SC issues notice to Centre, EC on reduction of disqualification period of Sikkim CM.

New Delhi, Mar 21 (PTI) The Supreme Court Monday sought responses from the Centre and the Election Commission on a plea challenging the poll panel’s decision to reduce the 6-year disqualification period of Sikkim Chief Minister Prem Singh Tamang, convicted and sentenced in a graft case, to 13 months.

A bench comprising Chief Justice N V Ramana and Justice Krishna Murari also issued notices to the Chief Minister and the secretary of the state’s Governor on the plea filed by J B Darnal, the vice president of Sikkim Democratic Front.

Senior advocate Mukul Rohatgi appeared on behalf of the Chief Minister on caveat when the plea was argued by the counsel for Darnal challenging the decision of the poll panel.

Rohatgi pointed out to the bench that the same issue has been raised before a pending case in the Delhi High Court.

“Why have you chosen so many forums you will have to explain? Some legal issues are there. Because of that we are issuing the notice,” the bench said and listed the plea for further hearing after six weeks.

The present plea was mentioned for urgent hearing before the CJI’s bench on March 10.

The Delhi High Court, in October 22, 2019, had issued notices to the Centre and others on a separate plea against the Sikkim chief minister.

Tamang, whose Sikkim Krantikari Morcha party won the state Assembly elections in April, 2019, took over as chief minister on May 27.

However, he could not contest the elections due to his disqualification.

He was required to contest Assembly elections within six months of becoming the Chief Minister to continue to hold the office.

He was convicted and sentenced to one year imprisonment for offences under the Prevention of Corruption Act on December 26, 2016. He completed the one year sentence on August 10, 2018.

The petition in the high court was filed by one Dek Bahadur Katwal, General Secretary of Sikkim Democratic Front.

The pleas, alleged that Section 11 of the RP Act, 1951 is unconstitutional as it provides “uncanalised / uncontrolled / arbitrary” power to the poll panel to remove or reduce the disqualification period.

The corruption case pertained to Tamang’s tenure as State Animal Husbandry Minister, when he was accused of misappropriating funds of Rs 9.5 lakh in the procurement of cows in 1996-97. PTI SJK SA

PRESS RELEASE
The Sikkim Democratic Front Party (SDF) is based on the principles of democracy laid down by the Constitution of India. The overall functioning of the SDF Party and its members is governed by the Constitution of the Sikkim Democratic Front Party.
Article 10 of the Constitution of Sikkim Democratic Front Party involves the subject on the termination of membership. Article 10 (b) states that “Any member can resign from the Party membership by giving the President a 30 days’ prior notice in writing to make his intention known” and Article 10 (c) states that “Those who fails to pay the membership fees for consecutive 2 years will automatically lose their membership of the Party”.
On 24th January, 2022 about 43 (Forty Three) persons from various districts of Sikkim had submitted their resignation letters in the Head Office of the SDF Party. On verification of those applications, it is found that only 7 (Seven) of the applicants were and had been members of the Sikkim Democratic Front Party. The remaining persons who had tendered their resignations on that day were/are not members of the SDF Party based on the official records and rather it was found that many of them are, actually, affiliated to the SKM Party. Therefore, their applications for resignation were, accordingly, not received and accepted by the SDF Party.
As far as the applications submitted by the 7 (Seven) persons namely, Ganesh K. Rai, Sonam Gyatso Lepcha, Dawcho Lepcha, Jiwan Limboo, Nima Lhamu Bhutia, Jigmee W. Bhutia and Sonam Lepcha are concerned they were then the existing members of the Party.
However, on the day of the resignation itself, i.e. 24th January, 2022, the said members, whose resignation letters were received, held a Press Conference in Gangtok, declaring them of having resigned from the SDF Party and expressing their intentions of forming a new political Party. They also expressed their dissatisfaction with the functioning and ideology of the Party in the said Press Conference. It is found that such expressions, acts and activities of the said persons directly involves anti-Party activities and guilty for serious breach of discipline as per the provisions of the Party Constitution.
Therefore, in view of the Article 10 (b) & (c) and other relevant provisions of the Constitution of the Party, the membership of the above mentioned persons hereby stands terminated with immediate effect. Furthermore, the Orders which have been issued by the SDF Party to the said members also stand as withdrawn/cancelled.

Dr. Sanjay Upreti residence of Daragoan Tadong under 25 Upper Tadong Constituency passed away around 3 am this morning. He succumbed to multi organ failure. Earlier his left leg had been amputated.

Doctor Sanjay Upreti was victim of a knife attack at New STNM hospital when he tried to save female attendant Kala Chettri. Both had been flown to Neotia hospital in Siliguri for specialist care but he could not survive the grevious injuries.

His remains will be brought back to Sikkim today.

Wishing peace, comfort, courage, and lots of love at this time of sorrow to his family. Our heart goes out to all the family members at this difficult time. All family of Late. Dr. Sanjay Upreti are in our heart and mind. Our heartfelt condolences on the passing of Dr. Sanjay Upreti. May he Rest in Peace.

HELP SOUGHT

Ayush Rai, a five-year-old boy, is struggling to live a normal life since birth due to various health problems. He cannot move his hands and feet, and is also unable to speak.
His parents have a weak financial status and as such, cannot take their child for treatment to a special hospital. Doctors have advised that Ayush is taken to Vallore for treatment but that is beyond the financial capacity of his parents. The poor parents have appealed the people to contribute and help to save their child.
