UK officials culpable in torture of Assange, doctors warn
Doctors have warned that UK officials could be held accountable for the torture of Julian Assange in an open letter published in The Lancet on this International Day in Support of Victims of Torture.
The 216 undersigned physicians and psychologists from 33 countries have accused UK and US government officials of intensifying Julian Assange’s psychological torture in spite of the world’s leading authorities on human rights and international law calling for his immediate release from prison.
Clinical Psychologist and Australian co-author of the publication, 'The ongoing torture and medical neglect of Julian Assange', Dr Lissa Johnson said the failure to properly treat Mr Assange may amount to an act of torture in which state officials, from parliament to court to prison, risk being judged complicit.
"The Lancet has published our letter just two days after the US Department of Justice announced a new superseding indictment against Assange, representing another escalation in psychological torture tactics," said Dr Johnson.
"Introducing extra charges at this late stage, right before the defence evidence deadline and over a year after the indictment deadline, when documents given to the prison generally take two weeks to be passed on, when he has not been supplied with a computer and when he is unable to meet with lawyers under Coronavirus lockdown, serves to ramp up his helplessness in the face of threat and is a key psychological torture tactic," she said.
"Under the Convention Against Torture those acting in official capacities can be held complicit and accountable not only for perpetration of torture but for their silent acquiescence and consent."
In the UK, such complicity is prohibited not only under the Convention Against Torture but also under Article 3 of the European Convention on Human Rights (ECHR) and section 134 of the Criminal Justice Act 1988 which states that it is an offence for any public official to “intentionally inflict severe pain or suffering on another in the performance or purported performance of his (sic) official duties.”
The open letter refers to psychological torture tactics inflicted on Mr Assange "capable of inducing severe despair, disorientation, destabilisation and disintegration of crucial mental and psychological functions," including the denial of his application for bail despite meeting the criteria for prisoner release recommended internationally by human rights and lawyers’ associations to contain the spread of COVID-19 and to protect the vulnerable.
Julian Assange's treatment during the first phase of his extradition proceedings in February was described as “shocking and excessive” by the International Bar Association’s Human Rights Institute (IBAHRI).
IBAHRI Co-Chair and former Australian High Court judge Michael Kirby commented in March that the Institute was concerned the mistreatment of Julian Assange constituted breaches of his right to a fair trial and protections enshrined in the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, to which the UK is party.
"It is deeply shocking that as a mature democracy in which the rule of law and the rights of individuals are preserved, the UK Government has been silent and has taken no action to terminate such gross and disproportionate conduct by Crown officials," Mr Kirby said.
A copy of the doctors' open letter has been forwarded to the UK Lord Chancellor and Secretary of State for Justice, Robert Buckland. It coincides with his receiving two further open letters from 36 members of the European Parliament and 11 current and former politicians from 9 nations, calling for Julian Assange’s immediate release on bail in light of COVID-19.
