The Department of Energy (DOE) - Oil Industry Management Bureau (OIMB) has received reports of fraudulent activities involving an individual named Railey, who is using the mobile number 09953266426 and falsely claiming to be a DOE employee. This imposter is offering to process and extend the validity of the LPG License to Operate (LTO) from five (5) to seven (7) years. Additionally, there is another individual using mobile number 09552170320, offering "private" delivery of LTO for PhP600.

The OIMB has no record of any employee by that name, and we do not conduct transactions through GCash or 7-Eleven Bayad Center.
The DOE adheres to the Code of Conduct and Ethical Standards for Public Officials and Employees or Republic Act No. 6713, which prohibits officials and employees from soliciting money.

We advise the public, particularly the industry participants, to immediately report the matter, or any similar unscrupulous acts, through DOE telephone no. 8479-2900 or email at [email protected].

All persons misrepresenting themselves to be authorized by or associated with the DOE or any of its officials shall be dealt with in accordance with the law.

MANILA, Philippines — The Department of Energy (DOE) told suppliers and retailers of liquefied petroleum gas (LPG) to obey safety standards as mentioned in the Republic Act (RA) 11592 or LPG Industry Regulation Act of 2021.

DOE senior science research specialist Robert Cardinales reminded LPG suppliers and retailers of RA 11952 regulations to avoid penalties and ensure consumer safety in a radio interview with DWIZ 882 on Saturday.

“Sana lang magcomply tayong lahat para maging safe ang negosyo, […] tayong mga consumer, diyan sa safety ng pagnenegosyo ng LPG,” Cardinales said.

(I hope that suppliers and retailers of LPG will comply so their industry will be safe, as well as we, the consumers, in the industry of LPG.)

According to RA 11592, suppliers and retailers of LPG products may face administrative and criminal charges if they fail to comply with regulations in the law.

Cardinales added that the most common violation the DOE has encountered in their inspections is LPG tanks lacking proper labels and identifications.

“Usually ang violation na nakikita namin ay yung mga generic cylinders, yung walang pagkakakilanlan kasi requirement sa tangke na kailangan properly marked at merong ownership,” he added.

(The usual violation that we see is generic cylinders, or those without identification, because it is required that LPG tanks are properly marked and with ownership labels.)

The DOE official also said that more surprise inspections will be conducted to ensure LPG suppliers and retailers follow regulations, especially as there are strict penalties.

“Inaasahan naman namin na magcomply naman lahat, especially unang-una sa (We expect them to comply to everything, especially to the) licensing requirement, then sa safety and code of practice,” Cardinales added.

A Department of Energy (DOE) official has cautioned those in the liquefied petroleum gas (LPG) industry to adhere to the Republic Act 11592, or the “LPG Industry Regulation Act” or else risk facing penalties.

Robert Cardinales, DOE’s Senior Science Research Specialist, tackled the gravity of the penalties for violators of the law during a recent interview on DWIZ 882.

RA 11592, signed by President Duterte in 2021, regulates, supervises, and monitors the LPG industry and all industry participants to ensure compliance with the health, safety, security, and environmental standards, among other codes and standards. DOE personnel regularly conducts inspections to check compliance with licensing requirements and safety standards.

According to Cardinales, individuals found operating in the LPG industry without a valid license can be slapped with a daily fine of P5,000. Repeat offenders will also face criminal charges, business closure, and a lifetime ban from participating in the industry.

Cardinales mentioned instances of violations, particularly the use of generic LPG cylinders without proper markings and ownership information. Violations were reported during inspections in areas such as Rizal and Quezon.
On license to operate applications, Cardinales said a six-month grace period was granted to all LPG industry participants, from January to July this year. Several retailers however have yet to comply with these requirements.

Cardinales said the energy department is working with concerned government entities, law enforcement agencies, and local government units to enforce the law effectively.

The public meantime has been encouraged to remain vigilant and report any irregularities to the DOE. The energy department promises to address such concerns in a bid to ensure safety and quality of LPG for both businesses and consumers.

Ngayong July 07, 2023 nalang po ang pag-kuha at pagpapalit ng inyong Standard Compliance Certificate o SCC ng License to Operate o LTO at wala pa pong extension ang DOE sa pagcocomply.
Kung kayo po ay hindi umabot sa nasabing deadline kayo po ay kailangang pansamantalang tumigil sa pag-ooperate ng inyong LPG Business hanggang sa mapalitan po ang inyong SCC ng LTO.
Para naman sa bagong papasok palang sa LPG Business o kaya'y wala pang LTO ay hindi rin po kayo pwedeng mag-simula at mag-benta ng LPG habang wala po kayong License to Operarate na nagmula sa Department of Energy.

Kung kayo po ay hindi tumigil sa inyong pag-ooperate ng LPG Business ng walang LTO, Kayo po ay may posibilidad na mahuli at mabigyan ng malaking multa, pagkakaroon ng kasong kriminal o pagka-kulong at permanenteng diskwalipikasyon sa industriya ng LPG (hindi na po kayong puwe-puwedeng mag negosyo ng LPG habang-buhay)

LPG Industry Displays Unity in Recently Concluded Nationwide LPG Summit Tour

The Liquefied Petroleum Gas (LPG) Industry demonstrated a remarkable display of unity following a successful national tour that provided stakeholders with an overview of Republic Act 11592, also known as the LPG Industry Regulation Act.

This legislation establishes the regulatory framework for safe LPG operations and outlines the roles and responsibilities of various government agencies.

Additionally, it introduces reforms to the existing standards of conduct and codes of practice for all industry participants.

Led by the Department of Energy (DoE), the summit was conducted in different regions to effectively disseminate information to LPG businesses across cities, towns, and provinces.

The tour covered ten regions throughout the Philippines, each hosting its own event. The regions included were:

Region 1 - San Fernando La Union
Region 2 - Cauayan City, Isabela
Region 3 - San Fernando, Pampanga
National Capital Region (NCR) - Pasay City
Region 4 - Batangas City
Region 5 - Legazpi City, Albay
Region 6 - Iloilo City, Iloilo
Region 7 - Cebu City
Region 10 - Cagayan de Oro
Region 11 - Davao City

The private sector partners who played a significant role in the successful LPG Summit tour across the country include the LPG Safety Foundation, LPG Marketers’ Association, LPG Industry Association, Republic Gas Corporation (REGASCO), Petron Corp, Fiesta Gas, Solane LPG, Phoenix Petroleum, South Pacific Inc., Shine Gaz, Brenton International Venture Manufacturing Corporation, Liquigaz Philippines Corporation, and Pascal Resources Energy Inc.

The government agencies which actively participated in the various events, including the Department of Trade and Industry (DTI), Bureau of Fire Protection (BFP), Philippine National Police (PNP), and Department of Interior and Local Government (DILG).

Through this collaborative effort, all participants and stakeholders received comprehensive education on LPG and safety-related matters. The events garnered significant coverage from national, regional, provincial, and social media platforms, including print, radio, TV, and online channels.

The expenses incurred in organizing these ten regional LPG summits were covered through voluntary contributions from private sector participants in the LPG industry.

This nationwide tour of the LPG Summit underscores the commitment and dedication of both the government and private sector in promoting LPG safety and raising awareness among the general public.

With the approval of DC2022-11-0037 or the “Guidelines on the Registration and Issuance of License to Operate (LTO) to qualified DOE-regulated LPG Industry Participants”, the Department of Energy (DOE) through the Oil Industry Management Bureau (OIMB) and the Field Offices (FOs) are now accepting the application for the registration and issuance of LTO as mandated by RA 11592.

Please be informed that all DOE-regulated LPG industry participants already engaged in any activity which have a valid and existing Standards Compliance Certificate (SCC) and LPG industry participants that have submitted a complete documentary requirements and paid for the corresponding fees for the issuance of SCC but pending release of the actual SCC shall obtain an LTO within six (6) months from the effectivity of the said circular which is January 7, 2023. Any LPG industry participants planning to engage in any of the activities of the LPG industry are also encouraged to apply for LTO before the actual commencement of business operations. All applicants shall submit the required documents for the registration and issuance of LTO and shall also comply with the required Standards for Product and Ancillary Equipment, Facility and Safety Practice.

Please be informed also that DOE through the OIMB and the FOs will start the process of convening the Sectoral Representatives, Regional Program Implementation Task Force, and National Program Policy Task Force for the implementation of Joint Department Circular No. JDC2011-11-0002 or the “Guidelines for the Implementation of LPG Cylinder Exchange, Swapping and Improvement Programs” that apply to End-consumers, Trademark owners or Marketers and their duly authorized Dealers and Retailers, Independent Hauler-Bulk, Independent Hauler-Cylinder, Refiller, Requalifier and Repairer.

The party-list group Liquefied Petroleum Gas Marketer’s Association (LPGMA) Partylist expressed gratitude to the Department of Trade and Industry (DTI) for the approval of the Implementing Rules and Regulations (IRR) of the cylinder exchange swapping and improvement program prescribed under Republic Act 11592 or the LPG Law of 2021.
Former congressman and LPGMA Partylist founder Arnel Ty said the support of government regulators and law enforcement agencies is crucial to the full implementation of thd LPG Law.
The cylinder exchange swapping IRR specifies the procedure and timeline for exchange, swapping, and buyback of LPG cylinders, the computation of the depreciated value of LPG cylinders, and the establishment of accredited LPG cylinder swapping centers.
“It is our party’s duty and mission to keep consumers safe and we hope that those in the industry will follow suit,” Ty said during a courtesy call to the DTI.

LPG INDUSTRY THANKS PNP FOR THEIR SUPPORT IN ENFORCING LPG LAW

The Liquefied Petroleum Gas (LPG) industry thanked the Philippine National Police for their commitment in providing support to enforcing Republic Act 11592 or the LPG Law of 2021.

“We are grateful for the PNP’s efforts in working hand in hand with other government agencies such as the Department of Energy and the Department of Trade and Industry to go after illegal LPG operators. They are safeguarding consumers in the harmful effects of defective LPG tanks and those that are not properly contained and stored,” Regasco President and LPG Marketers Association Partylist founder Arnel Ty said.

During the meeting, PNP Chief Police General Rodolfo Azurin Jr. suggested the creation of a technical working group to prevent illegal activities by unscrupulous LPG players.

DOE Reiterates Commitment to Implement LPG Law

The Department of Energy (DOE) has reiterated its commitment in the implementation and enforcement of the LPG Industry Regulation Act or the Republic Act No. 11592.

In a meeting with the members of the liquefied petroleum gas (LPG) industry on September 30, Energy Secretary Raphael Lotilla said the DOE is committed to support the full implementation of the LPG Regulation Act, which was signed into law in October 2021.

The law seeks to regulate the LPG industry to ensure consumer protection against malpractices, as well as to institute reforms in the existing standards of conduct and codes of practice for the LPG industry.

Lotilla also informed the LPG industry that the three remaining Implementing Rules and Regulations (IRR) of the law have been approved and will be signed in the coming week. These are the IRR for the license to operate; cylinders exchange, swapping and improvement program; and rules and procedures for administrative cases.

Lotilla also recommended the creation of a task force composed of different agencies such as the Department of Trade and Industry (DTI), Philippine National Police (PNP), and the local government unit (LGU) to augment DOE's lack of field personnel and to immediately curb violations in the LPG industry.

Present in the meeting were representatives of the LPG Marketers' Association (LPGMA), LPG Industry Association (LPGIA), Petron Gasul, Solane of Isla Petroleum , Phoenix LPG, South Pacific Inc. (SPI), Regasco, Pascal Resources, Brenton, Liquigaz, and Ferrotech Steel. They thanked DOE for its commitment in providing support to enforcing the LPG Regulation Act.

Energy Undersecretary Alessandro Sales and other employees of DOE also joined the meeting.
