A panel set up to investigate the finances of the Imo State Oil Producing Areas Development Commission yesterday submitted its reports to the Governor, Emeka Ihedioha.

The panel headed by Romanus Ezeogu accused a former governor of the state, Rochas Okorocha, of allegedly diverting over N6bn that accrued to the commission during his administration.

But Okorocha has dismissed the allegation, saying the state governor was only on a vendetta mission.

Ezeogu also alleged that the former governor took N422m from the commission’s treasury to purchase pre-Inauguration vehicles and also allegedly diverted N200m to purchase transformers during the 2019 campaigns.

He said there was proof that the last administration in the state spent over N400m on the abandoned Marine University at Osemoto in the Oguta Local Government Area of the state.

The panel further alleged that it discovered N1bn lodged in Ecobank, Obinze branch which was withdrawn without bank details or description of any kind.

Appeal Court Reverses Disqualification Of Bayelsa Deputy Governor-Elect..


An Appeal Court sitting in Abuja has reversed the judgment of a Federal Hight Court disqualifying the Deputy-Governorship candidate of the All Progressives Congress (APC), Senator Biobarakuma Degi-Eremienyo from participating in the Bayelsa State governorship election on November 16.

This comes as Senator Degi-Eremienyo who is now the deputy governor-elect challenged the High Court verdict that restrained him from taking part in the recently concluded poll.

Justice Iyang Ekwo of the Federal High Court in Abuja had on November 12 disqualified the lawmaker for allegedly supplying false information to the Independent National Electoral Commission (INEC) as part of requirement for the governorship poll.

In a judgment, Justice Ekwo said Senator Degi-Eremienyo gave false information in relation to his educational qualifications and went ahead to depose to an affidavit to correct the discrepancies.

The judge held that all his documents bore different names.

But in his ruling on Monday, a three-man panel chaired by Justice Stephen Adah held that the High Court erred in law and in breach of the appellant’s right to a fair hearing.

According to him, the case which was brought under Section 36 of the Electoral Act is criminal in nature and the respondents in the case ought to prove beyond reasonable doubt that Senator Degi-Eremienyo gave false information in his form C001 submitted to the Independent National Electoral Commission (INEC) as part of his qualifications to contest the election.

The Appellant Court held that more so the lawmaker submitted an affidavit sworn to court to prove that the names Adeyi-Eremienyo on his school-leaving certificate is one and the same as Degi-Eremienyo on his GCE certificate and newspaper cuttings announcing to the whole world a change in name and same was not challenged by the respondents in the lower court as such the findings of the lower court are erroneous.

The trial judge concluded by saying that “I agree with the appellant that the owner of the school leaving certificate and the GCE certificate are one and the same and I therefore set aside the judgment of the court below.”

SUN Newspaper Reacts As EFCC Seal Off Their Office

The management of Sun Newspaper owned by the former Governor of Abia State, Dr. Orji Uzor Kalu who was sentenced to 12 years in prison for a N7.65 billion fraud has reacted to the sealing of their office by the operatives of the Economic and Financial Crimes Commission (EFCC).

Confirming the sealing of their corporate headquarters at 2, Coscharis Street, Kirikiri Industrial Layout, Apapa, Lagos by EFCC agents escorted by heavily armed policemen on Saturday, The Sun said the are yet to understand the legal basis for the action.

The EFCC officials, who came in a white Toyota bus with registration number, ABUJA BWR-644GA, wrote on The Sun’s fence, “EFCC, keep off.”

They also advised staff to collect their personal belongings from the office as they will come back to seal the premises completely.

The management said: “We do not understand the legal basis for this EFCC action. It is on record that there is a pending appeal at the Supreme Court with Suit No: SC/546/2018 wherein The Sun Publishing Limited appealed against the Judgement delivered by the Court of Appeal on the interim forfeiture order made against it by a Federal High Court in 2007 based on ex parte proceeding. The Notice of Appeal and Motion for Stay of Ex*****on were duly served on EFCC by the bailiffs of the Court.

“It is also pertinent to state that EFCC vide a letter written by Counsel to The Sun Publishing Limited, dated 22nd May, 2018 and duly received by one Caleb Peter on behalf of Rotimi Jacobs & Co. was further put on notice of the pending appeal at the Supreme Court and advised to stay action in the matter pending the hearing of the Motion for Stay of ex*****on and the appeal.

“Again, it is instructive to state that The Sun Publishing Limited was not a party to the case of EFCC vs. Orji Uzor Kalu & 2 Others, so we do not see why the Judgment, in that case, should lead to attempt to seal The Sun Publishing Limited premises.
