From the FTC: “The Commission declines to exclude on-air talent from the final rule," the FTC writes. "Specifically, the success of on-air talent is a combination of the employer’s investment and the talent of the worker, both of which benefit the employer."

As a fierce defender of the press and our precious First Amendment… and one who knows and understands changing tech. And one smart enough to know the experts who know more than I…

Let me state this very clearly so there is no confusion about my position on the bills moving through Congress right now regarding an app utilized by an estimated 170 million in the U.S. and far more globally.

The United States government attempting to ban or force divestment regarding TikTok is an egregious attempt to thwart the protections of our First Amendment.

This is not about data privacy. This is not about “protecting our children” (god forbid that’s ever the reasoning to regulate speech). This is not about cybersecurity. It’s not about foreign influence on elections. It’s not about bad actors. It should NEVER be about propaganda.

This is about attempts to control speech and regulate what speech we have access to and from where - and an arbitrary line drawn that exists nowhere else. The bill is, quite frankly, bu****it.

And NO ONE who cares about our First Amendment should be in favor of it.

I am shocked to see some esteemed colleagues argue any differently. Especially anyone involved in broadcast - the only area where government gets license to muzzle and compel speech in exchange for the license they provide.

There are so many awful opinions and hot takes regarding the bill moving through the House and that might land on the desk of the Oval then get immediately challenged and ruled by SCOTUS.

Your take should be educated, informed and firm that our First Amendment stands.

It’s literally what separates us from the authoritarian tactics some say will this app creates.

Fight this legislation.

Hard.

“If you’re good at radio, really know what the privilege is about. And the overwhelming honor it is to find a single companion in a CUME of hundreds of thousands. If you understand how having one intimate connection in the sea of millions that are listening is the job. If you grasp that your target is what it’s always been about…”

The old routines (and the crutches radio relied on) are never coming back.

Your target moved. Better be sure you moved your aim to reach her/him.

Great work from Fred as always.

Now in the 40th month since the COVID outbreak, work from home is still very much a condition of employment, especially for younger members of the workforce. It continues to affect weekday routines, time spent in the car, and by extension, radio listening. This year in Techsurvey we added questions....

Sometimes, the day to day is just brutal.

“I was in my earliest years of my career when Columbine took the lives of children. I broke the news live. I remember thinking I might never have to do that again. Because it was… so shocking.

That was 1999. I was younger. I was naive. No appreciation for the reality that every conversation we had then would become a wonder twenty five years later about if we should feel numb or not.

I promoted concert tickets on the air today. I promoted weather apps and that it was National Wine Day. I did show prep and I did PSAs. All while helping my child pull up a grade.

And in between it all, I sought desperately for updates and crawled into the sorrow of what happened yesterday.”

I feel numb. And not at all as numb as I think I’m supposed to feel. Feelings these last two days are weird. Strange. They are… a human…

“The National Association of Broadcasters (NAB) is a fierce defender of the First Amendment and the critical importance of the ability to freely express views, both popular and unpopular. While the First Amendment protects freedom of speech, however, it does not prevent private actors from exercising sound, moral judgment. To that end, given the unprovoked aggression exhibited by Russia against the free and sovereign people of Ukraine, NAB calls on broadcasters to cease carrying any state-sponsored programming with ties to the Russian government or its agents. While we know that airings of such programs are extremely limited, we believe that our nation must stand fully united against misinformation and for freedom and democracy across the globe.”
