BREAKING: Appeal court upholds Tribunal's judgment sacking NNPP's Abba Yusuf as Kano governor, declares APC's Gawuna as the authentic winner

The Court of Appeal in Abuja has sacked Abba Yusuf as governor of Kano State, upholding the decision of the lower election petition tribunal that earlier nullified the governor’s election.

A three-member panel of the Court of Appeal led by Moore Adumein, in a unanimous judgement on Friday, declared Nasiru Gawuna of the All Progressives Congress (APC) winner of the 18 March governorship election in Kano State.

The tribunal had declared Mr Gawuna of the APC the winner of the election after removing what it described as invalid votes cast in favour of Mr Yusuf.

But the Court of Appeal anchored its decision on disqualification of Mr Yusuf as a candidate in the election.

The court held that he was not a member of the NNPP as of the time of the election.

The court added without being a member of a political party, Mr Yusuf could not have been validly nominated to run for the election in March.

“Yusuf Abba was not a member of the NNPP as of the time he was purportedly sponsored on 18 March for the Kano Governorship election,” the judge ruled.

“The tribunal was wrong not have disqualified the appellant, Governor Yusuf. The failure of NNPP to properly sponsor Mr Yusuf according to Section 177 (c) of the constitution, is fatal to their case.

“All the nine issues are hereby resolved against the appellant, the judge held
This appeal is hereby dismissed. The sum of N1 million is awarded as cost against Governor Yusuf,” Mr Adumein declared.

Mr Yusuf, the incumbent governor, who had won the governorship election on the platform of the New Nigeria Peoples Party (NNPP), is locked in a fierce legal battle with Nasiru Gawuna of the ruling All Progressives Congress (APC), over the outcome of the poll.

The Independent National Electoral Commission (INEC) had declared Mr Yusuf as the winner of the 18 March election with 1,019,602 votes against Mr Gawuna’s 890,705 votes.

Mr Yusuf had rode on the popularity of a former governor of the state, Rabiu Kwankwaso, and his political machinery, the Kwankwasiya Movement, to defeat Mr Gawuna of the then ruling APC in the state.

But Mr Gawuna challenged the election outcome at the Kano State Governorship Election Petition Tribunal.

In a unanimous verdict on 20 September, a three-member panel of the tribunal set aside Mr Yusuf’s victory after declaring 165,663 of his votes invalid.

Therefore, the lower tribunal declared Mr Gawuna, who turned out to have the highest number of votes after the deduction from Mr Yusuf’s score, as the lawfully elected candidate.

However, the governor appealed against the tribunal’s decision at the Court of Appeal, which upheld the Tribunal's decision today.

The Court of Appeal’s decision will not be the final, as whoever is aggrieved with the outcome can still appeal to the Supreme Court.

JUST IN: Appeal Court Sacks Another LP's Lawmaker

The Court of Appeal has nullified the victory of LP's Olukayode Doherty and declared APC's Rauf Age-Suleiman the rightful winner of the Lagos State House of Assembly election for the Amuwo-Odofin II Constituency.

Text of Press Conference by the Acting National Chairman of the Peoples Democratic Party (PDP), Amb. Umar Illiya Damagum, Today, Thursday, November 16, 2023 at the PDP National Secretariat, Abuja.

Gentlemen of the press, we have invited you today to express serious concerns over the underhanded design by the All Progressives Congress (APC) to cripple our democracy, overthrow the democratic rights of Nigerians, suppress the Rule of Law and downgrade our nation to a fiefdom run by the whims of a cabal

Yesterday, our Party alerted that our nation is fast sliding into totalitarianism following the activities of a cabal in the Presidency which is out to emasculate Institutions of Democracy, especially the Judiciary in the desperation to subvert and overturn the expressed Will of Nigerians in the various election matters across the country.

Of particular concern is the perverse pattern and attempts by the APC to use certain hugely compromised Electoral Petition Courts to sn**ch elections clearly won by the PDP and award them to the defeated candidates of the APC who were rejected by the people at the polls in most States across the country.

This sinister agenda tailored towards a systemic emasculation of the opposition and foisting of an oppressive one-Party system is evident in the conduct and outcome of certain election petitions in Zamfara, Sokoto, Kebbi, Nasarawa, Delta, Ogun and other States of the nation where the Election Petition and Appeal Panels were used to rob the PDP of victory won at the polls.

Also of serious concern is the continuing stay of the patently bias Plateau State Election Appeal Court Panel sitting in Abuja despite widespread demands by the people of Plateau State and the PDP for its immediate disbandment having regards to its varying and contradictory judgments against the PDP, which are also in conflict with the provisions of the Constitution of the Federal Republic of Nigeria 1999 (as amended), the Electoral Act, 2022, INEC’s Guidelines and Regulations for elections.

You will recall that on Wednesday, November 1, 2023, our Party addressed a press conference in which we alerted Nigerians of the dangerous pattern of conflicting judicial pronouncements by the Plateau State Election Appeal Court Panel to decimate and alter the expressed Will of the people of Plateau State in the 2023 National Assembly Elections.

Our Party at that press conference, also raised concerns over allegations in the public domain that the Plateau State Election Appeal Court Panel has been hugely compromised and induced by the APC and the cabal to defy the Will of the people at the elections.

Allegedly in the bid to assist the APC, the Plateau State Election Appeal Court Panel, in clear departure from well-established Judicial Precedents on matters settled by the Supreme Court, delivered varying, contradictory and conflicting judgments on election Appeals with the same subject matter, same facts, same circumstances and same applicable laws in bias judgements clearly skewed against the PDP in favour of the APC.

Our Party exposed how, in a bizarre pattern, the Plateau State Election Appeal Court Panel ordered a rerun where the PDP won and the APC came third, while where the APC came second, it ordered that the Certificate of Return issued to the victorious PDP candidate be withdrawn and a new Certificate of Return be issued to the defeated APC candidate, who came second in the election.

Of course, the judgments immediately heightened apprehension in the State being a recipe for anarchy and chaos in an already tensed Plateau State.

This is especially as our Party duly conducted our Primary elections in Plateau State in compliance with the provisions of the Electoral Act 2010 and which was appropriately monitored by the Independent National Electoral Commission (INEC).

Given the inexplicable infractions in the varying judgments and the grave tension they triggered in Plateau State, our Party, in line with the aspiration and expectation of the people of Plateau State took a firm position and demanded that the President of the Court of Appeal immediately disband the allegedly compromised Plateau State Election Appeal Court Panel.

Our Party also demanded that a new Plateau State Election Appeal Court Panel be constituted to hear the remaining Appeals and that the manifestly bias and inconsistent judgments of the Plateau State Election Appeal Court Panel already delivered in the Appeals be subjected to judicial review.

To this effect, I as the Acting National Chairman of the PDP addressed a Petition to the President of the Court of Appeal wherein I officially restated the findings and demands of the PDP against the Plateau State Election Appeal Court Panel.

It is however curious and disturbing that up till this moment, none of the issues or demands made by the PDP has been addressed or met.

The continuing stay of the Appeal Panel is clearly pitching the people against the Court and the Institution of the Judiciary. It is vexatious, inciting and amounts to snubbing an affronted and injured people and daring them to do their worse.

The consequence is that the Judiciary is allowing itself to be seen as an institution that has no regards for the sovereignty of the people and their constitutionally guaranteed rights in an electoral process under our laws. Also, its paints the Judiciary in the image of an insensitive institution which has no respect for the Rule of Law.

The concern and fear of all well-meaning Nigerians is that when the Court, as in this case, conducts itself as if it is not governed by Rules, it destroys the respect and confidence of the people in the judiciary and such portends a great danger for democracy, peace and tranquility in our country.

The PDP therefore in very strong terms again calls on the Chief Justice of Nigeria (CJN) and the President of the Court of Appeal to save the situation by immediately insulating the Courts from the alleged influence of the anti-people cabal seeking to emasculate the judiciary and impose a totalitarian regime our country.

The PDP also urges the CJN and the President of the Court of Appeal, as very experienced judicial officers, to restore confidence in the Judiciary by immediately disbanding the present Plateau State Election Appeal Court Panel, set up a new Appeal Panel and subject the bias judgments by the Plateau State Election Appeal Court Panel to judicial review.

This is the only way to avert crisis in Plateau State and redeem the image of the Judiciary from further negative public commentary.

The PDP will not relent in all its efforts to defend and preserve our democracy, respect for the Will of the people as well as the integrity of the Judiciary particularly in the handling of electoral matters in the country.

In this regard, the PDP invites all well-meaning Nigerians, Civil Society Organizations, the Media and indeed all lovers of democracy across the world to rise to the occasion, speak out and take urgent legitimate steps to defend the integrity of our judicial system and stem a looming crisis in our beloved country.

BREAKING: Appeal Court sacks Zamfara governor, orders fresh poll

The Court of Appeal sitting in Abuja has sacked the governor of Zamfara State, Lawal Dauda of the People’s Democratic Party (PDP), following an appeal entered by former governor Bello Matawalle.

*Recall that the Independent National Electoral Commission (INEC) had after the March 18 governorship poll, declared Dauda Lawal as the governor-elect, saying he garnered 377,726 votes.*

*The incumbent governor at the time, Bello Matawalle of the All Progressives Congress (APC), was said to have gotten 311,976 votes.*

Bello approached the Zamfara State Governorship Election Petition Tribunal sitting in Sokoto, with a petition against Dauda’s election.

Matawalle’s legal team led by Akinlola Kehinde SAN, had alleged there was wrongful collation of election results, including those of Maradun LGA.

He also argued that elections were not held in several wards in the state without any reason given by INEC.

But the Tribunal affirmed the election of Lawal, while dismissing Matawalle’s appeal for lacking in merit.

After losing his second term bid, Matawalle was appointed as Minister Of State, Defense, by President Bola Tinubu.

But he went on to appeal the verdict of the Tribunal, arguing that Dauda did not score the majority of lawful votes cast during the governorship poll and that the election was inconclusive.

He contended that the Tribunal erroneously struck out evidence tendered by his witnesses including several paragraphs in his petition.

But the PDP countered Matawalle, contending that he failed to prove his petition against Dauda’s election victory.

*On Thursday, a three-man panel of the Appeal court led by Justice Oyebisi Folayemi, declared: “It is our view that the order of the Trial tribunal striking out several paragraphs of the appellants petition was erroneous.”*

On the tribunal striking out the evidence (PW1 and PW17) tendered by Matawalle as hearsay, the appellate court held that it was evidently seen from the polling units results used by INEC that the result sheets were not signed by party agents of the appellants.

More so, the appeal court held that the evidence of Matawalle’s two witnesses (LG collation agents), contrary to the Tribunal’s position, are linked to the specific aspects of the appellants case.

The appeal court maintained that in line with the Electoral Act, it shall not be necessary for a party who alleges non compliance with relevant laws, to call oral evidence if their exhibits show the same allegations.

The appeal court observed that the documents INEC relied on to declare results in Maradun LGA of Zamfara state were mutilated, and as such, the same exhibits tendered by Matawalle before the Tribunal were not hearsay evidence.

“This court resolves this issue in favour of the appellants.,” the court held.

The appeal court further held that the tribunal failed to properly evaluate the evidence brought before it and that the appellants placed credible evidence before the tribunal.

The appeal court subsequently held that the appellants successfully proved that Dauda was not duly elected, and that the INEC Results Viewing Portal cannot be used in collating results as done by the Tribunal.

“This appeal is hereby allowed.

“The March 2023 Governorship election held in Zamfara state is inconclusive and the return of Dauda is set aside.

“INEC is hereby directed to hold fresh elections in Birnin Magaji and Bukun Yum LGA,” the court held.

This judgment was adopted by Justices Cordelia Ifeoma Jombo-Ofo and Sybil Nwaka Gbagi.

EDO 2024: PDP releases timetable for Governorship election

The National Working Committee of the Peoples Democratic Party has released its schedule of activities ahead of the Edo State governorship election.

The timetable which was signed by the party’s National Organising Secretary, Umar Bature, was released on Thursday after a joint meeting of the Board of Trustees and National Executive Committee of the party at its headquarters in Abuja.

According to the timetable, the party’s congress where its governorship candidate will emerge will hold on February 22, 2024.

The PUNCH reports that aspirants interested in contesting the governorship election will get the nomination form for N21 million, while youths aged between 25 and 30 will get a 50 percent discount on the nomination form fees.

According to the schedule of activities, registration of old and new members will hold between November 16 and December 7.

December 14 is the last date for submission of ward register to the Directorate of Organisation and Mobilisation while stakeholders’ consultative meeting with the National Working Group will hold between December 19 and 20.

Sales of expression of interest and ad-hoc forms for all offices is slated for January 10-16 while January 17 is the last day for the submission of already completed expression of interest and ad-hoc forms.

The screening of aspirants for the governorship seat by the National Working Committee will hold on January 18, 2024

Sales of the nomination forms to aspirants who completed and submitted their expression of interest form is slated for January 19- 25 while January 27 is the last date for submission of already completed nomination form.

February 22 is for the governorship primary while February 24 is for the appeal on the governorship primary.

THIS STRIKE IS A PROTEST AGAINST THE EMERGING CULTURE OF STATE VIOLENCE AND IMPUNITY - NLC

We would want Nigerians to not lend themselves to the “private matter” narrative being promoted by agents of government as it is intended to divert attention from the real issues.

Even as no freedom can be greater than the personal liberty of an indivudual in a popular democracy, which was violently and viciously violated in Imo, what the Nigeria Labour Congress and Trade Union Congress of Nigeria are fighting through this strike action are serial acts of violence/assault and impunity committed against individuals and organisations by the Nigeria Police Force or under their watchful eye or supervision.

We make haste to cite three instances here even as there are several others within the brief life of this government.

We recall the despicable role of the police in the forceful seizure of the offices of NURTW, RTEAN and NUPENG.

This strike among other things, is a protest against this reprehensible impunity which is fast becoming the signature of this government.

The arrest, beating and torture of Comrade Joe Ajaero represents the raising of the stakes in this culture of harassment and intimidation and we have no apology for resisting this through a strike.

For those not in the know, tyranny begins with the loss of personal liberty through the negative deployment of state power through it’s agents.

Critics of labour unions forget that they could be the next victims tomorrow.

Finally, we demand that the government of President Bola Tinubu nip in the bud this burgeoning culture of harassment, intimidation, violence and terror!

We will not back down until we secure a commitment from government to govern by the prescribed laws of the land.

We are clear about our objectives and we are not in need of approval ratings from agents of government passing themselves off as our friends.

The gradual closing of democratic space is a clear and present danger or tendency we can ill-afford to ignore.

Bayelsa State Governor, Senator Douye Diri , has canvassed for legislation to check the menace of vote-buying as part of measures to safeguard the country's electoral system.

Senator Diri stated this on Tuesday at his country home, Sampou, in Kolokuma/Opokuma local government area when his predecessor and Senator representing Bayelsa West, Chief Seriake Dickson, paid him a visit to formally congratulate him on his re-election for a second term.

The governor condemned the act of vote-buying, describing the development as part of the country's electoral process that was faulty.

He called on stakeholders to work collectively in addressing the menace in order to prevent politicians that do not mean well for the state to hijack the process.

His words: “For me, that is part of our electoral process that is very faulty. I like to urge our leaders, especially those that are in the National Assembly, to propose a bill that can solve this problem of vote-buying because it is becoming a very big problem here in Bayelsa State.

"So we all need to put our minds together to see how we can address this issue because that is the only way we can prevent politicians who do not mean well for the state from having access to political power."

Diri thanked Bayelsans for renewing his mandate to serve them for another four years.

In his remarks, Senator Seriake Dickson said he led a delegation of the Bayelsa West Senatorial District to congratulate Diri on his well-deserved victory.

He noted that in securing a second term, the governor has four more years of stability to consolidate on his development agenda for the state.

According to Dickson, "just as the people of Sagbama-Ekeremor senatorial district supported you in 2019 election, they did it again this time and they are still assuring you of their support in this fresh mandate.

"There is high expectations from the people and we know and trust that you will bring it about. You have taken the road to Ekeremor and we also expect that you will start the road to Agge. Power means nothing if it does not bring about development, peace and prosperity."

Also on Tuesday night, during a live Channels Television political programme, the re-elected Bayelsa governor applauded the Independent National Electoral Commission (INEC) for cancelling and rejecting questionable ballot figures earlier returned for Nembe local government area in Saturday’s poll.

Diri lauded the electoral umpire for insisting on the use of the Bimodal Voter Accreditation System (BVAS) to protect the integrity of the election.

He said the BVAS device was fully deployed during the election just as there was prompt distribution of sensitive and non sensitive materials across the state.

He said: "The electoral umpire did well and l want to believe that this is one of the best elections it has conducted where the BVAS was brought to full test and we saw that wherever it was bypassed, all parties were scored zero."

Making reference to Nembe-Bassambiri community where the BVAS was bypassed, he said INEC entered zero votes for such areas.

The state's helmsman noted that while the conduct of the election could be adjudged to be free, fair and transparent, it however was not perfect as it was human effort.

Comparing the conduct of the elections in Bayelsa to Kogi and Imo states, the governor noted that the terrain of Bayelsa was totally different from the two other states and attributed the delay in releasing results to the state’s difficult terrain.

"When there was hue and cry over the delay in releasing results, we understood that it was not that easy for election to be conducted and results stream in the way they could have in Kogi and Imo states."

He also exonerated INEC from the violence and hijack of election materials that occurred in Bassambiri, stressing that the politicians were to blame.

“Rather than accusing the electoral umpire, l think that the politicians in Bayelsa should be accused. For instance, l just gave you an example of Bassambiri and the history of what happened there before the election.

"It is a place where my party’s supporters were chased out of the community, including the Commissioner for Justice and Attorney-General who is a Senior Advocate of Nigeria. We tried to bring them back a day to the election but over 500 of them were prevented from entering the community.

“The intention was to ensure that no other party apart from APC went in there, which they succeeded and that led to the bypass of the BVAS so they can bring in voodoo votes from that part of the state.

"At the end of the day, everywhere you had proper voting, the votes that trickled in were in their very few numbers. But in Nembe-Bassambiri where BVAS was bypassed and there was no election, you saw figures of over 40,000 votes. The same applied to Okpoama in Brass local government area where the candidate of the APC comes from and you also had issues of violence and killing of a young PDP supporter recorded.

“So the issue is not much with the electoral commission but with the character of the kind of people l saw as my opponent in this election."

When asked if he would extend a hand of fellowship to those who contested with him, Diri said: “I will extend my hand of fellowship to all those who contested with me. My maxim from day one when l took over the reins of power is, to show love where there is hatred and to give light where there is darkness.

“But l will not reach out to murderers. l will not reach out to very violent people. There must be a mindset to move away from the violence and murderous attitude of Timipre Sylva and those around him."

On why he ran for a second term, Diri explained that he wanted to prove wrong critics that said he was a Supreme Court-made governor and that he could not win election in the state.

JUST IN: Abuja High Court Stops Senator Anyanwu From Parading Self As PDP National Secretary

A High Court of Justice of the Federal Capital Territory has ordered Senator Samuel Anyanwu to cease parading himself as the the National Secretary of the Peoples Democratic Party, PDP.

Justice M. M. Adamu of the court in his ruling on a motion brought by a member of the party, Douglas Nwachukwu, through his lawyer, F. S. Jimba Esq. dated October 30,stopped Senator Anyanwu from performing the function of the office of the Scribe of the party.

A high court in Enugu had given similar order asking him to step aside as the party's national secretary.

In the motion, Nwachukwu had prayed the court for the following reliefs: An Order of Interlocutory injunction restraining the 1st Defendant (PDP) whether by itself, National Working Committee, National Executive Committee, servants, agents, privies or any other person howsoever described from recognizing, accepting or dealing with the 2nd Defendant (Anyanwu) as the Nation Secretary of the 1st Defendant pending the determination of the substantive suit.

An Order of Interlocutory injunction restraining the 2nd Defendant from parading or acting as the National Secretary of the 1st Defendant pending the determination of the substantive suit.

After listening to Barrister Jimba, the court held, "That this application succeeds and the Orders are hereby granted as prayed.

"That an Order of Interlocutory injunction is hereby granted restraining the 1st Defendant/Respondent whether by itself, National Working Committee, National Executive Committee, servants, agents, privies or any other person howsoever described from recognizing, accepting or dealing with the 2nd Defendant as the National Secretary of the 1st Defendant pending the determination of the substantive suit.

"That an Order of Interlocutory injunction is hereby granted restraining the 2nd Defendant/Respondent from parading himself or acting as the National Secretary of the 1st Defendant pending the determination of the substantive suit."

The matter has been adjourned to 24th January, 2024 for hearing of the substantive suit.
