Rumors have been swirling about the impact of SB803 on our industry, reaching a fever pitch this week after the Assembly Committee on Business and Professions hearing yesterday in Sacramento.⁣

It’s myth busting time! 💥⁣

Let’s address the most popular misinformation, in no particular order:⁣

🔹 “SB803 will eliminate the option to booth rent beginning January 2022.”⁣

This is 𝗳𝗮𝗹𝘀𝗲. SB803 does not change AB5, which gives all licensees the option to booth rent.⁣

🔹 “SB803 deregulates hair cutting, which means just anyone will be able to cut hair.”⁣

This is 𝗳𝗮𝗹𝘀𝗲. Amendments to the bill will preserve the requirement to be licensed to perform all hair services currently regulated by the BBC.⁣

🔹 “Elimination of the practical exam means a less-qualified workforce.” ⁣

This is 𝗳𝗮𝗹𝘀𝗲. The practical exam measures your ability to pass the practical exam, not the quality or safety of your work.⁣

🔹 “1,000 hours in beauty school isn’t enough to learn everything a cosmetologist needs to know to be successful.”⁣

This is 𝗳𝗮𝗹𝘀𝗲. When states can’t justify the current curriculum hour requirements, legislators will make adjustments to reduce barriers to entry. Most licensed professionals would agree that the majority of useful learning happens on the job.⁣

🔹 “Chain salons and manufacturers are sponsoring this bill to hurt independent salon professionals.”⁣

This is 𝗳𝗮𝗹𝘀𝗲. SB803 is a sunset review bill produced by a legislative committee and will be revised multiple times throughout the process. Any organization or individual may express their support or opposition.⁣

Any surprises? 🤯⁣

Bad actors in our industry have something to gain (or lose) by perpetuating misinformation. 🚩🚩🚩⁣

Refer to the most current amendments when forming your opinion.⁣

[ Save & Share! ] Truly independent contractors like booth renters should issue form 1099 MISC to their salon landlord each year. ⁣⭐️

The rent you pay to the salon is considered income for them, and if you pay more than $600 in rent in a year, a 1099-MISC should be issued each year. ⁣

From the IRS: ⁣

“As a booth renter you must issue Form 1099-MISC for business rent paid of more than $600 or more to non-corporate landlords each year.”⁣

This is why salons giving workers a 1099-MISC or 1099 NEC is very very rarely correct.⁣

More from the IRS:⁣

“A booth renter is someone who leases space from an existing business and operates their own business as an independent contractor. As a booth renter, or independent contractor, you are responsible for your own record-keeping and timely filing of returns and payments of taxes related to your business.⁣

Indications that you are an independent contractor include, but are not limited to:⁣
• Having a key to the establishment⁣
• Setting your own hours⁣
• Purchasing your own products⁣
• Having your own phone number and business name⁣
• Determining the prices to be charged⁣

If these factors are not present, then you are likely an employee of the business who is providing the space to you.”⁣
