A City of Harlingen resident has filed a civil rights complaint alleging excessive force by the Harlingen Police Department. Initially named officers Joel Avalos, Arnoldo Maldonado, and Steven Benitez, the resident now seeks to include Westin Wilhite and Andres Flores in the amended complaint, citing new information.
The incident, shockingly, began over a simple turn signal. We've previously shared the full footage, but this brief clip highlights the aggressive treatment the citizen endured.
The proposed complaint asserts:
“Plaintiff re-alleges the foregoing as though fully set forth herein. The actions and/or omissions of Defendants Maldonado, Avalos, Benitez, Wilhite, and Flores amounted to an unjustified and excessive use of force against Plaintiff. Notably, Defendants continued to use a taser on Plaintiff even while he was handcuffed and subdued. Furthermore, Defendants stated their intention was not only to subdue Plaintiff but also to break Plaintiff’s limbs.”
The audio captures a disturbing intent to inflict harm. Do you hear it too?
The Harlingen Police Officers await the court's determination if they will be named in the lawsuit. Interestingly, based on hearing some of the radio traffic, this type of behavior seems routine from the “gang unit” and K9 officer.
We also note that HPD has a “highway” unit, yet the City of Combes (a small community just north of Harlingen) seems to have more interdiction cases than HPD. We question what they spend their time on and if it consists of effective fiduciary outcomes.
Notably, the Cameron County District Attorney also performs interdiction and has more worthwhile cases than HPD. We question HPD enforcment practices and skill to deliver true community safety.

The Hays County Sheriff’s Office has released footage of the Isaiah Garcia shooting to the public.
The footage captures the incident that led to Garcia being indicted for deadly conduct in April 2023. This indictment was dismissed on June 20, 2024, following a plea agreement.
At the time of the incident, Garcia was serving as a Deputy Sheriff in Hays County, working as a jailer. On December 12, 2022, he was tasked with escorting Joshua Wright to a hospital in Kyle, Texas, for treatment.
Garcia removed Wright’s handcuffs so he could use the restroom. When attempting to reapply the handcuffs, Wright shoved Garcia and fled, still wearing shackles and creating distance from Garcia.
The footage shows Garcia pursuing Wright through a crowded hospital, culminating in Garcia shooting Wright from behind.
