Business community offers solution to Americans With Disability Act complaints that allow disable access without damaging or bankrupting businesses.

When a business owner is notified of an ADA infraction, allow for a time period to correct it before being fined if not corrected.

California voters value education and the benefits it provides to our children, our future. That’s why voters in 1988 approve Proposition 98 which amended the California Constitution to mandate a minimum level of 39 percent of the state’s budget be directed towards education.

Today, California spends $23,000 per student in California from Kindergarten to 12th grade.

Attorney Kevin Shenkman, a transplant from Detroit to Malibu, is making a fortune by suing California cities that have not changed from at-large elections to by-area elections.

This change means voters select their representative in a defined area and the elected must live in that same area. California Voting Rights Act of 2001 allows Shenkman to collect more than $30,000 for each letter he files.

Going to trial means big money.

The City of Palmdale paid a $4.6-million award after an eight day trial. National Demographics Corp. President Douglas Johnson said Shenkman overwhelmingly leads in these kinds of filings and estimates he has filed hundreds of letters to voting districts.

Shenkman concedes this could be true.

The act’s good intentions to increase minority representation has made it worse. Johnson said some cities do not lend themselves to districts where they don’t have enough minority voters in a given geographic location or not enough candidates to cover each district, forcing city councils to appoint someone to serve.

This is contrary to the act’s spirit and mission. By-area elections favor the incumbent because it usually takes two or three tries to be elected. It forces the candidate to wait four years to run again which means a candidate loses interest and/or campaign team. The public forgets the candidate and message.

The act that wants to increase minority representation can exclude good minority candidates from running due to lack of available seats to win.

Medium to small cities under 300,000 population can be campaigned effectively if its team is organized and motivated.

By-area district elections are needed in large cities like Los Angeles. A solution which allows minority representation in government while not harming medium to small cities to find good candidates is to amend the law to read:

“Any city under a population of 300,000 is an at-large election unless the voters decide to have elections by-area.”

CVUSD Forced to Exclude Minorities from Elected Office - Unintended Consequences of Government Policy

California Voting Rights Act of 2001 intention was to increase minority representation in elected office but it has made the situation worse for minority candidates running for office.

The Act forces medium to small population cities to move from At-Large to By-Area elections.

Malibu attorney Kevin Shenkman, is using the Act forcing cities to move to By-Area elections has become very wealthy. For every letter filed, he is paid $30,000.

The Act's good intentions to increase minority representation has made it worse according to National Demographic Corporation President, Douglas Johnson because medium and small cities broken into districts don't have enough minority voters or not enough candidates to cover each district forcing city councils to appoint someone to serve - contrary to the Act's spirt and mission.

An area may have five quality minority candidates with only one elected position. Result is four are not able to serve in a By-Area election. If it is an At-Large election all five could possibly serve.

SOLUTION: Amend the Act to read "any city under a population of 300,000 is an At-Large election unless the voters decide to have elections By-Area."

Until this change, takes place, minorities are excluded from elected office in medium to small size cities.
