Officially Licensed Music videos are coming to facebook...what are your thoughts on that? Which category do you fall in? a) It's about time or b) who cares. If you are a creator of music or rights holder you should care. Personally, I am happy about it. Because not only will it bring in another royalty stream for creators it will provide one more way for artists to promote their music. A premiere of your video exclusively on FB for example. A hot topic these days is the use of royalty free samples and loops and what all you can and can not do with them.
I will attempt to clear this up once and for all...Creating a derivative work of a copyrighted work without permission is copyright infringement. Period. The right Splice is granting you is the right to use THAT sample without paying additional licensing fees. Note the key word here is LICENSING...yes, you are licensing that sound for use in your composition. You DO NOT OWN THE COPYRIGHT....This is stated right in Splice's Terms of Conditions.
"Sounds are licensed, not sold, to you. We grant you a non-exclusive, non-transferable, perpetual right to use Sounds you obtain through Splice Sounds in combination with other sounds in music productions to create new recordings." The same way a producer can license the same beat 1000000 times and none of the people licensing the beat will own it...the same principal is happening here. I can make a beat using a sound and you can make a beat using the same sound but neither you nor I can file a copyright claim saying we stole the other person's melody because neither one of us own that sound. The fact they are licensing the sound to you is also what prevents you from being able to take the sound and "insert" it into another sample pack and re-sell it. Because you do not own it... you can not sell or license it. Only the original creators can. So that means if your song were to become a hit the original creator of that sound COULD file a claim saying they contributed to that composition. Will they? IDK...but CAN they ...absolutely under copyright law....It is no different than if they were actually sitting in the room with you and created the bassline...you couldn't wait until they leave the studio and decide you wanted to interpolate it because you wanted to change a triad to a 7th chord or because you wanted to speed up the tempo. All of the same copyright rules apply. So in closing remember, they are NOT granting the right to create a derivative work. This includes interpolations. Create your own original material if you don't want any issues.....I hope this helps make it clear for everyone....let’s all thank Chris Wellz for the QOTD..Its a GREAT question that comes up often!🏆🏅🎼🎹.

Each year anywhere from $250 MIllion to $2.5 BILLION goes unclaimed in music royalties. Most of this is due to unregistered or improperly registered songs. Don't let this happen to you! Royalty collection is a slow process...knowing when you are getting paid for music is just as important as knowing when your next check is coming from the day job you want to quit one day.
