Independent Artists, navigating your own music career can be very challenging.

Who has Copyright Questions?

Here is a breakdown of copyright information for independent artists getting started in the music business:

⚖ Basic Copyright Law
- Copyright protects original works of authorship like songs, recordings, artwork, etc. It is automatically granted when the work is fixed in a tangible form.

- As the creator of an original work, you own the copyright and have exclusive rights to reproduce, distribute, publicly perform, display, and make derivative works.

- Copyright lasts for the life of the author plus 70 years. For works-for-hire, copyright lasts 95 years from publication or 120 years from creation.

®️ Registering Copyright
- You can register your copyright with the U.S. Copyright Office at copyright.gov. This isn't required but provides legal benefits like the ability to sue for infringement.

- To register a song, you need to submit an application, fee, and deposit copy (e.g. lyrics, recording). Visual art requires images.

- The current fee is $45 to register one work online.

📃 Using Copyrighted Works
- You need permission to sample other artists' recordings in your songs. Many use sample clearance services to obtain rights.

- For covers, you generally need to obtain what's called a "mechanical license" from the publisher to reproduce and distribute the composition.

- Be careful about using third party beats, instrumentals, etc. as they may contain unlicensed samples or lack permission from the creator to use.

PSA: You can be a veteran in the music industry continuously learning, growing, and educating yourself with as much knowledge as possible, think you have most of it figured out, and still be caught off guard feeling like a deer in headlights. There's some real shady people out there. Knowledge is power folks. Don't be afraid to build relationships with like-minded individuals. Don't be afraid to ask questions. You never know when one single person can save you from taking the wrong step, or being mixed up with the wrong kind of people. If someone offers you genuine advice, it's most likely because they want to see you succeed. They want to see you thrive. They want what's best for you, and your career. You will know when it's coming from a good place. It's confusion that should be a red flag.
Stop. Listen. Evaluate. Apply your knowledge. Continue moving forward. That is all.😊

64 years ago today, February 3rd, 1959 Buddy Holly, Ritchie Valens and The Big Bopper's (J.P. Richardson) plane crashed outside of my hometown in Clear Lake, Iowa. They had just played a concert at the legendary Surf Ballroom & Museum. Waylon Jennings was Buddy Holly's bass player at the time. He came down with the flu, and gave up his seat on the plane for Richardson. Tommy Allsup who played guitar in Holly's band, lost his seat to Ritchie Valens in a coin toss. They were headed to an airport in North Dakota to play their next show on the tour in Moorehead, Minnesota. It was poor winter weather conditions, and the pilot lost control of the Beechcraft Bonanza just after take off, and subsequently crashed into the cornfields. Unfortunately, all 4 died that fateful night.

People come from all over the world to visit our little podunk town, and see the memorial site. I am so incredibly lucky to share a small piece of history from this tragic story. I had the honor of performing a 4+ hour show with my mom for Buddy Holly's wife, Maria Holly for a private Buddy Holly Memorial Anniversary event. My dad Roger Mikkelsen was a chef at The Diamond Kay (now Rumors) in Clear Lake, where the event took place. That night was something so truly magical, I will cherish it forever. After all, it's not every day a small town Iowa girl gets to meet, perform for, and hang out with a legendary music icons wife, and to share that memory with both of my parents is incredible.

This is a photo I took at the entrance. There is a memorial at the actual crash site about .35 mile into the cornfield. The entrance can be found on the corner of Gull Ave & 315th St. Navigate your GPS to 22728 Gull Avenue, Clear Lake, Iowa and look for the giant glasses on the side of the gravel road. The section of land leading to the crash site is mowed for easy access. Don't forget bug spray!

Not only is it my Birthday month (Oct. 7th), there's only 20 more days until I get to see my JMA fam at The Josie Music Awards, and it'll be my very first time inside the Grand Ole Opry House in Nashville, Tennessee!!
