The Regional Trial Court Branch 45 of Tacloban City has rejected two petitions brought forth by Palompon Mayor Ramon Oñte due to lack of merit.

These petitions aimed to invalidate the search warrant that the court earlier issued on the site where the DBSN Farms Agriventures Corp. is located and to suppress the evidence obtained by the Department of Environment and Natural Resources (DENR) to support allegations of environmental law violations against the DBSN poultry farm.

“Both the Motion to Quash Search Warrant and to Suppress Evidence Illegally Obtained filed on January 19, 2024 and the Supplemental Motion to Quash Search Warrant and to Suppress Evidence filed on January 25, 2024 are denied for lack of merit,” Executive Judge Georgina Uy Perez said in her 16-page decision issued on February 2 this year.

Atty. Lloyd Surigao, one of the lawyers representing San Joaquin residents who have taken Oñate to court over DBSN’s dumping of chicken and other solid wastes that has polluted the municipality’s water sources, praised the court's ruling.

“This is another victory for the victims of DBSN’s illegal activities. The court was not deceived by Mayor Oñate’s attempt to cover-up the environmental transgressions of DBSN,” Surigao said.

DBSN Farm Agriventures Corporation is owned by the family of Mayor Oñate.

In its ruling, the court rebuffed Oñate’s argument that the Palompon Watershed Forest Reserve (PWFR) is not a protected area. “The argument of the respondent that an act of Congress is necessary for the PWFR to be considered as a protected area, fails to impress this court,” it said.

It likewise rejected Oñate’s claim that his right against unreasonable searches and seizures was violated when it issued the 10-day search warrant on January 16 allowing the DENR to excavate 30 sites inside the PWFR where chicken and other solid wastes have reportedly been dumped by DBSN.

“The issuance of the search warrant was made after a finding of probable cause for violation of Section 18 of RA 11038, otherwise known as the Expanded National Integrated Protected Areas System Act of 2018,” the court said.

The court noted that Oñate did not dispute, and even acknowledged, that Lot 5150, where the DBSN poultry farms are located, is within the PWFR, where the dumping, throwing and use of any toxic chemical, noxious or poisonous substance or non-biodegradable material, untreated sewage or animal waste or products whether in liquid, solid or gas state, including pesticides and other hazardous substances detrimental to the protected area, or to the plants and animals or inhabitants are prohibited under existing laws.

“Witnesses (were) able to establish that there were dumping and throwing of chicken parts, chicken droppings, intestines, feathers, dead chickens, large blue plastic drums, medicine bottles, plastic bags with contents and even expired canned goods on certain identified portions of Lot 5150, which is within the PWFR, a protected area,” it pointed out.

The court upheld its decision, stating that “there is no factual and legal basis” for it to invalidate or quash the search warrant it issued.

It also dismissed Oñate’s argument that the search warrant was irregularly implemented as it noted that the areas that were excavated were among those identified in the warrant, and that the DENR teams that implemented the court order submitted an itemized list of the evidence that were obtained from the excavations.

“From the foregoing, it is clear that there is no sufficient evidence supporting respondent's claim that Search Warrant No. 2023-12-06 was illegally and/or irregularly implemented. Hence, there is no basis to suppress the evidence obtained during the implementation of the said search warrant,” it said.

The controversy surrounding the continued operation of the DBSN poultry farm in San Joaquin in Palompon, Leyte is a battle between logic, which is sufficiently backed by evidence, and lies, which is being propagated by town mayor Ramon Oñate.

Lawyer Lloyd Surigao, one of the legal counsels of San Joaquin residents who have taken the local chief executive to court, said this as he cheered the legal victory that his clients scored years after filing their complaint for violation of environmental laws against the DBSN Farms Agriventures Inc., which is owned by the family of Mayor Oñate.

“The decision of the Regional Trial Court Branch 45 permitting the search and excavation of several areas of the Palompon Protected Watershed being occupied by the poultry farm is a huge victory for our clients, regular citizens, who have taken a staunch stand against the mayor of their town, whose family owns DBSN. These people are outranked in power and influence, and yet they stood their ground to defend their survival,” Surigao said.

But Surigao said the fight for justice is far from over, stressing that “this is a battle between logic and lies which could drag on for years due to legal maneuverings.”

“Ang hirap sa kalaban namin, puro kasinungalingan ang alam. Gone are the days when our leaders have the decency to lead. Gone are the days when our leaders stick to the truth,” he said.

He added: Simplehan na lang natin: When the DENR excavated 3 areas pointed out by our witnesses, lahat positive sa basura. That is proof that wastes were dumped there. Now who is lying? Yung basura, kitang kita na, pero ‘yung mayor, nagpapalusot pa rin.”

Surigao also cited inconsistencies in the statements and actions of Mayor Oñate during a hearing at the House of Representatives on the controversy, where he invited congressmen to do an ocular inspection of the DBSN site to disprove the allegations of illegal dumping of chicken and other solid wastes, but used government resources to stop the DENR from checking the farm site.

“He deliberately used LGU vehicles to block the barangay road and even sent his employees as human barricades. Mayor Oñate’s words contradict his action,” he said.

Surigao likewise noted the statement of the mayor in an interview that no part of Palompon town has been declared as a protected area, which he said is false.

“May I remind the mayor of the existence of Presidential Proclamation 212 which created the Palompon Watershed Forest Reserve. This is the same PWFR that he used when the LGU drafted its CLUP (Comprehensive Land Use Plan), the same PWRF used as reference in the FLUP (Forest Land Use Plan) that his office filed with the DENR-8. So, his statements are inconsistent and illogical,” he said.

Surigao appealed to the public: “Help us spread the truth in Palompon. Help us fight the injustice against our citizens. Help us push our government officials to do their job in protecting the environment and the interests of our people. Help us bring these criminals to face their day in court.”

The local cable provider, Sky Cable, informed they subscribers via text message on Friday that they will conduct their last broadcast and sign off on February 26, 2024.

"In anticipation of and pursuant to the closing conditions of the PLDT-Sky acquisition deal, Sky will now begin its transition into a dedicated internet service provider," Sky Cable said in their announcement.

"With this deal, the final broadcast and sign-off of Sky Cable will be on February 26, 2024, at 11:59 p.m.," it added.

As per the advisory, Sky informed cable TV plan subscribers that they can receive updates on how these changes will affect their service through mysky.com.ph, the messaging platform KYLA, or by visiting Sky Zones and business centers.

"All Sky Fiber services will continue, and subscribers will be provided with the same level of service and customer experience," Sky said.

PLDT announced on March 16, 2023, that they have finalized a sale and purchase agreement to acquire the complete ownership of Sky Cable Corporation for P6.75 billion.

Recently, the Philippine Competition Commission (PCC) granted approval for the complete sale of Sky Cable's business to PLDT Inc.

In a heart-wrenching incident, a three-year-old boy lost his life after drowning in the canal of a piggery in Dingras, Ilocos Norte. The incident was reported by GMA Regional TV One North Central Luzon on "Saksi" Tuesday.
