رپورٹ کو منظر عام پر لانے اور ہندو و مسلم فریقین کو نقول حوالے کرنے کے تعلق سے جج فیصلہ کرینگے ۔ محکمہ آثار قدیمہ فیصلے کو موخر کرنے کا حامی وارناسی : وارناسی کی ایک عدالت امکان ہے کہ گیان واپی مسجد کامپلکس میں محکمہ آثار قدیمہ کے سروے کی رپورٹ کو عام کرنے اور اس کی نقول ہندو اور مسلم فریقین کو سونپنے کے تعلق سے کل 6 جنوری کو فیصلہ سنائے گی ۔ وارناسی کی ضلع عدالت کے جج اے کے وشویش نے آج کہا کہ چونکہ یہ فیصلہ ابھی ٹائپ نہیں ہوا ہے اس لئے اسے 6 جنوری کو سنایا جائیگا ۔ ہندو فریق کے وکیل مدن موہن یادو نے یہ بات بتائی ۔ اس موقع پر عدالت میں ہندو اور مسلم فریقین کے علاوہ محکمہ آثار قدیمہ کے وکلاء بھی موجود تھے ۔ محکمہ آثار قدیمہ نے دو دن قبل عدالت سے خواہش کی تھی اس کی رپورٹ کو آئندہ کم از کم چار مزید ہفتوں تک منظر عام پر نہ لایا جائے ۔ ضلع عدالت کے جج جمعرات کو اس مسئلہ پر سماعت نہیں کرپائے تھے کیونکہ وہ کسی تقریب میں مصروف تھے ۔ کہا گیا ہے کہ آج اس مسئلہ کی عدالت میں سماعت ہوئی تھی اور چونکہ فیصلہ ٹائپ نہیں ہوپایا تھا اس لئے اس کی آج اجرائی نہیں ہوسکی اور کل یہ فیصلہ سنایا جاسکتا ہے ۔ 21 جولائی کو ضلع عدالت کے احکام کے بعد محکمہ آثار قدیمہ کی جانب سے گیان واپی مسجد کے احاطہ کا سائنٹفک سروے کیا گیا تھا ۔ یہ مسجد کاشی وشواناتھ مندر سے متصل واقع ہے ۔ محکمہ آثار قدیمہ کا سروے یہ پتہ چلانے کیلئے کیا گیا تھا کہ آیا یہ مسجد کسی پہلے سے موجود ہندو مندر کے ڈھانچہ پر تو تعمیر نہیں کی گئی ہے ۔ ہندو درخواست گذار کا دعوی تھا کہ 17 ویں صدی کی گیان واپی مسجد کو ایک پہلے سے موجود مندر کے ڈھانچہ پر تعمیر کیا گیا ہے ۔ اس درخواست کے بعد عدالت نے محکمہ آثار قدیمہ کو سائنٹفک سروے کرنے کی ہدایت دی تھی ۔ دو دن قبل محکمہ آثار قدیمہ نے عدالت سے استدعا کی تھی اس نے جو مہربند رپورٹ عدالت میں داخل کی ہے اسے مزید چار ہفتوں تک منظر عام پر نہ لایا جائے ۔ محکمہ سے 18 ڈسمبر کو ہی مہربند لفافہ میں رپورٹ عدالت میں پیش کی جاچکی ہے ۔ محکمہ آثار قدیمہ نے الہ آباد ہائیکورٹ کے ایک حالیہ فیصلہ کا حوالہ دیتے ہوئے یہ رپورٹ منظر عام پر لانے میں تاخیر کی استدعا کی تھی ۔ الہ آباد ہائیکورٹ نے 19 ڈسمبر کو مسلم فریق کی کئی درخواستوں کو مسترد کردیا تھا جن میں گیان واپی مسجد کی جگہ مندر کو بحال کرنے کی درخواستوں کی برقراری کو چیلنج کیا تھا ۔ ہائیکورٹ کا کہنا تھا کہ قومی اہمیت کے حامل اس کیس میں سماعت جتنا ممکن ہوسکے جلد بلکہ ترجیحا چھ ماہ میں مکمل ہوجانی چاہئے ۔ اگر ضروری ہوجائے تو نچلی عدالت محکمہ آثادر قدیمہ کو مزید سروے کرنے کی ہدایت دے سکتی ہے ۔ ضلع عدالت کے جج اب اس سارے مسئلہ پر ہوسکتا ہے کہ 6 جنوری کو اپنا فیصلہ سنائیں گے ۔ Source link
