This is Nigeria government disgracing themselves.

1) Lower Court earlier Struck off 8 of the 13 amended terrorism related charges against Kanu.

2) At Appealed court, Kanu’s Lawyers pressed court to strike out the entire case as Kanu will not stand trial on a case where it happened remains a secret.

3) Kanu’s lawyer, Mike Ozekhome asked court to determine if the extraordinary rendition of Kanu followed international process?

4) Nigerian lawyer, D Kaswe argued the court to dismiss the appeal as Kanu was returned (kidnapped) to Nigeria through due process.

5) The panel (Judges) agreed with Kanu’s lawyer that where jurisdiction is raised, it is important to deal with it first as it will affect the entire case later.

6) The panel said “It is clear that where a court lacks jurisdiction to determine a matter, every other thing it does will amount to a nullity.

7) The panel added thst the FG remained silent on the allegation that Kanu was abducted from Kenya.
“I thus agree with Ozekhome”, and FG’s refusal to state where Kanu was extradited means it is “deemed conceded by the FGN.”

8] The panel quoting the United Nations Convention, that an Extradition request shall be in writing and accompanied by a warrant of arrest to the host territory where a suspect is domiciled.

9) The judges stated that it is clear thatFGN having removed Kanu from a country without trial constitutes a fundamental violation of his right,” and that Kanu can only be returned from another country after being subjected to judicial process in the host territory.

10) The Appeal court faulted the lower court, stating that the warrant of arrest only applies within Nigeria but extraordinary rendition without formal trial in a transferring country is an error.

11) Panel added that there is a duty for Nigeria to conform with international laws and legal framework.

RULING.

12) Nnamdi Kanu’s extradition by the federal government of Nigeria clearly violated international laws which it was bound to obey.

13) Since law enforcement cannot show how and where Kanu was extradited from, the whole proceeding is tainted.

14) The actions of the Nigerian government amounts to “executive recklessness”.

15) The appellate court ruled that the lower court failed to look at the facts of Nnamdi Kanu’s extradition.

16) I hold that the respondent is restrained from holding Kanu in detention as the lower court has no jurisdiction to try Kanu on the remaining charges.

17) NNAMDI Kanu’s appeal succeeds. Justice Nyako’s decision to go ahead with the trial, against Kanu are set aside and the defendant is discharged.

The three-man panel was led by Justice Jummai Hannatu, from Gombe Division.

UPDATE ON OUR ABORTED ROUTINE VISIT TO OUR INDEFATIGABLE CLIENT - ONYENDU MAZI NNAMDI KANU BY THE LAWLESS DEPARTMENT OF STATE SERVICES (DSS) AT THEIR ABUJA HEADQUARTERS:

Consistent with our routine, we were at the DSS Headquarters today, to observe the Court-Ordered visit to our dear Client - Onyendu Mazi Nnamdi Kanu. But, for the second time since after the last court sitting, we were bluntly denied access to our Client by the personnel of the DSS.

This development is appalling and condemnable because there was no plausible reason(s) proffered for this violent affront to a Court Order.

Recall that the Order made by His Lordship, Hon. Justice Binta Nyako guiding our routine visits to our Client - Onyendu Mazi Nnamdi Kanu, is unequivocal and clear that these visits should be conducted on Mondays and Thursdays between the hours of 2:00PM and 4:00PM.

During our visit to Onyendu last week Thursday, being the 17th day of February 2022, in observance of this Court sanctioned visit, the personnel of the DSS turned us back, insisting that the officials assigned to receive us were not available.

The same flimsy reason was given today, 21st February 2022, for denying us access to Onyendu, in deliberate and flagrant disobedience to Court Orders.

With the foregoing, if the Chief Registrar of the Federal High Court Abuja, fails and/or refuses to endorse the relevant contempt forms filed against the Director General of the DSS for the gross disobedience to positive Orders of Court, as he has done in the past, then, it will become obvious to the world that the Registrar of the Federal High Court Abuja, is actively protecting the contemnors.

Orders of Court must be obeyed to the letter and must not only be respected, but must be treated with sanctity. Sadly, this has become a joke taken too far!

We therefore, wish to use this medium to place the World on Notice that the DSS should be held responsible should anything untoward happen to our Client - Onyendu Mazi Nnamdi Kanu during this period they are hoarding him from us.

We shall continue to keep the World abreast of every unfolding events as the DSS continue to thread on this ignominious path.

UPDATE ON OUR ROUTINE VISIT TO OUR INDEFATIGABLE CLIENT - ONYENDU MAZI NNAMDI KANU AT THE HEADQUARTERS OF THE DEPARTMENT OF STATE SERVICES (DSS) ABUJA, TODAY BEING THE 27TH DAY OF JANUARY 2022:

Our visit to our indefatigable Client - Onyendu Mazi Nnamdi Kanu today, remains positive as our legal strategies were discussed, and he is in firm spirit.

Onyendu Mazi Nnamdi Kanu deeply appeals to UmuChineke to avail themselves of the peace initiative presently ongoing and not to be distracted anymore. He further implored all UMUCHINEKE to keep their eyes on the ball because enemies are struggling in vain to entrench disharmony.

Onyendu reiterates that the ongoing interventions towards peaceful coexistence must be respected, encouraged and abided by. His call for unity among the entire UmuChineke at all levels, who believe in his peaceful message cannot be overemphasised.

Further, Onyendu extends his warm regards to millions of his fans and followers who have equally remained consistently resolute and focused. He is convinced that the present situation will only last a while and he will emerge victorious.

He also used the opportunity to offer special prayers for me in commemoration of my birthday, as he believed most strongly that the future is crystal bright and holds much good tidings .

Consistent with our usual request, we crave for your unrelentless prayers and supplications to the Almighty Chukwuokike Abiama.

ONYENDU MAZI NNAMDI KANU NEVER DENIED BEING THE LEADER OF IPOB - LET THE RECORDS BE SET STRAIGHT:

Greetings UmuChineke,

Our attention has been drawn to the deliberate misrepresentation/falsehood and wrong narratives being perpetuated by some mischief makers, and which is unfortunately gradually gaining prominence on social media platforms and print media. Hence, it is pertinent that we provide clarification and clear the doubt.

S.M. Labaran Esq., who stood in yesterday for the Director of Public Prosecution of the Federation is a colleague I hold in high esteem, but I shall resist every mischievous ploy being adopted to misinform the unsuspecting members of the public who were not privy to the details of the proceedings in court yesterday, with a wrong and mischievous interpretation of the purport of the Plea taken by our indefatigable Client - Onyendu Mazi Nnamdi Kanu.

For the records, Onyendu Mazi Nnamdi Kanu never denied being the Leader of the Indigenous People of Biafra (IPOB) while taking his plea, but only STOUTLY DENIED THE FACT THAT IPOB IS A TERRORIST ORGANISATION AND THAT BEING ITS LEADER IS AN OFFENCE, which position is well informed.

Members of the Public should be well guided that the status of the black market order proscribing IPOB is a subject of Appeal in Appeal Number: APPEAL NO. CA/A/214/2018, pending before the Court of Appeal, Abuja Division.

That being said, it is only laughable that the Federal Government of Nigeria (FGN) in their desperate but futile attempt to give a dog a bad name in order to hang it, brought a charge bordering on the status of IPOB, a subject matter of a competent Appeal, where issues has been joined with the same FGN.

Therefore, be properly guided UmuChineke, because we have sufficiently addressed the emptiness of that count and entire charge in our compelling Submissions before the Court, now adjourned to be heard on the 16th day of February, 2022.

We do not wish to dwell further on this subject, but be rightly informed that Onyendu Mazi Nnamdi Kanu never denied being the Leader of IPOB while taking his Plea yesterday.

When I watch how people talk s**t about you.

When i see how angry people get because of the civil disobedience put in place to hacken your release.

When I see how evil people heart is even people who claim that they are with you.

I ask myself why can't you take the offer given to you by the zoo and let us all suffer this together, since some do not value your efforts.

But you said no to that, you believed that if it's only one person who believes in you, that you will fight to make that person to see the light.

You said that you rather die than to back down, you said that you can't feel joy to be at a place enjoying life while people suffer.

I pray that God gives you strength to carry out this task, it's a rough journey, but you will conquer.
