The heightened and strategic operations of the National Capital Region Police Office headed by Regional Director PMGEN JOSE MELENCIO C NARTATEZ, JR to dismantle drug-related activities resulted in the apprehension of 38 drug personalities in the Region. A total of 25 operations were conducted and confiscated illegal drugs with a total Standard Drug Price (SDP) of Php 1,059,916.00 from May 21-22, 2024.

We shall wait for a warrant of arrest from a competent court. If the PNP arrest him prior to the warrant, crimes of unlawful arrest and arbitrary detention can be committed.

Kailan ba maaring arestuhin ang tao kahit walang warrant?

Section 5. Arrest without warrant; when lawful. — A peace officer or a private person may, without a warrant, arrest a person:

(a) When, in his presence, the person to be arrested has committed, is actually committing, or is attempting to commit an offense;

(b) When an offense has just been committed, and he has probable cause to believe based on personal knowledge of facts or circumstances that the person to be arrested has committed it; and

(c) When the person to be arrested is a prisoner who has escaped from a penal establishment or place where he is serving final judgment or is temporarily confined while his case is pending, or has escaped while being transferred from one confinement to another.

Ang PNP ay nakapagfile na ng demanda sa Piskalya sa kadahilanan hindi agad sumuko ang suspek o hindi agad siya nahuli pagkatapos ng kanyang ginawa. Kahit pa hulihin ay papakawalan lamang ito ng Piskalya.

Proseso:

dalawang paraan para makulong kahit wala pang hatol ang korte:

Una: Yung tinatawag na warrantless arrest na maari lang kapag pasok ang Section 5 Rule 113 of Criminal Procedure. Ikukulong sila muna at iinquest sa Piskalya at sasampahan ng Habla sa korte hindi na kailangan ng warrant of arrest kasi magpapyansya na lamang ang inaresto at haharapin na nya ang kaso nya sa korte sapagkat nakakuha na ng jurisdiction ang korte sa kanya.

Pangalawa: Kapag walang nang warrantless arrest dahil hindi na available ang Section 5 Rule 113, ang gagawin ay magsasampa ng demanda sa piskalya ang mismong biktima o pulisya. Kapag ang kulong ng krimen na ginawa ay lagpas sa 4 na taon, 2 buwan o 1 araw, ang Piskalya ay magsasagawa ng Pangunang imbestigasyon ( Preliminary Investigation) . Magpapapasa ang nireklamo ng Kontra-Salaysay at aaralin ng Piskalya kung mayroon bang sapat na dahilan o dapat pang ihabla sa korte ang nireklamo o hindi. Pag nakita ng Piskalya na dapat kasuhan, isasampa na nya ang Habla o Information pero hindi pa rin aarestuhin ang suspek. Aantayin parin ang korte magsagawa ng sariling imbestigasyon at pagnakitang ang korte na may sapat ding dahilan para maglabas ng warrant, doon pa lamang pwedeng arestuhin ang suspect.

Sa kasong ito, aantayin na muna ang Warrant of Arrest. Gustuhin mam natin arrestuhin dahil sa kanyang ginawa. kahit pa gigil na gigil ka na, hindi pwede sapagkat, the PNP must act within the bound of the law.
