As I'm typing this, the votes have finished and the 2 black lawmakers have been expelled, while the lone white woman was spared. The state of Tennessee has spoken loud and clear about where there priorities are when it comes to speaking out against gun violence, and in doing so may have inadvertently given the Democratic party 2 new superstars. Justin Jones and Justin Pearson definitely aren't going anywhere any time soon. Also this week, Mike Pence won't fight subpoena for testimony in Jan 6 case, MTG gets shouted out of her own pretest in New York, and more revelations about just how compromised the integrity of Clarence Thomas may be.

The Oklahoma legislature has broken federal law in restricting funding for transgender youth health care at OU Health.

By passing SB3, the state approved $40 million dollars of pandemic relief money from federal ARPA funding going to OU Health. A last-minute addition to the funding included a ban on the money going towards gender affirming care. The bill in Oklahoma states, “No money shall be budgeted or expended…for the benefit of any facility providing ‘medical s*x reassignment treatment,’ to children under the age of 18.”

OU Health said in a statement: "The legislature restricted the use of the funds from benefitting facilities performing certain gender medicine services. The new mental and behavioral health facility was never intended to provide such care. The OU Health Senior Leadership team is proactively planning the ceasing of certain gender medicine services across our facilities and that plan is already under development."

Anti-trans discrimination is unconstitutional under the Affordable Care Act’s Sec. 1557.

The US treasury states that recipients of ARPA funds can not discriminate based on s*x. This includes s*xual orientation and gender identity. Statutes that discriminate based on s*x must be supported by an “exceedingly persuasive justification.” United States v. Virginia, 518 U.S. 515, 531 (1996).

The legislation in Oklahoma does not meet this standard. Example: A federal judge in Arkansas has filed an injunction, halting the ban on gender affirming care in that state:

This is by far the most important race for Oklahoma this year, and we cannot stress enough how dangerous Ryan Walters is for the future of public education. It's unlikely he'll agree to debate on account of being a giant coward, but he should.
