude.

Stated differently, the government and its medical personnel have scared the daylights out of so many people that they take comfort in complying with government commands to stay home, shut their businesses and socially distance.

This voluntary servitude is a pernicious evil as it encourages those in power to continue to trample natural rights. And the more those in power get away with rights trampling, the more common it will become and the more folks will accept it.

The 13th Amendment, which was enacted to abolish slavery, only prohibits involuntary servitude. Its drafters and ratifiers never imagined this voluntary version.

Among the rights most severely restricted today are those of assembly, travel and commercial in*******se.

And none of these restrictions has come about via popularly enacted legislation.

All have come about through unlawful and unconstitutional executive commands.

Last week, a federal judge in upstate New York became the first in the nation to order a governor to produce hard evidence to justify his closures of businesses, particularly restaurants.

Lamentably, the governor's own evidence revealed that 35 times more people have been infected with COVID-19 while in their homes than by the patronage of restaurants.

I applaud this judge — he is skeptical of government commands and is moving in the direction of human freedom — but he has largely missed the point. The point is that freedom is the default position because we are born with the right to exercise it.

Government can only interfere with personal freedom not by demonstrating the evidentiary basis for its commands but by proving wrongness on the part of the people whose freedom it wants to curtail.

\The exercise of a natural right — so long as it does not nullify another's natural right — simply can never be wrong.

When government interferes with natural rights outside of due process, it fails its obligation to uphold the Constitution. And when governors and mayors use the power of the state to interfere with rights that are guaranteed by the U.S. Constitution, they explicitly violate federal law and expose themselves to federal prosecution.

Government is essentially the negation of liberty. What liberties may government morally negate? It may only interfere with the liberty of a person who has nullified someone else's natural rights. Suppose the rights nullifier is the government itself? When that happens, according to Jefferson in the Declaration of Independence, it is the duty of the people to alter or abolish the government.

That's where we are today, at the beginning of 2021.

We live under governments that not only fail to protect personal liberties, not only fail to recognize their validity and primacy, but actively assault them. And these assaults have been accompanied by sometimes soothing and sometimes terrifying scientific-sounding language, which has induced voluntary servitude.

The danger of voluntary servitude cannot be overstated. When accepted by the masses, it will make the exercise of personal liberties the exception rather than the norm. And it will take the personal courage and public sacrifice of revolutionaries to resist it.

The only reason we have even a modicum of personal liberty today is because of determined and often unpopular men and women who refused to surrender their natural rights.

Where are courage and sacrifice when we need them?

Thank you for taking the time to contact me regarding the Electoral College certification of the 2020 U.S. presidential election. I really appreciate hearing from you.

The events in the United States Capitol on January 6th, meant to disrupt a process at the heart of our democracy, were unpatriotic and un-American in the extreme. Our republic has long been the envy of people all over the world, and we must stand united against those who wish to tear us apart. We are grateful to the law enforcement officers that placed themselves in harm’s way and kept those working at the Capitol safe.

The business we conducted on January 6th showed there is deep distrust in the integrity and veracity of our elections. We need to restore American’s faith in our voting process. I am committed to pursue that so all of America has the benefit of what we enjoy in Idaho - solid confidence in the outcome of our elections. An open, transparent system with clear guidelines and rigorous safeguards is vital.

Now, we must come together as a country. I am confident we will emerge from this challenge stronger, just as America has done so many times before.

Idahoans have endured a lot over the last year. On both an economic and personal level, we have collectively been through more hardships in 2020 than in any other year in recent memory. In spite of these many adversities, I have seen great courage and resilience among Idaho's people. It has been my great honor to serve as a leader in this state and to witness the determination of the individuals who call our state home.

I believe that Idahoans have suffered enough. There are many ways in which the state of Idaho could take action to ameliorate the unfortunate conditions that have been forced upon us as a result of the coronavirus and—to a much greater degree—as a result of government lockdowns and ongoing restrictions of businesses and individuals.

One important solution involves expanding our state's healthcare capacity, something we hear is in increasingly short supply. First, though, we need some clarity regarding what specifically is lacking. Do we need more space and more beds or more doctors and nurses? Are we using the most state of the art equipment for personal protection and for facility sanitization? Once we understand the specific needs, we can work on fulfilling them.

As your Lieutenant Governor and a member of Idaho's Coronavirus Financial Advisory Committee (CFAC), I have been working to better understand the specifics of Idaho's healthcare capacity and what shortfalls may exist due to COVID-19.

A few weeks ago, I submitted a comprehensive proposal to increase Idaho's facility space, expand our nursing capacity, and acquire additional technological equipment. On November 25, Director Jeppesen told CFAC that Idaho's primary capacity shortfall is a lack of nurses. The committee and I voted to recommend allocating $5 million to bring additional nurses to Idaho.

In speaking with the Board of Nursing, I learned that we have more than 30,000 nurses (RN, LPN, and APRN) licensed in Idaho in addition to hundreds of new graduate nurses on temporary licenses. Unfortunately, we don't know how many of those nurses are currently practicing in Idaho and how many are working in other states. Without good information, it is difficult to know how best to allocate our resources to effectively solve problems.

Instead of using fear about capacity as an excuse for more mandates, we should identify where we have shortages and work to remedy them. I will continue to monitor the situation, ask questions, and offer solutions.

The state could also take direct action to help individuals and businesses who have suffered financial hardships as a result of government lockdowns, social distancing orders, capacity limitations, and other policies. Idaho has received almost $2 billion in federal CARES Act money, and we have wide latitude to use this money to alleviate the harm that has been suffered by Idahoans. For example, we could use some of that money to provide income tax credits to working families who have been forced to spend additional money to pay for childcare due to school closures.

There are a number of other options as well. Instead of localities threatening to pull business licenses, they could offer the elimination of business license fees for one year in order to incentivize a desired outcome. We could suspend business payroll taxes, income taxes, or even property taxes for a year. In addition to the CARES Act money, Idaho is positioned to have a General Fund budget surplus of over $500m in the current fiscal year. Surely, the legislature could find some room to help offer much needed relief to Idaho citizens.

We should direct at least some of this money to the people and businesses who have been harmed by injurious government policies. These policies have inflicted significant financial, physical, and emotional harm on Idahoans across the state. Over the last few weeks, we have seen more mandates being proposed or imposed on Idahoans by elected and appointed officials at various levels of government. These policies are multiplying the harm many times over. We don't need excessive government interventions. We need to trust each other to do what is best to protect ourselves and our loved ones. We need to use our God-given gifts to help each other through these times.

The more we learn, the less we have to fear. As a member of CFAC, your Lieutenant Governor, and a former legislator, I am committed to working with stakeholders and finding effective solutions that do not infringe on your rights. Have courage. Main Street Idaho needs your support right now. Your community needs your help. We all have talents and gifts that we can share as we work to rebuild our economy and restore our state.

Gold Star Mothers
I greatly appreciate the Gold Star Mothers who brought beautiful Christmas trees to the Capitol and decorated them. They do so much to keep the memory of their sons and daughters alive.

The origin of the Gold Star dates back more than a century and the first Gold Star Mothers organization began in 1828.

During the early days of World War I, a Blue Star was used to represent each person, man or woman in the Military Service of the United States. As the war progressed and men were killed in combat, others wounded and died of their wounds or disease, there came about the accepted usage of the Gold Star.

This Gold Star was substituted and superimposed upon the blue Star in such a manner as to entirely cover it. The idea of the Gold Star was that the honor and glory accorded the person for his or her supreme sacrifice in offering for his country, the last full measure of devotion and pride of the family in this sacrifice, rather than the sense of personal loss which would be represented by the mourning symbols.

As we celebrate the holidays this year, we also have an opportunity to reflect on the sacrifices that have been required to protect and sustain our freedoms.

COURAGE IS THE ANTIDOTE TO COVID

It has been more than six months since the first
COVID-related emergency declaration in Idaho.
Since then, we have witnessed unprecedented government
overreach, which has resulted in skyrocketing
unemployment, many businesses closing permanently,
closed schools, and churchgoers arrested in
Moscow for expressing their constitutional right to
religious freedom.

The initial justification for this declaration was to
“flatten the curve” of infections. Do you remember
that phrase? Somewhere along the line, it stopped
being about preventing spikes and instead became
about some unrealistic goal of preventing anyone
from contracting the virus. The lockdown orders,
now frowned upon in an enormous reversal by the
World Health Organization (WHO), were eventually
replaced with a hodgepodge of mask mandates, social
distancing directives, and bans on gatherings of
various sizes.

Is any of this infringement on our liberties actually
justified? Recent data from the CDC has revealed that the survival rate for those who contract the virus is 99.997% for those age 0-19, 99.98% for age 20-49, 99.5% for age 50-69, and 94.6% for age 70 and older.

Think about that. Tens of thousands of Idaho students are still being kept out of their schools despite the survival rate for young people being 99.997%. As more and more studies show schools are not the incubators of the spread of COVID-19, they still haven’t fully reopened. Adults are sidelined to watch the rates of depression and su***de increasing due to the imposed isolation of our kids.

In an opinion article penned last spring, I stated that all jobs and all Idahoans are essential. I called for the end of the lockdowns, predicted the devastating effects of isolation, and said that we would likely see cases rise, but we will overcome this together- and not at the expense of our economy, our livelihood, and our mental health. Still, it seems that a great many politicians, bureaucrats, and administrators have allowed fear to become their guiding principle rather than respect for the individual liberty and property rights of Idahoans.

Recently, President Trump was diagnosed with coronavirus, and he even spent a couple of days in a medical facility as a precaution. He didn’t respond with fear or panic, though; instead, he encouraged the nation not to allow COVID-19 to become the focal point of our lives. “Don’t be afraid of it,” he said. “Don’t let it dominate. Don’t let it take over your lives. Don’t let that happen.”

In the novel “Dune” written by Frank Herbert, certain characters recite a mantra regarding fear. “I must not fear. Fear is the mind-killer. Fear is the little-death that brings total obliteration. I will face my fear. I will permit it to pass over me and through me. And when it has gone past I will turn the inner eye to see its path. Where the fear has gone there will be nothing. Only I will remain.”

Fear is a powerful enemy, and, in 2020, we have witnessed firsthand how much harm it can cause. It is time to be courageous and return our state to normal. Our kids need to be back in school, playing sports, and enjoying their youth. Our college students need to be back in their classrooms and our football teams back on their fields.
Certainly, we still need to be responsible and take steps as individuals to protect the vulnerable, including the elderly and those who are health compromised. We must also respect the property rights of businesses and individuals. A little common sense goes a long way.

Last month, Nathan Apodaca, from Idaho Falls, went viral after posting a 22-second video on TikTok, which garnered more than 50 million views. In it, he is riding a longboard and sipping Ocean Spray Cran-Raspberry juice while lip syncing to the Fleetwood Mac song Dreams: “Now here you go again. You say you want your freedom. Well, who am I to keep you down? It’s only right that you should play the way you feel it.”

The viral sensation also resulted in a massive spike in streams of the 1977 classic “Dreams,” enough to enter the Rolling Stone Top 100 Songs Chart. I can’t help but believe that the lyrics from this song, along with Nathan’s carefree attitude, helped propel the video to its viral status.

“It’s a time in the world right now where everybody needs a break from everything that’s going on,” Apodaca said. “This video took them to a place where they could watch something and just chill and vibe out.”

The message of freedom and independence has always been part of the American tradition, and this year, we have felt its absence keenly. I know you want your freedom back and I am fully committed to its restoration.

All we need to do is stop being afraid.

Summary for Lefties & RINOs who have both reading and comprehension problems: The Second Amendment does NOT protect the right of the militia or those in the militia to keep and bear arms. Read the WORDS - "...the right of *the people* to keep and bear arms shall not be infringed."

*The People* are recognized to have an inalienable right to keep and bear arms just in case some idiot politician decides to turn the power of government against them - *including* the power of the standing army and *well-regulated militia*.

We weep for those of you who have are un-educated, or who have been mal-educated, or who are otherwise cognitively challenged - but we will never surrender arms, and we pray you never make us turn them on you in self defense.

Now, for those who are capable of reading and comprehending - here's the article:

THE SECOND AMENDMENT: READ IT LIKE A FOUNDING FATHER

The Second Amendment: A well regulated Militia, being necessary
to the security of a free State, the right of
the people to keep and bear Arms, shall
not be infringed.

The Second Amendment in our Constitution
is the most hotly debated topic regarding our
Natural Rights as Americans. The Second
Amendment is not only misunderstood, but
often deliberately mis-interpreted by people
on both sides of the argument.

Leftists argue that the ‘…right of the people
to keep and bear arms…’ is intrinsically
and inseparably tied to the fi rst part of the
Amendment that states, ‘A well regulated
Militia, being necessary to the security of
a free State…’ – and they are absolutely,
undeniably correct.

They argue incorrectly, either by deliberate or
ignorant misunderstanding, that only those ‘…
people…’ who are part of the ‘…well regulated
militia…’ are entitled to bear arms. That is not
what the Amendment states – at all.

Here’s the bottom line: ‘…the right of the
people to keep and bear arms, shall not be
infringed…’ is precisely because the ‘…well
regulated militia…’ was newly defi ned as a
separate entity under the control of the US
Congress.

Prior to the Revolutionary War, the commonly
understood defi nition of militia was all ablebodied
male citizens. That changed – legally
and constitutionally – in Article 1, Section
8, Clauses 15 & 16 of the Constitution. The
same Founders and Framers, who had just
defeated the British using the Colonial Army
and Colonial Militias, decided to formalize
the American Militia. They decided to make
it ‘Well Regulated’ as opposed to what
existed prior to the war. George Washington
understood intimately that the American
Militia system, to be useful to a General in the
field, had to evolve from what it was during
the Revolution.

So, the Founders and Framers gave the new
Congress authority in Section 1 Article 2:
Clause 15: To provide for calling forth the
militia to execute the laws of the union,
suppress insurrections and repel invasions;
Clause 16: To provide for organizing,
arming, and disciplining, the militia, and
for governing such part of them as may
be employed in the service of the United
States, reserving to the states respectively,
the appointment of the offi cers, and the
authority of training the militia according to
the discipline prescribed by Congress;
The Militia Acts of 1792 further fl eshed-out
the new defi nition of militia and militiamen.
Here is where the leftist & anti-gunner
argument encounters its fatal flaw.

The same Founders and Framers who, in the
new Constitution, redefi ne and form a ‘Well
regulated militia’ under State and Federal
control, also were fresh off the battlefi elds
against the British Standing Army and
several Loyalist Militias. These Founders
and Framers knew that any standing army –
be it an American standing army or even an
American ‘Well regulated militia’ – could be
suddenly turned against ‘…the people…’
So, they drafted the Second Amendment and
crafted it very deliberately. They understood
that a ‘…well regulated militia…’ was essential
to America’s future. They also understood
that the possibility existed that one day, ‘…
the people…’ might have to defend themselves
from that new ‘…well regulated militia…’.
Leftists and anti-gunners like to point out
that today’s National Guard is the same
‘Well-regulated Militia’ established in the
Constitution. They are not wrong.

How many times have ‘…the people…’ been
in harm’s way because the federal, state or
local government has turned the power and
weapons under their authority against ‘…
the people…’? How many times have leftists
bellowed for ‘The Government’ to use force as
a means of imposing their will upon citizens?
Once again, the brilliance of our Founders
and Framers is right there for us to see.

They said: ‘…the right of the people to keep and
bear arms shall not be infringed…’ precisely
because we, the Founders and Framers, are
creating a ‘…well regulated militia, being
necessary to the security of a free state…’
– that, one day, may be used against ‘…the
people…’ who have an unalienable Natural
Right to defend themselves.

It is expressly ‘...the people...’ who have the
right to keep and bear arms.
