*UPDATE: Lawyers denied access to tunnelers despite HS2 pretense otherwise*
This afternoon, lawyers representing the tree protestors in the tunnels beneath Euston Square Gardens were admitted to the site with an elaborate display of pageantry, only to be refused permission to speak directly with their clients.
The team of three visited the site to take instructions from their clients at the entrance to the tunnel downshaft, as per the Order made in the High Court last night. They were met at the gate to the park, which is now surrounded on all sides with a high fence, by representatives of HS2 who had been expecting them.
There followed a carefully staged piece of theatre in which the legal team was provided with hard-hats before being admitted to the park, protective equipment which has thusfar been denied to those in the tunnels.
However, having been granted access to the site, the team was then prevented from actually speaking with their clients at the entrance to the tunnels' downshaft. Instead, they had to resort to speaking with them over the telephone, something which could have been achieved just as well from off-site.
HS2 also refused access to the legal team’s world renowned specialist tunneling extraction and rescue expert Mr Peter Faulding. The High Court Order requires HS2 consider carefully the opinion of Mr Faulding and their refusal to permit him access is contrary to the spirit of the Order, raising concerns about their avoidance of external scrutiny.
Paul Powlesland a barrister from Garden Court Chambers, one of the three lawyers who attended today, comments: "It is bizarre that HS2 should grant us access to the site only to deny us physical access to our clients. And that they should deny access altogether to one of the country’s leading protest tunnel safety experts, especially given his views and guidance have been specifically ordered by the High Court to be taken into careful consideration, is utterly perplexing. You have to wonder why HS2 are trying to restrict the protesters’ access to expert advice.”
