Fact Finding Committee (FFC) Report on Sameena Maternity & Nursing Home, Talabkatta, Hyderabad, Held on 07-06-2020
INTERDUCTION: On 29-05-2020, a minor girl of age 14 years - Mumtaz Begum has died at Sameena Maternity & Nursing Home, Talabkatta, Hyderabad. Mumtaz Begum was vomiting continuously on 23-05-2020 and immediately her mother Rayeesa Begum took her to Sameena Maternity & Nursing Home which was near to their house. Dr. Sameena told them that admission is necessary. Rayeesa Begum admitted her daughter by depositing an amount of Rs. 50,000/- but she did not receive any receipt from the Hospital authorities. Dr. Sameena examined the patient and told that the girl has a hole in abdomen and that operation was necessary. They operated on the daughter, but the girl died on 29-05-2020. Rayeesa Begum has claimed that this death happened due to the un-necessary, un-ethical operation and the hospital authorities purposefully did this for money. Dr. Sameena has claimed that sometimes operations fail and that the failure wasn’t due to the doctor’s negligence.
On 07-06-2020, a team comprising of Jaya Vindhiyala, State General Secretary, PUCL-TS & FFC coordinator, Iqbal Khan, State Vice-President, PUCL-TS, Saleem, Greater Hyderabad General Secretary, PUCL-TS, Khaja, members of PUCL-TS, Yakub, member of PUCL-TS, Umar, members of PUCL-TS, Akhil, members of PUCL-TS, Mumtaz, member of PUCL-TS, Gaddam Ashok, OU JAC Chairman, Islavath Balaji, CPF Co-convener conducted a Fact Finding enquiry into the reported death of the 14 years girl on 29-05-2020. The team visited the house of the deceased and spoke with family members. The team also visited Sameena Maternity & Nursing Home, Talabkatta, Hyderabad to speak with the authorities and the Police Station, Rain Bazar, Hyderabad and spoke with the investigating officer, Mr. G. Vinod Kumar, Sub-Inspector regarding this premature death. During our visit the Station House Officer was not available at the station.
Version of the mother of deceased girl and other family members:
We were informed that 14 years girl Mumtaz Begum was a very active and clever student in her class. She was very healthy and she didn’t have any health issues until the recent issue.Rayeesa Begum approached the nearest hospital to her house to consult the doctor regarding her daughter’s problem. Dr. Sameena after checking her Daughter told that she has a hole in her abdomen and that she needed to be operated
urgently as it was a serious danger. She was worried about her daughter’s condition and agreed to the operation. And Dr. Sameena said that operation expenditure would be around Rs. 70,000/- and asked her to deposit the amount. Rayeesa Begum
deposited Rs. 50,000/- and promised that she would pay the remaining Rs.20,000/- a few hours later. But Dr. Sameena insisted that she pay the remaining amount and posed a question to the mother stating that how she would operate without paying the full amount for operation. Since then the mother didn’t see her daughter at hospital and she didn’t sign any documents for operation or any hospital documents. When the mother asked, they said that Mumtaz Begum is in ICU and that no one can see patient. On 29-05-2020 afternoon Dr. Sameena send Mumtaz Begum’s dead body to her home without any information with nursing home ambulance. Mother Rayeesa Begum was shocked when she saw the dead body of her daughter and fell unconscious. Later when she approached the Police of Rain Bazar, Hyderabad, surprisingly Dr. Sameena was sitting inside the chamber of Circle Inspector along with other hospital staff at Police Station, Rain Bazar. When she entered Police Station, they refrained from accepting a complaint against the Nursing Home and finally when she approached the police with the help of Media people, she was allowed to file a complaint before the SHO, Rain Bazar. The police registered crime No. 119 of 2020, dated 29-05-2020 U/ s 174 Cr. P.C. and sent the dead body for post mortem. Dr. Sameena blatantly said to her face that the post mortem report will not come out against her or her nursing home. Dr. Sameena might be influencing the authorities’ as till today no report has been provided to the police authorities or the investigating officer or me. The investigating officer has been casually diverting the case by stating that he could only conduct investigation after he received the post mortem report and mother said that, so far hospital costs may be around one lakh fifty thousand rupees, yet our child does not live.
Version of Dr. Sameen who is the in charge of Sameen Maternity and Nursing Home:
The team met with the Dr. Sameena. She told that mother of Mumtaz Begum came to the nursing home on 23-05-2020 with her daughter and said that her daughter continuously getting vomiting. We checked the patient and suggested that operation is must due to the hole she is sick and her life was in danger if the operation was not done immediately. Within two hours they have done operation, but unfortunately she lost her life. They stated that it was not their fault or not due to medical negligence and that it was only patient’s fault. She stated that in her home, there were four doctors and we know the everything how to deal with patients or patient. Dr. Sameena said
that Mumtaz Begum’s body was fully infected and due to the infection only she died. She stated that everyone would know only after seeing the post mortem report.
Version of Investigating officer, Police Station, Rain Bazar:
The team met the investigating officer Mr. G.Vinod Kumar, Sub-Inspector, Police
Station, Rain Bazar, Hyderabad and we were informed that case has been registered on
the complaint of deceased’s mother Rayeesa Begum under the Crime No. 119 of 2020 dated 29-05-2020. The dead body was sent for post mortem and that they were awaiting for report. He further stated that he would only further proceed when they receive the post-mortem report and further he said that they wrote the letter to the forensic department for report, but, till day no report reached police station.
Conclusions and findings:
There are a lot of contradictions and circumstances that place serious doubts on the versions of Dr. Sameena, Investigating Officer and the mother of deceased.
a. The patient’s medical records show that ‘ Simple left ovarian cyst’ and no discharge certificate or certificate of dead body. The nursing home people send dead body without filling any formalities perhaps the doctors of Sameena Nursing home wanted to avoid facing the questions from the parents of deceased Mumtaz Begum. This was a clear and absolute violation of medical protocol. This was much more than medical negligence. This was a death sentence under murder of girl child.
b. Dr. Sameena and the Sameena Maternity & Nursing Home did not follow the Supreme Court Guidelines like the proper record of the diagnosis, treatment, etc.
c. Dr. Sameena should not merely go by the version of the patient regarding her symptoms but should also make her own analysis including tests and investigations when necessary.
d. When the deceased’s mother approached the Police Station, Dr. Sameena was
already present in the chamber of Circle Inspector, Police Station, Rain Bazar, Hyderabad. They resisted Rayeesa Beguma from entering the Police Station. The police tried to dilute the subject and they succeed in doing the same.
e. That the police investigating officer didn’t make any serious attempt to investigate the charges of medical negligence or any other charges.They registered Crime No. 119 of 2020 U/s 174 Cr.P.C., FIR not against the Nursing Home.
f. The team enquired about the nursing home in the premises of that area of the hospital. The team heard shocking news from local people who are not ready to tell their names, but stated that every year 5 to 6 people die in the Nursing
home after admission. They all share similar stories of sorrow and state that the nursing home does lots of medical malpractices.
g. It is a clear case to initiate prosecution against Dr. Sameena and other staff of Sameena Maternity & Nursing Home, Talabkatta, Hyderabad U/s 302, 304-A, 338 IPC and under Section 20A of the Indian Medical Council Act, 1956, (Professional Conduct, Etiquette, and Ethics) and also the State Medical Councils
are empowered to take disciplinary action.
h. According to the team findings which we observed even paying DAMEGES to the deceased family Rs. 1 crore wouldn't be enough.
FFC DEMANDS:
1. Immediate action against the Dr. Sameena and Sameena Maternity & Nursing Home, Talabkatta, Hyderabad Authorities.
2. Proper enquiry with independent agency against Sameena Maternity & Nursing Home, Talabkatta, Hyderabad.
3. Crime No.119/2020 should be transferred to another police station by Appointing an investigate officer not less than DCP rank and who were Knowledge in medical Science along with honest medical opinion from Government Hospital by doing fresh post mortem.
4. Should arrange protection to the family of deceased from the Dr. Sameena and her henchmen and Sameena Maternity & Nursing Home, Talabkatta, Hyderabad Authorities, because the nursing home authorities are threatening the family Members of deceased to not to go anywhere for Justice.
FFC SUGGESTIONS: To regulate the private health sector, as per The Central government has been pushing for the implementation of the Clinical Establishments (Registration and Regulation) Act, 2010, or the CE Act, which seeks to regulate all clinical establishments in India and set treatment guidelines for common diseases and conditions. The States should also ratify this law and implement it, then only the BPL people will get good treatment from the hospitals.
