Since April 2018, this appeal has lingered before the Abuja Division of the Court of the Appellate Court, a protracted journey that highlights deeper concerns about the legal system's integrity and the right to a fair trial. This article delves into the circumstances surrounding the IPOB's proscription and the subsequent appeal, shedding light on the reasons for the delay and the implications it carries for justice and accountability.

At the heart of the controversy lies the proscription of IPOB as a terrorist organization by the Federal Government of Nigeria. This classification, met with staunch opposition and skepticism, has ignited debates about the legality and justification of such a label. The government's assertion that IPOB is a terrorist group has far-reaching consequences, impacting the lives of its members and their activities. However, the proscription has faced criticism for lacking a solid legal foundation, raising questions about the motivations behind the apparently dramatic move.

The appeal against the proscription, lodged since April 2018, has encountered an unreasonable and prolonged delay that has drawn attention and raised concerns about the integrity of the judicial process. The rolling adjournment of the appeal has been described as both unreasonable and wicked, suggesting a pattern that inhibits the timely administration of justice. The implications of this delay are far-reaching, as justice delayed is often perceived as justice denied. The apparent reluctance of the Federal Government to engage in the appeal process further exacerbates suspicions of political motivations behind the proscription.

The refusal of the Federal Government to actively participate in the appeal process speaks volumes about the strength of their case against IPOB. A government that obtained a proscription through legal channels should ideally demonstrate the confidence to defend its decision in a court of law. The evasion of accountability by avoiding the appeal proceedings creates an atmosphere of uncertainty and distrust. This raises questions about the legitimacy of the initial proscription and the extent to which it was influenced by political considerations, rather than genuine concerns for national security.

Amidst the haze of adjournments and evasions, a powerful call for accountability emerges. The protracted appeal not only highlights the broader issues of delay within the legal system but also exposes the need for transparency in governance. The powers that be are now faced with a dilemma – to either prosecute the appeal at the Supreme Court, thereby subjecting their decision to judicial scrutiny, or to consider releasing Nnamdi Kanu, leader of the IPOB, if they cannot justify their actions. The call for accountability extends beyond the legal realm, encompassing the principles of justice, fairness, and respect for human rights.

The case of IPOB's proscription and the subsequent appeal resonates with the broader themes of justice and democracy. The delay in the appeal process undermines the very essence of justice, eroding public trust in the legal system. In a democracy, the protection of citizens' rights is paramount, and the right to a fair trial is a cornerstone. The situation begs the question: What does it signify when the government, the very institution responsible for upholding the law, is perceived to be avoiding the scrutiny of the court? The answer reverberates through the corridors of justice and raises concerns about the state of democracy and governance.

UPDATE ON OUR ROUTINE VISIT TO OUR INDEFATIGABLE CLIENT – Onyendu MAZI NNAMDI KANU, AT THE HEADQUARTERS OF THE STATE SECURITY SERVICES (SSS), ABUJA, WHERE HE IS STILL BEING ILLEGALLY AND UNCONSTITUTIONALLY DETAINED IN SOLITARY CONFINEMENT:

We visited our indefatigable Client – Onyendu Mazi Nnamdi Kanu, today, the 4th day of September 2023, to apprise him on the status of the various pending Committal proceedings initiated against the Director of the SSS for flouting Court Orders, and steps being taken by our erudite Lead Counsel – Prof. Mike Ozekhome, SAN to secure an imminent date for the Hearing of the Supreme Court Appeal.

As you are aware, the Judgment of the Federal High Court delivered on the 20th day of July 2023, by His Lordship, Hon. Justice Binta Nyako, directed the SSS to among others, avail Onyendu Mazi Nnamdi Kanu of his full medical records from 29th June, 2021 till date. Although Onyendu has been examined by medical doctors of his choice outside the facility of the SSS, his medical records with the SSS in-house medical doctors are yet to be released to him, to enable his choice medical doctors make a holistic informed recommendation on his further prescriptions, and plausible medical solution(s).

Our last check on the extant Act of the National Assembly that created the institution of the State Security Services (SSS) revealed that no Section of the Law provided for the institution (SSS) to be ABOVE THE LAW. Intrinsically, the SSS is under bounding obligation to obey the Orders and Judgment of the Court.

The SSS is not in a position to handpick Orders and Judgment of the Court of Law to obey and those to flout with impunity. Otherwise, why was the SSS quick to remand Onyendu in their custody on the 29th day of June 2021, upon an Order granted by the same Judge, who has now directed them to avail Onyendu of his medical records, and they have failed to comply with the later order?

Recently, the personnel of the SSS have extended their acts of lawlessness by denying Onyendu access to visitors of his choice, in clear violation of a subsisting Court Order. However, our erudite Lead Counsel – Prof. Mike Ozekhome, SAN has swung into action by commencing contempt proceedings against the Director General of the SSS to demand immediate compliance with all the Court Orders that the SSS is currently violating with impunity.

Onyendu seized the opportunity offered by the visit to commend the efforts of Ezigbo UmuChineke once again, including the groups who are calling on the Federal Government to obey the Judgment of her own Court and release him unconditionally, or better still, prevail on the Supreme Court of Nigeria to set down the Appeal for Hearing so that these shenanigans will cease.
Also, Onyendu applauded the courage of the House of Representatives Committee in directing the Federal Government to release him unconditionally in line with the Judgment of the Court of Appeal. He appreciated the Chairman of the House of Rep Ad-hoc Committee on Security (Hon. Obi Aguocha) for being outspoken in this regard.

Efforts are currently underway by our erudite Lead Counsel – Prof. Mike Ozekhome, SAN to secure an imminent date for the Hearing of the Appeal at the Supreme Court following the cancelation of the earlier scheduled date of 14th September, 2023. We shall formally communicate Ezigbo UmuChineke and indeed, members of the public once a new date is secured.

UPDATE ON ROUTINE VISIT TO OUR INDEFATIGABLE CLIENT – ONYENDU MAZI NNAMDI KANU, AT THE HEADQUARTERS OF THE STATE SECURITY SERVICE (SSS), ABUJA, WHERE HE IS STILL BEING ILLEGALLY AND UNCONSTITUTIONALLY DETAINED IN SOLITARY CONFINEMENT:

Onyendu Mazi Nnamdi Kanu was today visited by the duo of His Majesty, Eze Chukwuemeka Eri, Eze Akajiovo Igbo Nile, Ezeora ###IV of Aguleri, and Distinguished Senator Ifeanyi Uba, at the facility of the State Security Service (SSS) Headquarters Abuja where Onyendu is still currently being held in solitary confinement.

The visit was unprecedented, as fruitful and productive discussions were exclusively held with Onyendu. During this visit, Onyendu reiterated his firm and unequivocal condemnation, and total cancellation of the senseless sit-at-home in the South-East, hitherto enforced in the entire South-East states by the enemies of our people.

Other crucial messages conveyed to them by Onyendu will be made public as given by Onyendu in due course.

Be assured UmuChineke that we are speedily approaching the end of the tunnel. ChukwuOkike Abiama is always on the throne, and this trying period will soon become history.
