Catholic Church Pledges Support for President Chakwera, Endorses Appointment of Veep Usi

In a significant show of support, the Executive Permanent Council of the Episcopal Conference of Malawi (ECM) has pledged unwavering spiritual backing for President Lazarus Chakwera and his administration.

During a visit to Kamuzu Palace in Lilongwe, ECM President Desmond Tambala conveyed the Church's endorsement of Chakwera's recent appointment of Dr. Michael Biswick Usi (MB-Usi) as the new Vice President, following the tragic passing of the late Dr. Saulos Klaus Chilima.

"Our coming was to convey our condolences to the head of state but also to assure him of our prayers and our support for his leadership, including the appointment of the new Vice President," Tambala told the media after the meeting.

The ECM President emphasized that the Catholic community is keeping the families of the deceased in their prayers, while also firmly standing behind Chakwera's decisions during this period of national mourning.

During the interaction, President Chakwera reciprocated the heart feeling, taking the opportunity to console the Catholic bishops while acknowledging that Chilima was a devout Catholic faithful. Pres. Chakwera further underscored the close relationship between the government and the faith-based community in Malawi.

Presidential Advisor on Religious Affairs, Reverend Brian Kamwendo, praised the ECM's visit, highlighting the importance of the Church's spiritual support for the nation's leadership, particularly during this challenging time.

The Catholic Church's endorsement of Chakwera's appointment of MB-Usi as the new Vice President reflects the influential role of faith-based institutions in Malawi's political and social landscape. This partnership is seen as a vital source of strength and guidance as the country navigates the path forward.

MICHAEL USI APPOINTMENT: UNITING A GRIEVING NATION & SETTING A NEW TONE FOR NATIONAL DEVELOPMENT

The appointment of Dr. Michael Bizwick Usi as the new State Vice President brings with it refreshed aura for a nation emerging from national tragedy and grief.

In Dr. Usi, President Lazarus McCarthy Chakwera has found a level-headed public administrator and development strategist who has fluid social connection with millions of Malawians owing to his professional background at ADRA Malawi.

A devout Seventh Day Adventist, Usi is a renowned social educator who has over the decades used his talents to transform communities across pertinent social issues ranging from health, education, politics, economy and religion among others.

RESPONSE ADDRESSING THE MISLEADING CLAIMS ON THE 7 DAYS PERIOD IN THE ANONYMOUS DOCUMENT

Anonymous document making the rounds is making several inaccurate and misleading claims regarding the President's constitutional mandate to appoint the Vice President. Firstly, the document wrongly asserts that the 7-day period outlined in Section 84(2) of the Constitution has expired, and therefore any subsequent appointment would be "null and void." This is incorrect.

As clearly explained in my post which I made on Tuesday, the proper interpretation of the relevant constitutional and statutory provisions shows that the 7-day period actually expires either on June 21st, or June 20th depending on whether we include or exclude Saturday. Section 45(2) of the General Interpretations Act excludes Sundays and public holidays (Monday this week was a public holiday).

The document's anonymous author has made a mistake in their calculation by failing to properly exclude the initial date of the event and public holidays, as required under the General Interpretations Act [see section 45(1)(a) of the Act].

The incident of the missing plane reportedly happened on Tuesday, 11th June. The vacancy in issue is due to death. The fact that a plane went missing could not entail death of its occupants. When someone goes missing, he can only be presumption dead after 7 years unless there is evidence proving their actual death. The evidence proving their actual death was the plane wreck and their bodies which were discovered on Wednesday. Thus for the purposes of the law, the death occurred on Wednesday when, upon discovering their bodies, a medical doctor pronounced them dead. The counting therefore, started on Wednesday as per section 45(1)(a) of the General Interpretations Act.

Secondly, the document falsely claims that the President will "lose the mandate" to appoint the Vice President if the 7-day period elapses. This is simply not true. The Constitution does not impose any such consequence or limit on the President's appointment powers. The anonymous author is reading into the provision something that is not actually stated. Perhaps also confusing appointment with announcement.

Today, for example, we have even read communique from MEC telling us that the President has appointed new MEC Chairperson and two Commissioners. While announcement of that appointment has taken place at the beginning of business today, it is possible that the appointment happened before today. In fact, the Communique highlights that the appointment is with effect from 7th June 2024. The implication of this is that the appointees will be said to have been appointed on 7th June yet the President might have appointed them yesterday or a day before yesterday. But announcement happened today.

This underscores the point that appointment and announcement of the appointment are not one and same thing. In fact, the Constitution says nothing about announcing the appointment of the Vice President. Those suggesting that the fact that the announcement is not forthcoming so far then appointment has not been made, they are simply reading their own words into the Constitution. No rule of statutory interpretation condones that.

Similarly, the suggestion that if an appointment is made after the expiry of a required period (assuming that the President has not yet made the appointment already) would null and void is an act of reading strange words into the provision itself. It is a sort of interpretation that is pedantic. Pedantic interpretation is not allowed at law (and this is something which whoever made that ridiculous opinion is expected to know).

The document boldly, yet, wrongly equates the act of appointment with the public announcement of the appointment. As demonstrated, the two are distinct - the President may have already made the appointment, even if the public announcement has not yet been made. The Constitution does not require immediate public announcement of the Vice President's appointment.

In essence, the anonymous document is riddled with errors, making unfounded claims and imposing imaginary restrictions that are not present in the actual constitutional and statutory framework. This kind of pedantic and inaccurate interpretation of the law is not permissible. The public should be wary of such anonymous, misleading opinions and instead rely on authoritative and properly reasoned legal analysis.

As I have mentioned, the said document is anonymous as it is not signed by any individual or organization. Further it is not posted directly on public space by its anonymous originator. It has been written and released anonymously via WhatsApp platform. This makes the document faceless. And there is a reason why the originator made it faceless: He is cautious against embarrassment. The opinion carried by the document is utterly embarrassing.

MEGA FARMS ARE NOT A PRESERVE OF UTM

In the days following the burial of late Right Honourable Saulos Klaus Chilima, there has emerged a trail of opinions around his impact on the mega farm initiative being implemented by government across the country.

Those that have birthed this discussion seem desperate to credit the mega farm initiative solely to the late Vice President, and no one else.

Truth is, this should not be the case. We must be guided more by what the anticipated outcomes of the mega farm initiative entail than who mentioned it first at some political platform.

For the sake of argument and enlightenment, the main leading partner in the Tonse Alliance, Malawi Congress Party, has fronted the mega farm idea as back as over ten years ago.

Both its 2014 and 2019 election manifestos have put into greater perspective on how the party has long intended to transform the agriculture sector. Page 27 of the Malawi Congress Party 2019 manifesto discusses the party’s intention to give the agriculture sector a facelift in line with its intended industrialization agenda.

“The MCP understands agricultural transformation as involving restructuring the sector, a focus on activities and interventions that raise productivity, and the modernization of agriculture. Through the agricultural transformation agenda, the vision of the MCP is to create an agricultural sector that emphasizes the importance of increased agricultural productivity and linkages to domestic markets, self-sufficiency in food production, tackling massive unemployment of youth and women, poverty reduction and strong private sector participation.”

The blueprint further states that;

“The ultimate goal of the MCP government will be to increase agriculture’s contribution to economic growth by not only increasing production for food security, but also for agro-processing and manufacturing for both domestic and export markets.”

The MCP manifesto also posits that they will “prioritize the following areas: land access and tenure; agribusiness development with particular focus on youth and women; agricultural productivity and development; agriculture extension and appropriate technology; market access and development, climate change and agricultural development; and management for agricultural transformation.”

This is why all the attributes of mega farms that MCP mentions in its manifestos fit perfectly with what they are doing today across the country in transforming the agriculture sector.

The Linga Mega Farm in Nkhatabay, Katunga-Maseya (KAMU) Mega Farm in Chikwawa are a proper model of what the Malawi Congress Party has always wanted even before it assumed power in 2020.

Further to this, President Chakwera’s MCP is one that is reviving most of the irrigation schemes that were abandoned in the mid 90s, few years after Ngwazi Hastings Kamuzu Banda left office.

Based on this argument, it may only be right that the departed Vice President put a name to an initiative that has always been part of the MCP genetic make-up.

It is only proper to put things in perspective.
