Mr. Speaker, my esteemed colleagues in the House of Representatives, magandang hapon po sa inyong lahat. This representation rises this today on a matter of personal privilege.
Mr. Speaker, mga kasama ko po dito sa Kamara, mga kababayan; TALPAKAN NA!!
Ang ibig sabihin ng salitang TALPAKAN ay laban sa sabong ng manok. Now, just to be clear, when I speak of cockfighting of sabong, I am no talking about the 2022 elections––malayo pa po ito, Mr. Speaker, although mukhang nagsisimula na ang galawan para sa eleksyon.
What I am referring to, Mr. Speaker, is online cockfighting, or online sabong. Patok na patok po ngayon ang online sabong. Kahit saang lugar ng Pilipinas ka pumunta ay puede kang magpa load at tumaya sa e-sabong online gamit ang cellphone o anumang gadget mo.
Ang online sabong ay LIVE na palabas ng actual na sabong ng manok. Online lamang ang pagtaya at digital ang pera na gamit. Pero manok sa manok pa din ang laban.
Ano po ang sabi ng ating batas ukol sa sabong? What law covers cockfighting? Ang Presidential Decree 449 o Cockfighting Law of 1974, Mr. Speaker, ang nag-iisang batas tungkol sa sabong sa Pilipinas. Sinasabi po nito sa Section 5(d): “…cockfighting shall be allowed only in licensed cockpits during Sundays and legal holidays and during local fiestas for not more than three days.”
Batas po ito Mr. Speaker. Nakalagay sa batas na puede lamang ang sabong sa mga lisensyadong sabungan at pag linggo o holidays at fiestas lamang. LIMITADO lang ang sabong ayon sa batas. There are clear guidelines, clear parameters that regulate cockfighting.
Sa ilalim din ng Section 6 ng PD 449: “City and municipal mayors are authorized to issue licenses for the operation and maintenance of cockpits..”
Ibig sabihin Mr. Speaker, sa ilalim ng batas, local government units lamang ang may kapangyarihan na magbigay ng lisensya sa mga sabungan at sabong sa Pilipinas.
Batas po ito, Mr. Speaker. Sa pagkakaintindi ko, batas lamang din ang puedeng magbago ng naunang batas. At tayo sa Kongreso ang dapat gumagawa ng batas na yan, kung di po ako nagkakamali.
Pero sa kasalukuyan Mr. Speaker, ang PHILIPPINE AMUSEMENT AND GAMING CORPORATION (PAGCOR) ay nagbigay ng lisensya sa tatlong kumpanya para mag operate ng Online Sabong o e-Sabong sa Pilipinas. Ayon sa website ng PAGCOR, ito ay ang mga sumusunod:
1. Belvedere Vista Corporation (Sabong Express)
2. Lucky 8 Star Quest Inc. (Pitmasters Live)
3. E-Sports Encuentro Live Corporation (Encuentro Live)
Bagamat tatlo lang ang may lisensya galing PAGCOR, sa kasalukuyan ay may PITONG websites na ang online sabong sa ating bansa. I repeat: while the PAGCOR website lists THREE companies allowed to operate online cockfighting, there are SEVEN online cockfighting websites.
Alam po ba ninyo na araw-araw ngayon ang sabong sa mga websites na ito? ARAW-ARAW ang sabong ngayon sa Pilipinas. Ang masakit pa nito, kahit mahal na araw o Holy Week––kahit BIERNES SANTO SAGRADO; kahit ngayong pandemic; kahit bawal ang sabong dahil sa ECQ o MECQ o GCQ––TULOY PA DIN ANG ONLINE SABONG.
Sa bawat website may average na 350 sultada o laban ng manok sa isang araw. Ibig sabihin, sa isang araw ay merong hindi bababa sa 700 katao na nasa lugar kung saan ginaganap ang sabong na ito na pinapalabas ng live sa online. Hindi pa kasama dyan ang mga organizer, sentenciador, kristo, taga tari at mga taga linis ng lugar. LIVE po yan. Araw-araw. Nakalagay naman kung saang lugar sila nagtitipon. ANG TANONG: BAKIT WALANG HUMUHULI SA KANILA DAHIL SA PAGLABAG SA QUARANTINE RESTRICTIONS???
Alam din po ba ninyo na hindi kumukuha ng permit sa mga lokal na pamahalaan ang mga online sabong operators na ito? Eh sa ilalim ng PD 449 malinaw po na dapat sa mga LGUs sila kumukuha ng prangkisa. Let me repeat the text of Section 6: “City and municipal mayors are authorized to issue licenses for the operation and maintenance of cockpits..”
Kaya nais kong malaman kung sino ang nag payo sa PAGCOR na may kapangyarihan silang mag bigay ng lisensya sa online sabong? Gusto ko rin malaman, anong batas ang pinag batayan nila ng kapangyarihan na ito Mr. Speaker?
Mga kasama, yung JUETENG po ay pinahuhuli natin dahil ito po ay ILLEGAL. Piso-piso lang ang pusta sa jueteng. Tatlong bola lang sa isang araw ang Jueteng.
Pero dito po sa online sabong, sa isang araw ay may average na 350 sultada o laban ng manok sa isang araw. Kaya puede kang tumaya ng 350 times sa isang araw. Ang minimum bet dito ay 100 pesos kaya malaking pera po ang umiikot dito.
Alam po ba ninyo na ang pinaka mahinang pustahan sa kada isang sultada ay 5 million pesos. Ang isang sultada ay tumatagal lamang ng average na limang minuto; kaya may 12 sultada sa isang oras at may gross bets na 60 MILLION PESOS KADA ORAS. I repeat: 60 million pesos per hour. An average of one million pesos per minute, Mr. Speaker.
Sa isang araw, may sampung oras na tuloy-tuloy ang online sabong – kaya ang gross bets per day ay 600 million pesos. Yan ay sa isang licensed operator lamang. Kung tatlo ang kasalukuyang may lisensya, and we do the math, 600 million multiplied by three is 1.2 BILLION PESOS IN GROSS BETS PER DAY. Isipin po ninyo yan: 1.2 billion pesos na pusta kada araw.
Mr. Speaker, dahil online o digital currency ang gamit sa pagpusta sa online sabong, madami ang nalululong sa bisyong ito dahil isang pindot lang ang pagtaya. Ang masakit dito, kahit menor de edad ay nakakataya sa online sabong dahil hindi naman nakikita ng operators o ng PAGCOR kung sino sino ang tumataya. Because anyone with a cellular phone can place a bet. Our children; our grandchildren––kahit sino, Mr. Speaker!
Dahil sa mga isyu tulad nito, tingin ko po na panahon na Mr. Speaker para magpatawag tayo ng isang INVESTIGATION IN AID OF LEGISLATION upang malaman natin kung kailangan na nating amyendahan o palitan ng tuluyan ang PD 449. If cockfighting has evolved because of technology, then the law that regulates it must evolve and adapt as well.
Bukod po sa online sabong, kailangan na rin natin tingnan ang Online Bingo o E-Bingo at iba pang uri ng online betting o VIRTUAL CASINOS.
The very nature of Internet gambling makes regulation extremely challenging, if not close to impossible. Bets are electronic transactions in which no physical good or commodity need be transferred between the gambler and the operator.
The only possible means of effective regulation is through the platform by which the gambler and the operator interface––namely, through the Internet service provider, or ISP, or the payment system provider.
Sa kasalukuyan, ginagamit ngayon na pang load at pang kuha ng taya ang mga digital payment systems tulad ng GCASH, PAYMAYA, at PAYPAL. This representation submits that we need to review current legislation on digital payment systems to ensure that they are not being used for illegal purposes.
Mr. Speaker, ang nakakatakot dito ay baka sa darating na halalan, ang vote buying ay maging digital na din. Dahil nakita na ng mga tao ang gamit ng digital payment systems sa internet gambling, hindi malayong gamitin din ito para sa vote buying.
I believe that legislation represents a measured and appropriate response to a demonstrated social evil that grows worse by the day. I describe Internet gambling as an “evil,” and I do not use that word lightly. The dangers of gambling are manifest, and that is why gambling is so heavily regulated in our country.
For all of its benefits, the Internet has a dark side; it makes gambling accessible to those who are most susceptible to the addictive power of gambling: the young, the weak, the poor, and the uneducated. The Internet offers ease of access and anonymity, and we should be concerned because our children are the most computer-literate segment of our society and can find these sites with ease. Unfortunately, they are also the most vulnerable to gambling's addictive powers.
Madami nang nabalita na mag-asawang naghiwalay dahil na addict sa talpakan o online sabong ang asawa. May mga seaman at OFWs na nagpakamatay dahil na addict sa online sabong at naubos ang naipon––walang maiuwi sa pamilya. Science has revealed that gambling is not a harmless vice or a victimless crime. According to scientific studies of the US National Academy of Sciences, “pathological gamblers engage in destructive behaviors: they commit crimes, they run up large debts, they damage relationships with family and friends, and they kill themselves.”
If online gambling such as e-sabong and e-bingo continue unregulated, these social evils will slowly creep into our homes and infect our family members like a new virus––a virus for which there is no vaccine.
Mr. Speaker, history has shown us that evil triumphs when good men stand by in its midst and refuse to act. Let us do something, because we are in a position to do so; let us take action now, before this evil festers and grows; and let us protect our families, protect our children, from the online pandemic of internet gambling.
