The Rivers State House of Assembly has dismissed a recent resolution made by Martin Amaewhule and his 24 co-travellers, which declared a shutdown on government expenditure, until an Appropriation Bill for the 2024 fiscal year is presented and passed by them as illegal, stating that they have no constitutional rights to make laws for Rivers State having vacated their seats following their defection to the All Progressive Congress in December 2023.

The resolution by Amaewhule and 24 others, according to the Speaker, "furthermore directed the Governor to desist from further authorization of withdrawals from the Consolidated Revenue Fund of the State and to direct all Rivers State Government Ministries, Commissions, Agencies, Departments and Extra-Ministerial Departments to desist from spending taxpayers funds until the 2024 Appropriation Bill is laid before the former members parading themselves, albeit unashamedly, as members of the Rivers State House of Assembly"

Speaker of the Rivers State House of Assembly Rt Hon Victor Oko Jumbo who read the statement at Tuesday plenary during the sitting of the Assembly and urged the public to discountenance the resolution by Martin Amaewhule and 24 others to the effect that the Rivers State Governor, Sir Siminalayi Fubara, is not permitted to authorize the withdrawal of moneys from the Consolidated Revenue Fund of the state.

He pointed out that by their defection and declaration of their seats as vacant by the Rt. Hon. Edison Ehie as then authentic speaker of the Rivers State House of Assembly, Amaewhule and 24 others have no legal capacity or moral basis to pass any valid resolution or enact any legislation for the state.

The Speaker disclosed that, "On the 1st Day of December, 2023, at the 87" Legislative sitting of the House, former Speaker, Martin Amaewhule and the 24 former members defected from the Peoples' Democratic Party (PDP) to the All Progressives Congress (APC)."

"By virtue of section 109(1)(g) and (2) of the 1999 Constitution which are self executing, and consequent upon their defection, on the 13 Day of December, 2023, Rt. Hon. Edison Ogerenye Ehie, as the then duly recognised Speaker of the 10th Rivers State House of Assembly, by virtue of a court order granted by Hon Justice Danagogo on the 12th Day of December, 2023 in Suit No. PHC/3030/CS/2023, and pursuant to section 109(2) of the 1999 Constitution, declared their seats vacant."

Rt. Hon. Oko-Jumbo noted that as the authentic Speaker of the Rivers State House of Assembly recognized by law, and the Rivers State Government to carry out statutory obligation for the Assembly, urged the Independent Electoral Commission, INEC, to expedite preparations towards the conduct of a bye-election to fill the vacant seats created in the Rivers State House of Assembly by the defection of Martin Amaewhule and 24 others.

"Consequent to the above Constitutional provisions and the declaration of their seats vacant, the recognised 10th Rivers State House of Assembly is the one led by Rt. Hon. Victor Oko-Jumbo. Thus, the Rivers State Government has ceased paying any form of salaries, allowances or statutory remunerations to the former members."

The Speaker faulted Martin Amaewhule and the 24 ex-lawmakers' attempt to legitimize their actions based on section 122 of the 1999 Constitution, noting that the section empowers a State Governor to continue to make appropriations for 6 months, from the budget of the previous fiscal year, where for any reason he is unable to present an appropriation Bill to the House.

He reminded the defected members that Gov Fubara, presented the 2024 Appropriation Bill to the Rivers State
House of Assembly, under the leadership of the then Speaker Rt. Hon. Edison Ehie, and it was duly passed on the 13 Day of December, 2023 and assented to on the 14th Day of December, 2023.

The Speaker said the House is awaiting to receive from Gov. Fubara , the presentation of the Medium Term Expenditure Framework (MTEF) for the next 3 financial years, pursuant to section 10 of the Rivers State Fiscal Responsibility Law, No 8 of 2010, in order to prepare for the 2025 fiscal year.

Meanwhile a bill for the establishment of Vocational and Technical Institute sponsored by the Hon. Adolphus Timothy and Rt. Hon. Victor Oko-Jumbo passed the first reading while a motion for the prohibition of open defecation in the state was unanimously approved by the house.

COURT ORDERS RIVERS CHIEF JUDGE, CLERK OF ASSEMBLY FROM DEALING WITH MARTIN AMEAWHULE, 24 OTHERS

On Monday, the Rivers State High Court of the Port Harcourt Division, sitting in Port Harcourt, granted an ex parte application and issued a restraining order against the Chief Judge of Rivers State and the Clerk of Rivers State House of Assembly form having any dealings with Rt Hon Martin Amaewhule and 24 others.

The exparte motion came before Justice Jumbo Stephen for hearing and determination of the Suit NO, PHC2177/CS2024 and he had listened to the reading of the supporting affidavit.

The court therefore, restrained the Chief Judge of Rivers State from dealings in whatsoever capacity with Rt Hon Amaewhule and 24 others who ceased to be members of the Rivers State House of Assembly when they defected from Peoples Democratic Party PDP to thr All Progressives Congress, APC.

In the order, the Clerk of the Rivers State House of Assembly was also restrained from dealing with the Rt Hon Amaewhule and others(who are 1st to 27th Defendants on the suit).

The Court granted that an Order of Interim Injunction be served to restrain the 31 and 32nd Defendants, not only
from dealing or howsoever relating with the 1"- 27th Defendants as members of the Rivers State House of Assembly but also do not receive forward or howsoever act on any
resolutions, articles of impeachment or other documents or communication from the 1- 27th Defendants.

This remain so pending the hearing and determination of the motion on notice for interlocutory injunction that has been filed already.

The court also granted that the parties to the suit are directed to maintain the status quo ante litem in the suit as the 5th July 2024 pending the hearing and
determination of the motion on notice for interlocutory injunction already filed.

The matter was adjourned to the 15th
day of July 2024 for hearing of the motion on notice for interlocutory injunction.

Rivers State Governor, Sir Siminalayi Fubara, has clarified that he is not fighting anybody but rather defending the State against predators, and protecting supporters of the interest of Rivers State against those who feel that they own the life of others.

He also has asserted that the failed attempt to detonate an explosive device at the Hotel Presidential, a five star hotel in Port Harcourt, was a deliberate ploy to strengthen the call for a state of emergency by haters who want to undermine the State to achieve their evil plans.

Governor Fubara made the assertion when he received on courtesy visit, a delegation of the Senate Committee on Privatisation and Commercialisation, led by its Chairman, Senator Orji Uzo Kalu, to Government House in Port Harcourt on Wednesday.

The Governor explained that some youths were hired to engage in a protest to demand for extension of tenure of former local government chairmen who have served out their statutory three-year tenure.

Governor Fubara said the protesters and their sponsors were aware that some honourable members of the National Assembly were guests at the Hotel Presidential, which is why they attempted to detonate an explosive device near the facility in order to give reason to support the call for state of emergency when the matter is raised at plenary but they failed.

He said, "As a matter of fact, let me tell you, I know of everything that is happening. Yesterday (Tuesday), they (protesters) were aware that you are in the State. So, there was an attempt to create serious problem.

"In fact, there was a plan to detonate dynamite at the Hotel Presidential because you people were there. But this God that we serve, it happened that the man who was trying to do it, detonated it but just few seconds after, it blew his hands off."

Governor Fubara asserted: "The idea was that as you were hearing state of emergency, it will be so that by the time they finish, when you return to have your sitting tomorrow (Thursday), the debate will be from somebody from this State who called you people to tell you not to come. He will now raise issue of state of emergency, and say after all, distinguished colleagues saw it happen while you were in Rivers State, that you saw what happened.

"But you see, when you are with God, even your own child who is planning evil, will go and tell somebody that, God is with this man because he is clean, this is what my father is planning. That is what is keeping us in this State."

The Rivers State Governor wondered why it seems that the law is silent or inactive to take its course over offenders because somebody appears to be bigger than the law on the agitation, because there is nowhere in the country were tenure elongation for former local government chairmen has been an issue.

Governor Fubara clarified that he is not fighting anybody but rather defending the State against predators, and protecting supporters of the interest of Rivers State against those who feel that they own the life of others.

The State Chief Executive pointed out that there is no Governor in Nigeria who can take 10 percent of the abuse railed at him by former local government council chairmen.

Governor Fubara said he has taken those insults and attacks in his strides without going hard at the purveyors because their plan is to distract him, stressing that he has remained focused on delivering good governance and democratic dividends to Rivers people.

He said, "Where on earth can tenure of local government chairmen be elongated. You were a former Governor, was it tried in your time. Even those of you that are Senators here, even in your own states, has anyone tried this before?

"Is it that the Constitution that governs Nigeria is different from the one that operates in Rivers State? These are the very pertinent questions we should ask.

"Why should it be that when it comes to the case of Rivers State, the law is always silent? Is it that there is somebody bigger than Nigeria? That is the question I want you to go back with."

Governor Fubara insisted: "I tell you, we know everything that is happening, and you know it, everybody knows it. We should be bold enough to look at the face of people and tell them the truth.

"I am not fighting anybody. If I am fighting, people will know that I am fighting: My pattern will change. What we are doing is to defend ourselves. We can't just fold our hands. Only a tree will be standing and somebody will come and cut it off.

"It doesn't happen as a human being. If you know that danger is coming, you shift. What we are doing is just to protect ourselves. So, Distinguished Senators, I am not fighting anybody."

Governor Fubara further said: "Somebody thinks or some people feel they own life. I don't own life. The person who own life is God. What we are doing here is to serve the people of Rivers State because God has given us this opportunity.

"It doesn't matter the channel the opportunity came from. But the most important thing is God, and nobody takes the place of God in anything," he added.

The Governor told members of the committee to factor in the interest of Rivers State as they recommend the privatisation and commercialisation of public companies, saying that when the State buys stakes in such companies, it can be protected and supervised to be viable.

"I will also appeal to you that in this process of privatisation, anything that has to do with our own State here that needs to be privatised, the Rivers State Government will be interested.

"Because you can't come here and own our property when we have the resources to have shares or to acquire some portion of it.

"So, as a committee, if there is anywhere you can support us; if they is anyone that is still available, let us know, and let us get the details so that we can own it.

"It is only when we own it that those assets can be protected. It is only when we own it, that is when those assets become viable to the State, and also become viable to the Federal Republic of Nigeria," he noted.

In his address, Chairman, Senate Committee on Privatisation and Commercialisation, Senator Orji Uzo Kalu, said they were in Rivers State to carry out oversight duties on some projects under their purview.

Senator Kalu, who is the member representing Abia North Senatorial District, commended Governor Fubara for his love for peace, determination to offer quality governance and keep pace with providing the right climate to engender economic growth to all residents in the State.

The Senate committee chairman also urged the Minister of the Federal Capital Territory, Nyesom Wike, to shealth the sword, and call his supporters to order as a commitment to fostering peace and putting the interest of the State above all considerations.

He said, "I want to admire Your Excellency, your Deputy and your team for the good things you are doing in the State, but it is good to have peace.

"I want to thank you because you look like a very peaceful man. Your face shows a peaceful man. Your laugh shows a peaceful man. So, I want you to continue in that manner of peace. There is nothing like peace. Let people who are eating with this problem stop eating from it.

"We know that politics has taken its shape. We commend you for what you are doing for the people of your State. I will continue to ask you to focus on the job.

"Leadership is a very big burden. It is not a sweet potato. It is not anywhere where you can see rice and beans. On the street of Rivers, everyone is saying that the Governor and the former Governor are quarreling.

"We want to plead with you, continue to be holding your people back because if your people demonstrate like the other people, we will have a state of anarchy, and it is not good to have anarchy.

"I want to plead with you to abide by the rules of the land. I plead with you to abide by what the Constitution says. I plead with you to also abide by the decisions of the Judiciary. Wait for every judicial interpretation and act on judicial interpretation," he added.

He pledged the readiness of the committee to work with the State Government to achieve mutually beneficial goals that will advance the interest of all Nigerians, adding that the hardship in the land was already enough burden that leaders need to concentrate efforts to address to promote growth and prosperity for all.

GOV FUBARA DISPELS RUMOURS OF CRISIS

•Insists Rivers Is Peaceful, Not Under Siege

•Inspects 14.6km Omodu-Eberi-Omuma Road

Rivers State Governor, Sir Siminalayi Fubara, has emphasised that the State and its people are enjoying an enduring atmosphere of peace to promote sustainable development, fast-paced investments and accelerated economic growth.

He said the recent negative narrative that portrays the State as immersed in crisis with disrupted peace is untrue, misguided and was the handiwork of mischief makers.

Governor Fubara made the clarification when he spoke to newsmen in Egbelu Community, shortly after inspecting the progress of work on the 14.6km Omodu-Eberi Road project in Omuma Local Government Area on Thursday.

The Governor said it was important that Nigerians know of the uninterrupted peaceful atmosphere in the State because the people are going about their normal activities, while governance was thriving.

He stated: "And to also tell Nigerians that Rivers State is peaceful. You can see that we are moving about inspecting projects as against what you see on the screens of your television sets that police are everywhere, that we don't move about anymore, and that Rivers State is under siege.

"We are not under siege. Our State is free and peaceful. If at all there is any problem in any part of the State, I know quite well that Nigerians know where the problem is coming from, not from us," he clarified.

Governor Fubara emphasised: "We are peace-loving people. It is already written all over us. Our actions and our deeds have confirmed that we are peace-loving people.

"We will continue to maintain the peace that we promised everyone, for the betterment of the good people of Rivers State," he added, and encouraged the business community, especially potential investors to take advantage of the vast investment opportunities that abound in the State.

Commenting on the 14.6km Omodu-Eberi Road project, Governor Fubara stated that the project was started by his administration with the target of inaugurating it during his one year in office anniversary.

Governor Fubara explained that what delayed the work was the decision to extend the length of the road to make it serve as a comfortable link for motorists to drive onto Abia State.

The Governor said: "We are in Omuma to inspect the project that we started. The project was supposed to be part of projects commissioned during our one year anniversary celebrations.

"But we found out that some part of the job, if completed, will link Rivers State to Abia State, and we felt there is no need to commission it halfway without joining that part that connects us to Abia State."

Governor Fubara further said: "So, we directed the Ministry of Works to extend the project from 8 kilometers to 14.6 kilometers. So, we are here to see what is happening, and to prepare ourselves that maybe in the next two months, we might likely be coming here to commission this project for the good people of Omuma."

Rivers State Governor, Sir Siminalayi Fubara has directed an immediate audit of the accounts of the 23 Local Government Areas of the State

Governor Fubara gave the directive to the Local Government Auditor-General to commence the process.

immediate audit of the accounts of the 23 Councils in the State snd make the report available within the next one month .

The directive was given during the swearing-in of the Chairmen of the Caretaker Committees (CTC).

They have been saddled to take charge of the affairs of the 23 Local Government Areas of the State.

Each CTC has seven members for each Local Government Area.

Governor Fubara said: " You've emerged from the millions of people of this dear State, to lead or to manage, for a short time, the affairs of our dear Local Government Areas.

"Count yourself very lucky and take this opportunity as a call for service. It is not a call that will make you see yourself as a super human, but an opportunity for you to protect the interest of your people and to also make us proud, at this critical time, that the decision we have made is not a mistake.

"Let me also say this, what is happening here now is a defence of democracy. We will not allow a wrong precedent to be created in this country.

"It is not about Rivers State, it is not about Fubara, but if in anyway, this attempt of tenure elongation succeeds in Rivers State, it becomes a norm in Nigeria.

"So, we have taken it upon ourselves to say, not on our own watch, will it happen because it is completely alien to the Constitution of the Federal Republic of Nigeria.

"So, for those people who are saying the only reason why we are going to continue to be in office is because elections are not conducted, know that we have more than 85 percent of the States in Nigeria that are being ran by caretaker.

"Ours is different. Here, you have your tenure, you have completed your tenure. It is proper you let go, and life doesn't create vacuum. If your tenure has expired, it doesn't mean I should, because I want to please you, allow you stay longer. No, no.People must take over, manage the affairs and elections be conducted."

To the newly sworn-in CTC chairmen, governor Fubara said: "Let me also sound it very clearly here that your tenure are not going to be too long because, as a matter of fact, by the end of today or tomorrow, there should be a process for the commencement of electing local government chairmen in our dear State.

"Let me also advise that as you resume in your respective local governments, please, I do not want any confrontation. It is not in my nature, it is not my style.

"Whatever happened yesterday, I know that the world know that it is not from you people. Some people caused it. So, let us not give them the opportunity to continue to make our State look bad in the comity of States.

"When you go back, if there is any situation, I want you to be law abiding. I don't want any confrontation. You can operate from anywhere. The most important thing is that you have the control of the LGAs today.

"I want to also appeal, whatever is the benefits, salary or whatever due the out-gone Chairmen, Vice Chairmen, the Councilors, ensure that it is being sorted out.

"I am not of the class to say that because something happened so, you should maltreat them, no. Whatever is their entitlement, ensure that they get it. And also make sure that you maintain peace. It's important in your LGAs.

"I feel very, very sad that all the time, for one reason or the other, you only hear about Rivers State; one bad news. If not that we managed to organise our one year anniversary, I wondered what will be happening in this State. Is it always crisis here, crisis there?

"But, please, I want to appeal to you, when you go back, I don't want crisis. Just manage the situation as much as we can.

"God does not start and end halfway. That is the truth. Since God has started with us, He will definitely complete His work in our lives.

"I also want to say this, that for the local government activities witnessed in the past three years, I would want to mandate, which is an official assignment, not even a statutory duty, the Auditor-General should immediately commence the audit of the 23 local government areas in the past three years and come up with the result in the next one month.

"It is important, so that we will know what has happened and how our funds were been used in those 23 local government areas. It is important so, that it will be a check for those people who are also coming in.

"Let me at this point thank everyone of you. My take home for you today will still remain ensure the peace.

"Nobody should take the law into his or her hand. The most important thing is that there is no vacuum. Government continues, and you have the leadership.

"Go back and do what you need to do, but I don't want any form of confrontation. Please, whatever is it, will be sorted out, but I don't want any fight.

Rivers State Governor, Siminalayi Fubara briefed newsmen shortly after a Security Council Meeting at Government House in Port Harcourt on Tuesday.

Governor Fubara explained: "We've just finished a security council meeting and the meeting is because of the situation that we are experiencing in the state.

"You are all aware that the tenure of the Council Chairmen ended yesterday, 17th June, 2024 and today, we have ordered the Head of Local Government Administration to be in charge while we wait for further directives.

"It's really unfortunate that we started hearing some disturbing news from some Local Government Areas (LGAs) of invasion of council secretariat and it is really, really unfortunate.

"So, we have called the security council meeting so that the needful will be done.

"We are also aware that our enemy is also planning a lot of things, but we will not fall into that plot were we will allow him or them to destroy the peace that we are enjoying in the state.

"Let me also say this, I am also aware that there is also a grand plan to come and arrest some of our supporters.

"This time around, you have to pass through me to arrest them, because I don't think there is any thing that any of those people following us have done wrong, rather than standing on the side of truth.

"If it will cost us our lives, to stand on the path of truth, we will do that and I will be the one that will lead this course.

"Let me assure everyone, more especially the great and peace loving people of Rivers State, the law is the law.

"The law has said that there is no extension of tenure. The court said so and whoever that is assuring anybody anywhere of whatever, I advise them to desist from it because peace is what we need in this state.

"I assure everyone of you that whatever it takes to make sure that we maintain peace and order, we are not going back on that.

"Thank you for what you are doing for us, moreover the media people, you've really been on watch for us.

"We don't know anybody in Abuja, we only know the media in Rivers State and you have been doing very well for us."

…RE-COMMITS TO EMPOWERING RIVERS YOUTHS TO ACTUALIZE THEIR POTENTIALS…

Rivers State Governor, Sir Siminalayi Fubara says the Rivers State Youth Resource Centre (RIVSYREC) is an evidence of his Administration’s commitment towards empowering our youths and providing them with the needed resources to actualize their Potentials.

Governor Fubara stated this during the Flag Off of the Construction of Rivers State Youth Resource Centre (RIVSYREC) on Tuesday, 28th May 2024, Beside Old Airport Hotel, at the Greater Port Harcourt City Development Authority, Port Harcourt.

Represented by his Deputy, Professor Ngozi Nma Odu , Governor Fubara disclosed that over 65% of our population are youths and we cannot afford to ignore such a population, noting that our youths are yearning for us to equip them with relevant skills.

According to the Governor beyond going to the University and picking up a certificate, skills will drive you further; stressing that in developed countries like the United States, the UK and Europe it is the people that acquire skills that are able to make more money, because your skills answer to specific questions and render solutions to problems.

“The idea of conceiving this youth resource centre is to change the narrative of our youths, change the trajectory of our State and let people begin to see us from a better and a more wonderful perspective that we really are”.

The Governor, who advised the Youths against selling their future for a paltry sum, noted that the era of acquiring skills and selling the starter packs given to them are over.

“We are saying that, if you acquire that skill you can put in your best and get the best out of it, so please as you come into this centre, which has a multi faceted approach, they will teach you and screen you on what you are best suited for and there after they will equip you with the right process and link you up”. Governor Fubara quipped.

The State Chief Executive who reiterated that his Administration would continue to put the Rivers people first in the scheme of things, said when we positively impact on the lives of our people we will forever be remembered.

In his remarks Dr. Chisom Gbali, the State Commissioner for Youth Development who extolled the sterling qualities of Governor Fubara said the resource centre would close the gap of training, skills and education that is currently lacking in some of our institutions.

He said the project has four cardinal areas such as ICT, Skills Acquisition, Artificial Intelligence and Entrepreneurship and expressed gratitude to the Governor for changing the narrative towards youth development in the State.

Earlier, Arch. Clifford Ohikere, who spoke on behalf of Osborne Logistics and Engineering Services, said the project which is in three phases, would focus on developing youths with emerging skills sets and equipping them with knowledge and certifications that would make them globally competitive.
