PORT ORANGE, FL – Recently uncovered emails between Port Orange Police and State Prosecutors have raised concerns over law enforcement conducting "fishing expeditions" during traffic stops under the guise of cannabis enforcement by a newly promoted cop. Otherwise known as a Fourth Amendment Violation or unlawful search in the eyes of the law, he has remained at the department. In addition, despite being admonished by State's Attorney Christpher Walker in an email citing "nothing illegal was afoot" when he conducted a traffic stop for "dark tint", Michael Guillerm has now been promoted to a position of sergeant, supervising younger officers.

In addition to this email string, a recently uncovered document showed that supervisors accused Guillerm of an unlawful search on other occasions in 2020. Those allegations were brought forth by Officer Thedore Kurtz and spells out an incident where Officer Guillerm conducted a traffic stop for a car going over the stop bar at a traffic light at 2:30am. In documets obtained, a direct quote from the supervisor is as follows:

The traffic stop itself took over an hour and a half for a relatively simple traffic stop. I also observed no case number at all was pulled by the officers on-scene and I eventually pulled one to log my bwc from being on the stop. - Officer Kurtz

According to the report Kurtz told Guillerm that he was violating policy for not issuing citations for the Driving while Suspended or Revoked License. Although the driver no knowledge, the police policy requires action to be taken and officers have zero discretion on that offense.

Two sergeants reviewed the video and determined that Guillerm did not activate his body worn camera until he got to the door of the car. Guillerm also did not identify the woman stopped; instead, immediately accused the passenger of being someone he was not, claiming furtive movement and removed both from the car. Guillerm instead read the driver her rights according to miranda and jumped into the narcotics investigation.

Furtive movement allows officers who believe someone is moving in a manner to hide or conceal something, permission to search the immediate area. A source close to the department said his nick name is "furtive movement". He used that term twice in this video.

The woman gave consent to search the car; however, at that time she was not free to leave and she would not be able to provide consent while being detained according to case law in the United States. Guillerm never addressed the stop bar violation according to the report and gave verbal warnings for both that and the revoked drivers' license that was discovered in Illonois.

Both Kurtz' and Sergeant Bird's review of the body camera revealed that it was evident that the woman did not want her purse searched. Guillerm continued to make several requests to search the purse, which the driver did not consent to, according to the report.

Charging affidavit VS. What was said
Ofc. Guillerm then wrote on line 23 that he asked f she would dump the pouch out. What was really said was:
"You wanna dump the the two makeup purse on the ground for me" " Why don't you dump it on the ground. Now you're borderline making furtive movements
Administration Review

After review and consultation with Lt. Besuden and Capt. Kilpatrick, there is no violation of the search and seizure policy; the DWLS policy violation should be addressed as an informal remedial training documented in supervisor notes. Please close as "No further Action Required." However Kilptrick is no longer with the department and was later charged with a felony for essentially taking a disabled cops' money and mis-using it according to the charge. She took a plea deal and is no longer working in law enforcement.

State's Attorney Chris Walker said in closing relating to searches of vehicles:

I know this is frustrating. But you and I have been doing this long enough to know when changes in the law happen it's never in our favor. They only make things more difficult for us.

Relating to the case at hand in the letter, a man who had multiple felonies charged against him by Guillerm was said to be unlawfully searched, and all charges were dropped. The man's felony charges of narcotics and firearm posession were all dismissed due to the lack of "PC" or unlawful search.

The charges against the woman on the traffic stop were also dismissed just a couple days later due to the lack of PC for the search. Despite the department not finding any wrongdoing, which is clear in the video, no discipline was made and the complaint was unfounded.

This unruly, unlawful behavior appears to continue in the Port Orange Police Department where one officer took a woman on a date and according to her, he taunted police with his loud car and said to her "They would have stopped us if we were black". We will have a story on that this week!

HUGE UPDATE! Girlfriend vehicles tracked 200+ times

Officer Jarmarus Brown utilized DAVID (Driver and Vehicle Identification Database) and FLOCK LPR (License Plate Readers) to track his girlfriend's and her family's vehicles.

He also installed tracking devices on her belongings and required her to be on FaceTime for his entire shift, According to the charging affidavit Brown ran a check of her driver’s license and vehicle information on June 18, 2024, gaining access to her personal details and all vehicles she and her family may own.

According to the report, Brown also made accusations against the woman, stating to fellow officers at the department that she was suicidal. Shadrack King, a fellow officer, informed the woman that Brown had used department databases to track her whereabouts.
Officer King was interviewed and stated that Brown believed his girlfriend was cheating on him. King recalled an incident where Brown knew she was lying about her location. He stated that Brown used the FLOCK system and saw that her vehicle was elsewhere. Brown then asked King if he wanted to assist in stalking her on a "stakeout" to find out where she was. King testified that he believed Brown recruited Bernice Martell, a police detective, to join him.
In the summer of 2024, King noticed that Brown was using the FLOCK system while they were sitting next to each other. King saw that Brown had an image of his girlfriend’s car on the screen and warned him to stop. King told Brown that this could get him into trouble, but Brown replied that he knew that and would stop.
Brown’s Interview

Brown was interviewed by Detective Teske with the Volusia Sheriff’s Office. He demonstrated knowledge of the systems he was being questioned about and admitted to running his girlfriend’s tag. However, he claimed he had only run it 10 times, not 69 times. Brown did not comment on running checks on his girlfriend’s mother or brother’s tags. As the interview continued, Brown claimed he could not recall any further information regarding the questions asked.

Brown attempted to justify his actions by stating:
"Like I told my agency, it was dumb as hell on my end, emotions flowing, mind going." He was arrested and charged with unlawful access of a computer database and stalking, a felony and misdemeanor, respectively. His bond was set at $15,000.
Opinion

It is our opinion that each violation should result in a separate criminal charge. In a similar case in South Florida, each unauthorized access of a person’s or vehicle’s information was charged as a felony. However, that does not appear to be the case here.

ANOTHER COP ARRESTED - Orange City Police Officer Jarmarus Brown Arrested; Misuse of Law Enforcement Databases and Stalking

UPDATE: Report shows “During this time, Officer Brown exhibited controlling behavior by attempting to control her daily activities, trying to distance her from her family, often sitting in his patrol vehicle outside of her workplace, and even placed a GPS air tag in her wallet without her knowledge or consent.”

Orange City, FL – Officer Jarmarus Brown of the Orange City Police Department was arrested today following an internal investigation into allegations of stalking, and misuse of police databases. Brown, a once well-regarded officer, is accused of illegally using the Flock camera system and other law enforcement resources to track an ex girlfriends movements for personal reasons.

The arrest comes after a former acquaintance of Brown came forward with detailed allegations, claiming he repeatedly monitored their whereabouts using police databases, even while off duty. According to reports, Brown allegidly used Flock license plate readers to track not only the victim's car but also the vehicles of their family members. The charge suggestes that he accessed the system without a legitimate law enforcement purpose, a direct violation of department policies and state privacy laws.

Another police officer had previously attempted to raise concerns about Brown’s activities but was reportedly ignored by department leadership. Allegidly Brown had openly admitted to using the system to track the victim’s movements and even referenced looking up family members’ tags when the victim’s car did not appear in the system.

According to the complaint Brown allegedly used FaceTime calls to keep tabs on the ex girfriend and confronted the victim about their location, despite them never sharing it with him. In one incident, he reportedly told them, "You're f**ing lying to me about your location; I have the proof right in my face!"* while sitting in his unmarked patrol car with his department-issued computer open. The victim also discovered an AirTag hidden inside a wallet Brown had gifted them, further fueling concerns of unlawful surveillance according to the complaint

Brown was booked into the Volusia County Jail with a $15,000.00 bond and is facing multiple charges, including misuse of official information, unauthorized access to a law enforcement database, and stalking. If convicted, he could face significant fines and potential prison time.

Community activists are now calling for a broader review of database access policies within the department to ensure officers are held accountable for any misuse of their surveillance tools.

Arrest Warrant Issued for Ormond Beach Police Officer in Felony Battery Case

Volusia County, FL — A warrant has been issued for the arrest of Ormond Beach Police Officer Jacob Ryan Cannon following an investigation by the Florida Department of Law Enforcement (FDLE). The affidavit, filed in the Circuit Court of the Seventh Judicial Circuit, details allegations of felony battery against Cannon, stemming from an incident that occurred on December 6, 2024.

According to FDLE Special Agent Christopher Imel, who authored the affidavit, the case began when the Ormond Beach Police Department responded to a traffic crash involving a woman identified as Shanna McRee near 274 W Granada Boulevard. Officer Melissa Edmonds of the OBPD was the first to arrive at the scene, finding McRee inside a motor vehicle.

The investigation revealed circumstances that prompted FDLE’s involvement. On December 10, 2024, SA Imel was officially notified of the incident, which allegedly involved Officer Cannon. Details from the affidavit suggest that Cannon’s actions during the encounter with McRee may have crossed legal boundaries, leading to the felony battery charge under Florida Statute 784.041.

Special Agent Imel, a seasoned law enforcement officer with over two decades of experience, including roles in criminal investigations and supervisory positions, outlined the probable cause that led to the issuance of the arrest warrant. Cannon, identified as a white male born on July 22, 1992, residing in Palm Coast, Florida, is now facing serious legal consequences.

The case continues to develop as FDLE and local authorities work together to ensure due process. Officer Cannon’s status with the Ormond Beach Police Department remains under review pending the outcome of the legal proceedings.

Port Orange Cop Accused of "SX harassing" A Woman Then Promoted after written reprimand- (Vid in comments)

Port Orange, FL—An internal investigation by the Port Orange Police Department has resulted in a formal reprimand for Officer Michael Guillerm following allegations of inappropriate online behavior. The investigation, cataloged as IA #2018-0009, was initiated after a complaint surfaced on the department's page accusing Officer Guillerm of "repeated s*xual harassment" on social media.

***The Complaint

Port Orange Police received a complaint by a woman alleging that Officer Guillerm made unsolicited and inappropriate comments about her body via Instagram. The complainant, whose identity has been redacted, described the messages as crude and unprofessional, raising concerns about the officer's conduct while on duty. A formal complaint, providing the screen shots and messages were provided to the department.
Investigation Findings

The investigation, conducted by Lieutenant Alan James, involved a review of social media exchanges, interviews, and disciplinary history. Officer Guillerm admitted to initiating and participating in the Instagram conversation but denied any intent to harass. The conversation included explicit comments about the complainant’s physical appearance and an inappropriate question about her s*x life. Guillerm argued that the conversation occurred in a personal capacity and claimed the complainant’s social media posts invited such discussions.

While the complainant provided a detailed account, investigators were unable to interview her due to a lack of response to multiple follow-up attempts.

***Messages

Some of the message included the following;
Guillerm: "Do you mind if I ask, are your b***s fake?"
Complainant: "You can say what you'd like. So can I. I honestly have no interest in speaking with someone who can't hold a proper conversation without mentioning my body."
Guillerm: "You realize you post pictures where half of the photo is your b***s pushed as close to your chin as you can get them? And then you have the audacity to get upset because I ask if they’re real?"

Complainant: "I’m not upset at all. Also, posting things and choosing whom I’d like to have conversations with are two different things. If I want to post naked pictures, it doesn’t mean I’d like every conversation to end up speaking about it."
Guillerm: "Does having kids make a s*x life hard?"
Complainant: "What in the [expletive] makes you think this is an appropriate question?"
Guillerm: "Just curious?!"
Complainant: "I’m about to block you. I cannot believe you’re a cop."

***Disciplinary Outcome
The findings led to differing interpretations within the department. While the harassment allegation was deemed "unfounded," the Professional Conduct violation was initially marked as "not sustained." However, Chief Thomas Grimaldi disagreed with this assessment, concluding that Guillerm’s actions undermined public respect for the department and violated its Social Media Policy. Guillerm was issued a written reprimand for unprofessional conduct and improper use of social media. There likely was no discipline associated with this.

***Officer Guillerm's History

The investigation also highlighted Guillerm’s prior disciplinary record, which included remedial training for mishandling evidence and inattention to duties. Despite this, the investigation found no evidence that Guillerm used department resources for the conversations in question. He also was a participant where a man filming a homeless interaction with cops then turned on the camera man where 5 port orange cops surrounded a parking lot in order to retaliate. Public Concerns

The complainant criticized the officer’s behavior, stating, “The police are to protect and serve, not scare and harass s*xually.” The case has sparked discussions about professionalism in law enforcement and the potential impact of personal behavior on public trust.

Former Chief Grimaldi emphasized the importance of accountability, stating in the reprimand letter, “Further action of this type will result in more severe disciplinary action.” The department has reiterated its commitment to maintaining the highest standards of conduct for its officers.

As social media continues to blur the lines between personal and professional behavior, this case serves as a reminder of the responsibility law enforcement officers have to uphold their integrity both on and off duty.

In Port Orange, on a cold December day, two officers—Andrew McKay and Christopher G Rogers of the Port Orange Police Department—stopped a woman and arrested her for using a shopping cart from Winn-Dixie, despite her having permission to do so. McCay cited that the "Chief doesn't want [shopping carts] off the lots" as the reason for the arrest.

While they concluded the charges against the woman, Officer McKay's body camera was still rolling, and Rogers either didn’t realize or didn’t care that it was live. Rogers, who had been employed for just six months as of July 2019, according to his LinkedIn profile, and whose current wife shared a photo indicating he started on June 27, 2019, began speaking casually about his ex-wife, who had just driven by, according to his statements caught on camera.

The remainder of the body camera video is muted. The woman was charged, but the charges were later dropped. JMA Media purchased a brand-new shopping cart for her as a gesture of support. We confirmed that the store had given her permission to use the cart due to her condition, as she has cerebral palsy. A video of the cart purchase can be watched here

Making personal statements on duty, as Officer Rogers did, is a serious matter. Fellow Officer McCay neither reported the incident nor took criminal action on the day Rogers made the statements, according to available records. The reason for Rogers’s animosity toward his ex-wife may never be fully known, but records provide some context:

Data from Clerk.org shows that on February 11, 2019, Christopher G. Rogers filed as the petitioner in a case where Angelina Rose Rogers was the respondent. Judgments were entered, but due to the confidential nature of family law, specific details are not accessible. According to The News-Journal, he and the ex wife were married on or near January 17, 2015.

In December 2024, the Port Orange Police Department announced that Officer Rogers had been promoted to Sergeant.
We have requested records of police calls to addresses registered to Rogers in an effort to uncover any additional details. This raises an important question: how do so many officers with questionable actions get promoted within the system? See this article about a Deland Lieutennant

Any time an officer makes threats on duty, it should be investigated. Joking or not joking about shooting at someones car, tires or them should be grounds for termination.
