Six years in prison for sponsors of Soot in Rivers

Those who engage in illegal operation of illegal artisanal refineries will now spend six years in prison without an option of fine

This is contained in a the Rivers State Environmental Protection and Amendment and Management amendment bill currently before the Rivers State House of Assembly

The bill seeks to amend section 22 of the principal law to make it a punishable offence for anyone that would engage in any activity that would cause soot

Moveable properties including vehicles used in the commission of the offence will also be forfeited to the Rivers State

Properties of persons found guilty used in committing the offence shall also be demolished

The law if passed would also give the Rivers State Government powers to revoke title documents in respect of the properties and transfer such properties to the state

Governor Wike's Suspension of Elected
Council Chairmen unconstitutional....
...Party gives Gov Wike 7 days to reinstate Chairmen

The All Progressives Congress in Rivers State has learnt of the unilateral decision of Governor Nyesom Wike to suspend some elected Local Government Chairmen in the State. According to a Government Statement issued in Port Harcourt, those suspended by the order of the Governor of Rivers State are the Chairmen of Port Harcourt, Degema and Abua/Odual Local Government Councils.

We have studied the circumstances surrounding the recent order issued by the Governor. We have found out that the State Governor acted outside the dictates of the Nigerian Constitution. The Constitution of the Federal Republic of Nigeria recognizes the existence of three tiers of Government. They are Federal, State and Local Governments.

For purposes of ensuring effective checks and balances in the system, the 1999 Constitution (As Amended) assigns oversight functions pertaining to activities of Local Government Councils to State Houses of Assembly. The Rivers State House of Assembly is accordingly the only authority, which by way of resolutions, recommendations, lawmaking, etc, has the capacity to take far reaching steps regarding the management or administration of local government councils.

There is no section of the Nigerian Constitution which allows the Executive arm of Government in any State, or a State Governor as head of the executive, to punish elected officials without referring perceived acts of misdemeanor against elected officials at the third tier level to the House which has the power of oversight.

Where elected representatives err, our constitution allows a process of recall which makes it mandatory for two-thirds of the electorate to order the return of their representatives. The same constitution prescribes an impeachment of chairmen by councillors who constitute the legislative arm at that the Local Government level. In this instance, there is no proof that councillors in the affected LGAs have either complained or played their statutory roles before the Government action.

For the avoidance of doubt, what the Governor has done, in our opinion, is to hijack the responsibility preserved for the State Legislature under the Constitution. It is important to note that the Rivers State House of Assembly which has the power of oversight has not sat to deliberate on this matter.

The Rivers State House of Assembly sat about two weeks ago. To our knowledge, that was the last time that the elected representatives of the Rivers people met. There has been no other sitting by
members to consider matters of legislative importance ever since. It is also a matter of public record, given what was placed within the public domain, that the House only considered matters related to some appointments pertaining to the State Judicial Service Commission.

Not withstanding the reason why Governor Wike suspended the said local government chairmen, it is our view that the State's number one citizen has brazenly breached constitution. By his action, he has treated the House of Assembly with great levity. It is our expectation that the House of Assembly shall call the Governor to order.

We similarly believe that the suspension of senior staff employed by the Local Government Service Commission on grounds that they collaborated with their bosses, is another step taken too far. What was the Governor inferring by his action? Was he saying that workers at the grassroots should be disobedient to constituted authority?

Against this backdrop, we ask the State Government to take steps within seven days to restore the elected chairmen of Port Harcourt, Degema and Abua Local Government Councils to their seats. While urging the Government to do what is right, we want to draw attention to the fact that elected Chairmen and councillors belonging to the APC have been in court. They have been challenging their illegal removal from office by the Government of Rivers State.

The Supreme Court has ruled that it is illegal for any government in this country to set aside the mandate of elected Councils. We are aware that the Rivers State Government has acted in breach of this landmark decision.

We urge chairmen and councillors who were elected on the platform of our great party not to relent in their effort to secure justice. The APC shall continue to stand with them through out this period. Our conviction that the Apex Court will compel the Rivers State Government to comply with its ruling remains unshaken.

Finally, Rivers people can no longer tolerate the Governor's bid to promote a culture of fear and intimidation. Rivers people have had enough of his penchant for running a one-man show. As a political party, the APC enjoins the Rivers Governor to tone down a little. Nothing can be gained from what many right thinking Rivers people are beginning to view as acts of executive reckless on his part.

Lawmaker representing Eleme Constituency in the Rivers State House of Assembly Hon Igwe Aforji has described as condemnable, the decision of one Mr Osaro Nwakaji and 14 others to drag the Peoples Democratic Party in Rivers State to Court over the conduct of the Wed 18th of March 2020 ward congresses

Hon Igwe Aforji in a statement issued by him and made available to Kpokpo News expressed worry why Mr Osaro Nwakaji who he described as a non party man would take such actions when he knew nothing about the congress

He said "Mr Osaro Nwakaji is my constituent, he is not a party man, but a staff of Intels in Warri. so I wonder why he should allow himself to be used against a well organized ward, Local Government and State Congresses"

Mr Aforji also hailed the judiciary for always standing up to the task of delivering justice at all levels and advised members of the party who may wish to use the judiciary as a template and, or means to seek relevance or stall due process in future political activities of the party in the State to think twice before toeing such path adding that the PDP in the State has well articulated internal mechanism to handle personal concerns and matters arising from nominations as well as elections

Hon Aforji stressed that the new leadership of the PDP was unshaking since according to him it was elected on the principles of equity and appealed to the any aggrieved party members to stop wasting their time and resources on litigations but join the party to move it forward

As you may recall a High Court of the Federal Capital Territory (FCT) on Monday this week struck out a suit filed by some members of the People’s Democratic Party (PDP) in Rivers State, challenging the conduct of ward congresses in the state.

Osaro Nwakaji and 14 other members of the ruling party in the state, through their counsel, P. N. Ogbole SAN, had dragged PDP before Justice Charles Agbadza, sitting at Jabi, Abuja, through an originating summon to challenge their exclusion from participating and vying for positions in the ward congresses of the party in the state,

The plaintiffs/claimants sought a declaration of the court that they are entitled to participate in the PDP ward congress scheduled to hold in 2020 or any other date.

They also sought a declaration that the refusal of the party to issue them nomination forms having paid the requisite fees is unconstitutional, null and void.

The claimants further sought a declaration that the purported PDP ward congresses held or to be held in the state to their exclusion, having paid the requisite fees for nomination forms is null, void and of no effect whatsoever.

They further sought a perpetual order of injunction restraining the party from conducting any wards, local government areas or state congresses or further congresses in the state based on the ward congresses election conducted in 2020 or any other date.

Delivering judgment on the matter Justice Agbadza upheld the preliminary objection of the defendant, claiming that the court lacks jurisdiction to hear and determine the matter.

According to him, it was settled that the issue of jurisdiction was the live wire of any judicial proceedings and once raised, the court must determine it once and for all.

The judge held that going by the reliefs sought by the claimants, the cause of action emanated from Rivers State, adding that by instituting the matter in the FCT High Court, the conduct of the claimants was forum shopping and amounts to an abuse of court process.

He stated that by the virtue of the recent Practice Direction issued by the Chief Judge of the FCT High Court, Justice Ishaq Usman Bello, the case ought to be transferred to Rivers State, where it originated from since it was forum shopping.

Justice Agbadza further held that there are a plethora of authorities that the court cannot interfere in the internal matter of a political party.

He said the claims of the plaintiffs were a matter of internal affair of PDP, adding, “What the claimants are asking the court is to dabble into an internal matter of a political party.”

Saidu who is the leader of the northern community in Rivers State and 2 others are challenging the arrest of some northerners including their trucks and cows during the lockdown period​

They are demanding the sum of one hundred million naira​ as compensation for human right abuses

Justice E.O. Obile adjourned the case to the 22nd for adoption of motion on notice​

The adjournment followed in failure of the court bailiff to serve the defendants the writ of summons

INEC​ Worries over high cost of Bye Elections

The Independent National Electoral Commission (INEC) has expressed concerns over the increasing cost of organising the increasing number of bye-elections in the country. The Commission says a national conversation would be appropriate to address the concern.

Chairman of the Commission, Professor Mahmood Yakubu raised the concern at a virtual meeting held with leaders of political parties in the country held today.

Professor Yakubu said “there is need for a national conversation around the frequency of bye-elections in Nigeria. In the month of May 2020 alone, five members of State Houses of Assembly passed on. Since December 2019, a period of six months, twelve members of the National and State Houses of Assembly have similarly passed on. This is in addition to the resignation of two Senators from Bayelsa who have since been sworn-in as Governor and Deputy Governor of the State”.

“The cost of conducting these bye-elections to the Commission, the security agencies, political parties and candidates, election observers, the media, litigations (both pre-election and post-election) and disruption of activities as a result of the restriction of movement on Election Day is enormous”.

He observed that “there is no election season in Nigeria any longer. The Commission is busy conducting elections all-year round between one General Election and another. This often diverts our attention away from reform, innovation, peer learning and planning for the consolidation of our electoral process”.

“The Commission is going to open a discussion with stakeholders and the National Assembly for necessary reforms towards more cost-effective and democratic options”, he said

INEC URGES POLITICAL PARTIES TO CONDUCT RANCOR FREE PRIMARIES FOR EDO GOVERNORSHIP ELECTION



The Independent National Electoral Commission (INEC) has urged political parties intending to field candidates in the September 19th Governorship election conduct rancor free primaries, and adhere strictly to the date for submission of nomination of candidates.



The Commission said today, 1st June 2020 marked the commencement of activities for the Edo governorship election as outlined in the Timetable and schedule of Activities for the election made public on the 6th of February 2020.



Chairman of INEC, Professor Mahmood Yakubu made the call today at the opening of the Commission’s first virtual meeting with political parties.



Addressing Chairmen and Secretaries of Political Parties, the INEC Chairman said “based on experience, it is important to draw your attention to the necessity for rancour-free primaries. Party primaries form the foundation for the secondary election conducted by the Commission. You must therefore avoid acts of thuggery, brigandage, vote-buying and other sundry violations of the Electoral Act”.



“As we monitor the conduct of party primaries, we will pay particular attention to your compliance with the law and to consider sanctions so that the unruly behavior of some party supporters is not carried forward to the main election”.



He continued: “Party primaries for the nomination of candidates for the Edo Governorship election begin tomorrow. Already, some political parties have invited the Commission to monitor their primaries which must be conducted from 2nd to 27th June 2020. This time around, the submission of nomination forms will be done online for which a dedicated portal has been set up.



“Let me therefore warn political parties that intend to field candidates for the election to strictly adhere to these dates as well as the new online procedure for filing of nominations. Any party that operates outside these dates will only have itself to blame. The portal will automatically shut down on the scheduled date and at the fixed hour.”the INEC Chairman warned.



He recalled that the Commission had made public the Timetable and Schedule of Activities for the Edo and Ondo governorship elections earlier in the year and noted that the Edo governorship election was only 110 days away. He said: “you will recall that on 6th February 2020, the Commission released the timetable and schedule of activities for the Edo and Ondo Governorship elections. Today, it is exactly 110 days to the Edo Governorship election scheduled for 19th September 2020 and 131 days to the Ondo Governorship election holding on 10th October 2020”.



“The Timetables for the two elections contain 14 activities drawn from the Constitution, the Electoral Act as well as the Commission’s Regulations and Guidelines. The first activity is the official publication of Notice as enshrined in Section 30 of the Electoral Act. The date for this activity for the Edo Governorship election is today Monday 1st June 2020. I am glad to say that this activity has been carried out. The Notice for the Election (Form EC60A) has been pasted in our Edo State office… with this development, the process leading to the Edo Governorship election on 19th September 2020 has commenced in earnest”.



Commenting on the mode of primaries political parties may choose to adopt, the INEC Chairman said: “ I wish to appeal to political parties that opt for direct primaries to avail us with the register of members to be used for the election from Ward to Local Government and State levels for the effective discharge of our monitoring responsibilities under the law”.



He added: “those that opt for indirect primaries should similarly make available to the Commission the list of delegates for the election. Doing otherwise will amount to going into an election without the voters’ register. The Commission makes available to each political party the complete register of voters before every major election. We expect political parties to reciprocate for their primaries”.



Professor Yakubu said the meeting would afford the Commission the opportunity to discus the Commission’s revised guidelines for the conduct of elections with party leaders. “The policy will be a major issue of discussion at this meeting. I am glad to note that a number of political parties have also issued guidelines to their members for the safe conduct of party primaries for the forthcoming Edo and Ondo Governorship elections drawing from the advisory by health authorities”.



Responding, the Interim Chairman of the Inter-Party Advisory Council (IPAC) ​ and Chairman, African Action Congress(AAC), Leonard Nzenwa, Commended INEC for the development of the new guideline for conducting elections in the COVID-19 pandemic era. He said “the political parties would want to commend INEC for the bold step it has taken to come up early with a well-heeled Policy on Conducting Elections in the Context of Covid-19 Pandemic”.



“Indeed, the measures outlined to tame the scourge in the document is realistic, exhaustive, health-sensitive, safety-induced and in tune with reality of the times. Our checks so far show that globally the Independent National Electoral Commission, INEC is the first National Election Organising Body ​ to have done this, not even USA, India, Pakistan has codified effort to respond maximally, politics-wise to the pandemic in an enclosed one-all document as it did”.



The Interim IPAC Chairman continued: “It is also gratifying to note that the document received wide commendation across board and is now being referenced. And last week we commended the Commission via a plethora of media for its effort. From high-end issues as Health and Safety Concerns, legal matters, Election Planning & Implementation to Elections Operations to materials handling, Staff Management and Ad Hoc Recruitment and Placement to logistic, transportation and Passenger Management to queuing arrangement in polling Units, crucial areas in pre and post-election preparation and management were properly captured”



He however urged the Commission to address some grey areas observed by the parties and called for more stakeholder engagement in order to ensure all citizens were educated and enlightened on their roles with regards to organising elections in a pandemic situation.

PRESS STATEMENT

Disregard False Stories About NDDC.

The Management of the Niger Development Commission, NDDC, wishes to announce the death of its Acting Executive Director, Finance and Administration, Chief Ibanga Bassey Etang. He died in the early hours of Thursday in Port Harcourt.

This announcement is coming at this time because of the need to inform family members. The Commission is not aware of the cause of his death as at the time of this release (6.45pm on Friday, 29, 2020).

In line with fears of the current time, the Commission took the precautionary measure of temporarily shutting down its headquarters for two weeks. Staff were also asked to self-isolate.

This action does not presuppose the cause of death.

An autopsy report is being expected and when this is ready, it would be released with the consent of the family.

The NDDC is, therefore, miffed by spurious and uncharitable coloration being championed by mischief makers on the occasion of the demise of Chief Ibanga Bassey Etang, whose untimely death occurred at the early hours of Thursday the 28th of May 2020.

The Commission is on course to issuing a comprehensive fact-based statement in consonance with the bereaved family, but for the unwarranted and unsubstantiated reportage which is flying in devilish propensities.
Until the autopsy report is release from the Commission's stables, every story on this matter, flies in the face of truth.

The Commission also wishes to state that the rumours over the internal memo for staff of the Commission to stay away, so that sanitary and hygienic cleaning of the Commission can take place, is most unfortunate. The idea behind it is purely precautionary.

The commission wishes, therefore, to appeal to those mean spirited, whose ambition is to always turn truth on its head, to seek a path of repentance.

The NDDC is determined to deliver on its core mandate to the good people of the Niger Delta region. Neither slander nor provocative insinuations will deter us.

Rivers State Governor Nyesom Wike has cautioned that he would reinstate another round of lockdown in the state if residents continue flout state's government directives on COVID 19

Governor Wike gave this today during his democracy day​ broadcast​

He lamented that after several attempts by the state government to sensitize residents on the dangers of COVID 19 and the need to observe safety precautions residents are still disobedient

He said" so many people are moving about our street and other public places without face masks, we have cited business including banks and shopping centres attending to customers without face masks or maintaining physical distancing. We have also seen people on our streets buying and selling without face masks in clear disregard on the ban of clustered trading activities and unauthorized social gathering. While we have the recourse for total lockdown for obvious reasons, it appears we may be forced to reinstate this drastic measures sooner than later if members of the public continue to flout, disregard and or abuse the established regulations of social distancing and the compulsory wearing of face masks in the State"

Gov Tambuwal meets Buhari on killings in Sokoto

Sokoto State Governor, Aminu Tambuwal today met with President Buhari over recent attacks and killings by bandits in the state.

Briefing state house correspondents after the meeting, the Governor said he is satisfied with the actions of Mr President, noting that the President affirmed decisive actions to be taken against the attackers.

Rivers State Government to employ over 4000 youths for cassava production

Rivers State Governor Nyesom Wike has assured that the cassava processing plant in Afam, Oyigbo LGA would employ over 4000 persons when fully operational

Gov Wike who stated this after inspecting the plant yesterday also noted that the plant would boost agriculture in the state adding that already 3000 cassava farmers have been registered to produce cassava for the plant

He said the cassava plant which was initiated by previous administration and abandoned in 2012 is now 90 percent completed

He said the Cassava plant ought to have been Commissioned this month if not for the COVID 19 pandemic

Oga Eze, owner of a roadside mechanic workshop with 3 workers and 2 apprentices and his neighbor Kingsley, a welder all depend on their daily catch according to how fortune smiles at them to make a living. Unfortunately, they are gradually going out of living due to lockdown. There are more than 200,000 Oga Eze and Mr. Kingsley in Rivers State.

Maureen works in a restaurant while her friends Laura and Chibroma work in a night club and a hotel respectively. They are about to lose their jobs, which took them off the street of prostitution, due to lockdown. There are more than 200,000 Maureen, Laura and Chibroma in Rivers State.

Mama Fubara's husband lost his rig work 4 years ago while Mama Ibeshe's husband, a habitual drunk died of liver complications leaving their 7 children behind for her to cater to. Mama Fubara has taken to market trading at Fruits Garden market just to provide food, shelter and help for their children while Mama Ibeshe goes all the way out daily selling 'abachaa' just to make ends meet.These women depend on their daily profit to feed their families. These women are the real heroes but their livelihood is threatened by this lockdown. There are more than 200,000 Mama Fubara and Mama Tekena.

Mama Okoro who sells vegetables at Creek road market, her neighbors Sister Ngozi and Okon, a pepper seller and a grinder respectively have eaten up their business capital just to survive in this lockdown. They may never go into business again. There are over 200,000 Mama Okoro, Ngozi and Okon in Rivers State.

Sir Wowowo is an economics teacher in a private school while his friend Engr. Abinami with second class upper in Petrochemical Engineering is doing his business in 'GRA'(General Running Around) for want of a white collar job since he graduated in 2000. Both men have families depending on them. Their hopes are dashed as they may lose their hustle due to lockdown.

The list is endless...

As the world resets itself to normal, our dear Rivers economy will plunge and be plagued with a deadly economic pandemic known as recession.

Millions of people in Rivers State, especially in the informal sector will lose their jobs and livelihood. Life after Covid19 pandemic will be very tough and unbearable for so many individuals and households.

The resultant adverse effects will be increased crime, criminal and nefarious activities, increased prostitution and ritual killings, high-end corruption in public and private sector, unprecedented school dropouts and frustration/depression leading to su***de and suicidal thoughts etc. Rivers of hardship and death!

WAY FORWARD

The government of Rivers State should put together an economic team of highly knowledgeable and experienced persons with proven capacity and integrity to thinker and administer programs that will be targeted towards reviving the economy. The team should bear in mind the present state of crude of price crash and it's effects on the monthly revenue of the state.
'CAPACITY, INTEGRITY AND TRANSPARENCY should be the Hallmark for qualification into membership of this team. I wonder if we still have such persons in Rivers State. I believe we still do!

The team should amongst its wide consideration, recommend zero interest soft loans to SMES under strict monitoring and compliances. Remember, our people often think that government money is everybody's money!. The loan should be disbursed thus:

👉 N50,000 each to 25,000 household businesses especially traders in various markets across the state. This is 1billion Naira.
👉 N50,000 each to 25,000 small scale farmers across the state. This is another 1 billion
👉 1 billion naira to be accessed collectively by large scale farmers depending on the vaibility of their Proposal.
👉 1 billion naira to be accessed collectively by business owners such as hotels, restaurants, factories, etc.
👉 1 billion naira to be accessed collectively by genuine traders or intending traders.

The government should as a matter of neccesity, place it's major interest in harnessing our agricultural resources using modern technologies of production and processing.

My suggestions above, may not provide a blanket solution as I'm only a lawyer not an economist. But I believe, it can be thoroughly looked into, reviewed or modified to suit economic trends.

This can only be achieved with a collaborative effort between the state, local government and multinational companies who are willing to help out.
