The count down is on and it is days away from the 23rd World Congress on Safety and Health at Work
There has never been a more timely time to hear what has never been included or considered, but is fundamentally important to factor in. By listening to those who have experienced a workplace injury there is a lot that can be added to the discussion of how to create a safe, healthy workplace and maximise chances of rehabilitation. We also need to consider the impact on families that a badly managed recovery can have or even what the loss of a loved one encompasses.

The current Workers Compensation system can leave you feeling alone, isolated, untrusted and broken. How is it possible a system that is supposed to help you recover after a work based injury and get you back to work, can be so dissimilating that you spend your days searching for the light at the end of the tunnel!

Campaign win!

The State Insurance and Care Governance Amendment (ICNSW Governance) Act 2023 passed the Upper House late last week - and it contains a part of the pledge that the Injured Workers Campaign Network fought to get signed by over 150 candidates and sitting members.

Previously, the board of iCare was not able to make decisions that were "not in the best interests of ICNSW" - and we all know how this ended for injured workers.

Now however, all board decisions must promote the objectives of iCare, which now includes providing injured workers with "early and appropriate treatment and care for injury and illness that optimises the recovery and return to work".

The amendment seeks to improve governance iCare's governance through the introduction clear objectives for icare and its board - one of which uses the language of our pledge.

Aspects of the amendment include:

1. Clear Objectives: The amendment establishes clear objectives for icare - previously they were guided by the These objectives provide a reference point for all icare board decisions.

2. Addressing Gaps: The amendment addresses a gap in the existing legislation by establishing clear objectives for icare. While the current law defines functions, it lacks overarching principles to guide icare in achieving its functions.

3. Injured Workers: Places a strong emphasis on providing timely and appropriate care to injured workers. This is a huge win for the Network, the language having been pulled directly from the IWCN pledge.

4. Transparency and Accountability: The amendment promotes efficiency, transparency, and accountability in icare's operations. It ensures that icare conducts its functions as efficiently as possible, avoiding upward pressure on premiums and levies.

5. Government Oversight: The Treasurer is granted the authority to require icare to provide specific information when necessary, ensuring transparency and financial governance.

This legislation is part of the Government's ongoing reform efforts, responding to recommendations for clarifying the roles and responsibilities of various entities, including icare, SIRA, and SafeWork NSW.

Through your campaigning efforts, we have now seen 2 parts of the pledge enshrined in legislation: injured worker representation on the board of iCare, and the board of iCare having to keep timely and appropriate medical treatment for injured workers front of mind when making decisions.

The eyes speak in ways words could never encapsulate!
How is it fair when after 5 years you are left with no diagnosis, everything you try only makes the pain worse and you are unemployable with no support!
Workers Compensation shouldn’t send you to hell it should help you back up so you have a positive future!

Maybe you don’t like this style of music but the message is clear. The System itself leaves a huge majority of those seriously injured at work with added mental health injuries. It’s not a hand up it is abuse! It needs to stop! A person broken in body and spirit has virtually no chance of returning successfully to work.
If this describes your workers compensation journey then I apologise if it has triggered you. The world outside workers Comp needs to know that this is not an exaggeration if anything it is a minimisation because these 51 deaths don’t include those kicked off the system without help for 11 years or long term the affect of losing help when the legislation was backdated.
Please share so it is not just injured workers who understand this reality.

I used to believe the Myth before my injury….
I guess that’s why I feel betrayed by the System set up to care for injured workers and get them back to work.

Insurance Companies routinely challenge the recommendations of your medical team. It can take years to challenge their denial of treatment legally. For many it is too late for recovery by then.

Injured Workers can be so isolated and alone they think that their treatment under workers compensation is about them and being judged as fraudulent and not worthy of help.
It is a complete revelation when they understand that it is not just them! There are countless others hiding in plain sight fighting the same injustice, lack of timely medical care and financial support.

IT IS NOT ABOUT THEM, IT IS ABOUT AN ABUSIVE SYSTEM THAT WITHOUT EFFECTIVE REGULATION DESTROYS LIVES AND FUTURES ON A ROUTINE BASIS BECAUSE THEY CAN.

Join us as we work together to lobby to change the Legislation and give protections to vulnerable Injured workers in NSW. You need to answer the questions and provide an email address but our group is a safe place for injured workers to find out what is going on and how they can help the campaign.

I am proud of our efforts! The Injured Workers Campaign Network has come so far!
We celebrate the passing of the first Legislation to reform the System which provides an Injured Worker Representative on the Board of ICARE and for the existence of an Advisory Committee who will be a voice of the experiences of Injured Workers lived experience.
This is what we stand for and what we will campaign for as we move on now in our campaign in hope!

The Liberals were not contesting the Legislation but belittled the Bill, The size of the gallery watching, the cause the Bill fought for etc etc.

Yesterday, the State Insurance and Care Governance Amendment (ICNSW Board) Bill, passed through the Lower House. This Bill will see an injured worker representative appointed to the iCare board. This is a campaign issue that has been hard fought by injured workers, and central to our strategy of getting inside iCare to address the substantial problems created by their ongoing mismanagement of the scheme.

While the Bill still needs to pass through the Upper House, this is a huge step forward for injured workers across the state of NSW. We have been ambitious and relentless in our campaign and pushed for our voices to be central to the scheme. After underpayments, neglect, and our data leaked, it is crucial our voices are heard at the highest level.

Thank you to Sophie Cotsis, Jenny Leong, Jason Yat-sen Li MP, Anna Watson MP - Member for Shellharbour, Liza Butler MP and Warren Kirby MP who spoke in favour of the Bill amendments!

Trigger Warning: The following story can be very confronting to some viewers. It contains REAL stories of the damaged workers compensation system.

Three years ago today The Liberal Nationals who were architects of the Legislation knew the consequences of their actions and ignored it.

Next week comes a first move to redress the mess by introducing a Bill for second reading to grant an injured worker representation on the Board of ICARE itself. The start of what it will take to fix the mess!
