Participation in the Maiden PROF. SIS. ANNE OBIORA MOOT AND MOCK COMPETITION, held on the 14th Day of December, 2022. The competition was hosted by the Catholic Law Students Association Of Nigeria (COOU CHAPTER). The intiative performance was sumptuous and came out with an excellent result.

From the harshness and cruelty of this world
So many agonizing past experience
For a lad of his age

He cried bitterly in his young age
To him there was nothing to live for
In agony and torment from his soul
He suffers day and night

He carried his agonizing cross alone
For nobody was willing to lift that heavy burden
In a scrappy and scraggy manner he continues his journey
Hoping to meet his savior soon

WEEKLY LAW DIGEST

DID YOU KNOW THAT?

SEC. 1 of the CHILD'S RIGHT ACT, ART 4 OF THE AFRICAN CHARTER ON HUMAN AND PEOPLE'S RIGHT (ACHPR), AND ART. 3 OF THE CHILD'S RIGHT CONVENTION. astutely provides for the Best interest of a Child as a Right to be enjoyed by every Child.

The Best interest of a Child is of a Paramount importance as a Child has all rights to contribute on things that relates to his Life. A child as we all know is not a property to be owned by their parents. They're independent human beings with independent Rights as soon as they're given birth to. See the case of PATON V UNITED KINGDOM, RE:BABY BOY DOE.

The Child's Right act which provides for the Rights of a child of which the Right to the Best interest of Child is among has been declared as anti - cultural,anti - traditional and anti - Religious due to the celebrated notion that a child being a Minor has no rights. According to our African Culture,a child is only seen and not heard and this contradicts the Child's Right to Express views and be heard contained in ART 12 of the CHILD'S RIGHT CONVENTION
Our Children should be heard out and their contribution on things that will either directly or indirectly affect them should be taken. Parents should give their wards maximum support on things that wholely appeals to their Best interest. A denial of such Right is an offence under both our Municipal and international Laws and can attract punishment.

The Legal Nuggets Initiative is a community of creative idealists. It is a citadel of creative excellence. We believe in our creative capacity to recreate and offer profering solutions to the lingering state of the society. It is our majour objective - Transformation of obsolete ideologies and bad fate of the society with the aid of our intellectual skill and creativity.

The motto of our noble organization is Scientia Est Potentia - Knowledge is Power.
The power of creativity, that of transformation, of leadership, and of every art and science lies within the framework of knowledge. Being Nuggets Ideologists, we don't proclaim being professionals. It is our mission to keep on searching for the true knowledge and equip ourselves with relevant information.
Yearning for more knowledge is our utmost desire.

Welcome To the Legal Nuggets Initiative Forum⚖️⚖️⚖️.

What is Legal Nuggets about?

*Legal* means what is lawful, right and valid.

*Nugget* on the other hand means a resourceful and legit information.

Thus Legal Nuggets Initiative is the organization of resourceful researchers, creative ideologists, writers, and providers of legit legal information on various concepts of law.

What is our intended objectives?

Our intended objectives includes;
Firstly grooming of members creative skills and enlightenment programs.
Secondly is enlightenment programs and essay writings on conception of the law on societal affairs, providing you with the relevant case laws and legislations, and law articles that staves off your ignorance on law matters.
The next is we also create and assert ideologies, mainly our individual assumptions as regards to what should be a solution to the drilling and lingering situations in our citadel and society at large.

Our Roles/Functions And Services
1.) We provide you with a weekly digest on a particular concept of law.

2.) We write articles on the situational affairs of the society echoing our own voic. Articles covering law matters, politics, individual and societal philosophy cm religion.

3.) We organize debates and quiz competition to improve our intellectual skills.

4.) We organize seasonal symposiums, colloquium and train students on intellectual skills.

5.) We aspire to organize future webinars, seminars and conferences, inviting speakers to talk on public and law matters.

6.) We organize discussion forums on law and societal affairs, part of our debate stage.

7.) We provide you with fun and entertainment video content.

8.) We also train students on Public Speaking skills.

Our Challenges.
1.) We are yet to build a strong students forum, and we aim to achieve this, with you joining our platform.
2.) We are battling with pecuniary aid.

Monday: we have our physical gathering, by 12 - 2pm.
Routine weekly submission of articles, rotatively by our members on Saturdays.

Wednesday's weekly law digest as assigned to a member.

IS THERE STILL HOPE?

Is there still hope indeed?
Many things have gone wrong
Brutality and banditary is now rampant
Taping and assassination is at its apex
Killing of innocent citizens is now common.
Is there still hope?

Humanity is no longer a good virtue
Good vision is no longer in the picture
The quest for money is now the vision
Leaders are basking in the euphoria of evil
The economy wanders without direction.
Is there still hope?

Sympathy and conscience is now despised
The reward for labour is now neglected
Youths desire to pluck success
Yet no one wants to pay the price
Dissemination has brought scandal.
Is there still hope?

The hope for a new dawn is uncertain
As crimes have now been legalized
The assumption of no hope is now the faith
Oh! there is hope indeed
But greater sacrifice must be made.

WEEKLY LAW DIGEST

DO YOU KNOW...

THAT one of the class of persons considered not capacitious enough to contract are the ILLITERATES. However the law has not supplied any superlative definition of ILLITERATE but the courts have afforded to provide meaning to the term ILLITERATE.
Accordingly, the term ILLITERATE has been sumptuously defined in the case of NHACHAGWO v. AMODU, per CHARLES J, as a person who is unable to read with understanding and to express his thoughts by writing in the language used in the document made or prepared on his behalf.
So illiterate is thus purely relative, a graduate in English may well be an illiterate in German, therefore a person may be capable of signing his name and read figures, he may not be adequately literate to understand the meaning and effect of the document he is signing.
The Law seeks to protect this category of persons and two laws are particularly relevant in this regard, namely
1) The ILLITERATE PROTECTION LAW
2) THE LAND INSTRUMENT REGISTRATION LAW
These laws contains provision aimed at protecting illiterate in their contractual transactions.
SECTION 2 of ILLITERATE PROTECTION LAW lay down certain duties which the writer of any document made on behalf of an illiterate person must comply with & also SECTION 8 OF THE LAND INSTRUMENT REGISTRATION LAW lay down certain rules which must be followed by a person in a land contract with an illiterate person otherwise the contract can't be enforceable under the Law.
so being an illiterate is not a defect because the law protects illiterate persons in their daily contractual transactions.

Weekly Law digest

DO YOU KNOW THAT..
The law prohibits discrimination on the basis of disability and imposes sanctions including fines and prison sentences on those who contravene it. It also stipulates a five-year transitional period for modifying public buildings, structures, and automobiles to make them accessible and usable for people with disabilities. This is in accordance with the DISCRIMINATION AGAINST PERSONS WITH DISABILITIES (PROHIBITION) ACT,2018.
The law will also establish a national commission for Persons with disabilities, responsible for ensuring that people with disabilities have access to housing, education and healthcare.

THE CONSTITUTIONAL BASIS FOR APPOINTMENT OF THE RECENT ACTING CJN - HONOURABLE JUSTICE OLUKAYODE ARIOWOOLA JSC.
RECENT NEWS HINT: President Buhari swears in the (new) acting CJN - Hon. Justice Olukayode Ariowoola JSC.
In the recent news report Hon. Justice Ariowoola, the most senior justice of the supreme court, has been sworned in by President Buhari, as the acting CJN, following the resignation of his predecessor, Hon. Justice Tanko Muhammad - the former CJN, who stepped down from the office of CJN citing ill health as the grounds for his resignation.

WHAT THEN IS THE CONSTITUTIONAL PROVISION FOR THE APPOINTMENT OF THE ACTING CJN.
It is notable in section 231(1)
"That the Appointment of a person to the office of chief justice of Nigeria shall be made by the president on the recommendation of the National judicial council subject to confirmation of such appointment by the Senate."
Whereas in SECTION 231 (2)
The constitution also provided for the appointment of a person to the office of a justice of the supreme court in the same manner as provided in SECTION 231 (1)
However in relation to this context, pursuant to sub section (4) of the same section (S. 231), also provided that on the vacancy of the office of CJN (in this context resignation), the president shall appoint the most senior justice of the supreme court to perform the functions, of the chief justice of Supreme court. Thus SECTION 231(4)
Provides that;
"if the office of the CJN is vacant or if the person holding the office is for any reason unable to perform the functions of the office, then until a person has been appointed to and has assumed the functions of that office, or until the person holding the office has resumed those function, the president shall appoint the most senior justice of the supreme court to perform those functions."
Thus with regard to provisions of subsection (4) Hon. Justice Olukayode being the most senior justice of Supreme court is eligible to become the next acting CJN.
it must also be noted that in the provisions of sub section (5), of the same section (S.231), the tenure of the acting CJN shall expire three months from the date of his appointment. SECTION 231 (5)
Provided thus;
"Except on the recommendation of the national judicial council, an appointment pursuant to the provisions of subsection (4) of this section shall cease to have effect after the expiration of three months from the date of such appointment, and the president shall not re-appoint a person whose appointment has lapsed."
Conclusively, it is note worthy that the appointment of Hon. Justice Olukayode Ariowoola, as the acting CJN is constitutional with regards to provisions of SECTION 231 OF C. F. R. N 1999 (as amended), also that his appointment tenure will elapse three months on the date of his appointment, pursuant to the provisions of the constitution.

Like stray sheep on a journey to it's owner
Focus indeed we have lost

Suffering and anguish has become our robe
Struggling to make it to the top
Servants we have become to Money
Willing to cross boundaries for our master

Must we aimlessly continue to wander
For things that doesn't bring peace
Peace and joy keeps smiling at us
Must we choose to wander aimlessly

Live in peace while the opportunity abound
Seek peace and joy
Money is our servant and not our Master
Be warned so you won't REST IN PEACE ‼️
