HEWA LOA what happened yesterday at the Kauaʻi Planning Commission hearing RE the former Coco Palms Hotel site, Wailuanuiahoʻāno?
We lost. We lost our Petition for Declaratory Order requesting they make a determination that the permit granted 8yrs ago had lapsed (ended), was not valid and they needed to reapply, to current code and environmental and cultural standards. **Background the permits were reissued via unconstitutional special legislation to allow it to be rebuilt based on the expired Iniki Ordinance (used to allow people to rebuild post storm). The abuse of this ordinance, 30 years later, based on 50 year old environmental and cultural assessment and laws.
This Petition request is based on the process and a Watanabe ruling that if there was no finding of substantial progress after a 2 year period, then the permits lapsed.
The developer plans to start construction in the coming few weeks to start the building of a 350+ room hotel on a royal cemetery and the historic, Queen Debra Kapule's, inland fishponds that are critical agricultural infrastructure for Kaua’i.
Important promises are already being broken. The developer never met with community, they are entirely focused on monetary profit, to max their return on this sacred Hawaiian cultural and environmentally sensitive, native wetland habitat. You can hear them say it for themselves in the arguments, it all about economics.
Another promise, the developers (accidentally) told us, they don't have intentions of removing a specifically agreed building they promised in Oct (the front wooden dangerous structure). The developers stated, clear as day, that building, being non compliant, wont be demo'd or they wont be able to rebuild it. Nor were they willing to consider working with existing setbacks and current development requirements.
We stand steadfast that any rebuild based on hotel permits from 50 year old cultural and environmental requirements, and the 30 year old Iniki Ordinance, is unjust, immoral, unacceptable and illegal.
Again, the developer plans to start construction in the coming few weeks to build a hotel. We don't know exactly where we go from here, but I know we aren't giving up.
