*Schools must reduce fees as classes are online, no overhead & maintenance costs: SC*

Demanding full fee commercialization and profiteering, said SC asking Rajasthan private schools to reduce fee by 15%

*New Delhi* : The Supreme Court has made some significant observations that are applicable to schools, colleges and other educational institutions in the time of pandemic when teaching has gone online for more than a year now.

The Supreme Court bench led by Justice Khanwilkar in a judgment noted that schools and educational institutions which remain closed for physical classes for the past more than a year and continue to do so must ideally reduce fees as their running and overhead costs of maintenance, electricity, petrol/diesel to run generators, water cost, stationery charges have come down with various facilities provided on campus remaining closed.

SC said that demanding fee for facilities not availed amounts to “profiteering and commercialization”, adding “overheads and operational costs so saved would be nothing, but an amount undeservedly earned by the school without offering such facilities to the students."

By saying this, the Supreme Court directed Rajasthan private schools to give a 15% deduction In annual school fees for the period 2020-21. The SC was hearing an appeal filed by some private schools of Rajasthan against HC order upholding the Rajasthan government's direction to schools to give a deduction of 30% in fees. Striking down that rule, the SC said that the appellants are justified in challenging the government order. However, that does not give licence to the appellants “to be rigid and not be sensitive about the aftermath of the pandemic."

In law, the school management cannot be heard to collect fees in respect of activities and facilities which are, in fact, not provided to or availed by its students due to circumstances beyond their control.

Demanding fees even in respect of overheads on such activities would be nothing short of ind

*Delhi: COVID patient fails to get bed, dies; family attacks hospital staff*

New Delhi, Apr 27: Family members of a woman, who allegedly died due to COVID-19 after failing to get a bed at Apollo Hospital in south Delhi, attacked the staff of the private healthcare facility on Tuesday, police said.

However, they said no complaint has been filed in this regard so far.

"The hospital received a woman in a critical condition at the emergency in the early hours of Tuesday. Immediate medical attention appropriate to her condition was given by a team," the hospital''s spokesperson said in a statement.

"Given the paucity of beds, the family was advised to shift the patient to another facility with available beds. Unfortunately, the patient died around 8 am, following which her family members resorted to vandalism, destruction of hospital property and assault on our doctors and staff," it said.

While the hospital deeply condoles the death of the patient, it is deeply shocked at the behaviour of the patient''s family against doctors and healthcare workers who are providing untiring services amidst the pandemic, the spokesperson said in the statement.

Pictures circulating on social media showed blood on the floor, broken doors and furniture strewn around inside the hospital.

A purported video clip of the incident showed the hospital staff and some people engaged in a pitch battle, hitting each other with sticks, near the hospital''s entry gate.—(PTI)

lockdown in Kashmir valley to prevent spread, deaths due to Covid-19: DAK to Govt*

SRINAGAR - Doctors Association Kashmir (DAK) on Tuesday urged government to impose lockdown in the Valley to prevent further spread and deaths due to the novel Coronavirus.

“Lockdown is the only tool to tackle the worrying situation we are in,” said DAK President and influenza expert Dr Nisar ul Hassan.

“Returning to a situation where we will have no control is far worse than a week or two of social measures,” he said.

Dr Nisar said we are witnessing a horrific situation in hospitals.

“For the last few weeks people in large numbers are coming to hospitals with severe bilateral pneumonia requiring oxygen and many needing intensive-care setting," he said

“Our beds are full, oxygen points are occupied and we don’t have space in ICU’s,” he added.

Dr Nisar said “not only the elderly and those with underlying medical conditions, but young people are now coming with severe disease and some of them are dying.

"The virus has taken an ugly turn and the situation has deteriorated," he said.

“If we will not impose restrictions now, we will be in a situation which will be difficult to control,” warned Dr Nisar.

“It is important for policy makers and public to know that decisions need to be based on what is happening with the disease in our community rather than what other places are doing,” he said.

“The decisions need to be driven by data rather than public or economic pressure,” said Dr Nisar. - (KIMS)
