Ebonyi South Senatorial Election: The Journey so far, Gratitude and Prospects.

Before I proceed, let me put on record my inestimable appreciation and debt of gratitude to you, the excellent people of Ebonyi South, for the unquantifiable support and solidarity before, during and after the 2023 Senatorial Elections.

Recall that on October 16, 2022, the of former Governor David Umahi Nweze abducted me to their Old Government House, Abakaliki base; with a clear intent to kill me.

In their custody; I was tortured, assaulted, dehumanized and stripped naked while being video recorded live for ex-governor Umahi's primitive entertainment. They minced no words in revealing that my only offense was daring to challenge Umahi in the then forthcoming 2023 Ebonyi South Senatorial contest. Upon my rescue from their dungeon half-a-day later, the same Umahi pressurized the then Commissioner of Police to arraign me before another incapacitated magistrate who threw me into jail for 6 weeks on a trumped-up murder charge, that I only learnt of while on the dock. I am alive and free today because you stood up for me.

While it is practically impossible to list by name all the angels in human form that used to secure my freedom and undertake the elections, I must specifically defer to the great and brave people of Onicha Igboeze (men, women, youths at home and abroad) who repeatedly proved themselves warriors and people of impeccable integrity. Indeed every clan and people stood up for me; the state was united as one by my travail; and I eternal grateful.

To all other champions of my struggle and freedom, whose names I plead not to list here because of the risk of missing out many, this is me saying thank you. You took bullets for me, sacrificed your comfort and relationships. You stood firmly to tell truth to power at grave personal risks and championed the cause beyond the boundaries of the state and the nation. I also extend immeasurable gratitude to the media and also the judiciary.
Then of course, my wife, the super champion of the struggle.

I say a special thank you to each and everyone of you. God used you to save my life and to where we are today.

To Umahi and his team of tormentors and promoters, I bear no grudge; having long forgiven all. Karma and vengeance, which belong to God, are not mine to serve. This is despite the fact that their torture and brigandage resulted in my permanent loss of my right eye vision. In plain language, former Gov Umahi and his terror group blinded my right eye; yet I forgive them!

On February 25, 2023, the Presidential/National Assembly Elections were held across the nation; Ebonyi South inclusive. The people enthusiastically went to the polls to to cast their votes based on the many “reformatory provisions” of the 2022 Electoral Act; which had raised hopes of a free, fair and credible elections.

Nigerians, as indeed the whole democratic world, looked up to INEC to deliver on its core mandate. On that score, you trooped out to cast your votes, stood-by for the votes to be counted and went home happy that your votes had counted. You were sure, and it was well known, that you had elected me to represent you.

On Sunday February 26, 2023; how shocked you were to learn that some compromised staff of INEC had sold their soul to the devil and announced a loser, who came a distant third position, as your elected Senator. In proof of your disapproval, the district went into a traumatic coma rather erupting in celebration. Democracy had been r***d and your mandate stolen. Across the country, the story was same; a litany of electoral miscarriages. INEC had failed the nation!

In my immediate reaction to that grand electoral heist on February 27, 2023 at the State INEC headquarters, I pledged that your stolen mandate shall be retrieved. To realize that solemn vow, I approached the Election Tribunal to ventilate our collective grievances.

In their desperation to manufacture evidence in defense of our factual complaints before the tribunal, the Mandate-thieves attached a forged INEC BVAS Backend Report to their reply; in the forlorn hope that we shall not detect their criminal act. However, we promptly caught them in the act and took steps to verify the document, which INEC promptly denied and confirmed as not being from them; hence the act of forgery. We also petitioned the IGP to investigate and prosecute them for the forgery (same petition remains alive and pending as time does not run against crime).
For this reason, the illegally declared winner panicked and abandoned the seat for an executive appointment.

At that point, our pledge of retrieving your solemn mandate was effectively fulfilled. It also meant that the Tribunal could thereafter take only one of two decisions: reverse the jaundiced electoral manipulation or in the worst case; put the power back in your hands to elect the Senator to represent our people; which they finally did.

It is unfortunate that the tribunal and, more recently, the court of appeal chose technicality over substantial justice and dismissed our case and quest for justice.
Whatever influenced or motivated those decision is no longer important. As much as I disagree with the said decision, I accept it; being an apostle of the rule law and democracy.
I am particularly satisfied that I stood the course and fought with grit against the enormous forces and obstacles amassed against me. We stood this election against a sitting governor and with all the naked manipulations, he could only lead with a paltry 2,882 votes!

I have worked with integrity, sacrificing wealth and comfort. I neither compromised nor sold out against the people. My head is held very high!

Having exhausted the judicial window for remedy, the Ebonyi South Election shall now be re-conducted by INEC, with all political parties at liberty to participate. The immediate take away, therefrom, is that unlike most districts, Ebonyi South now has another opportunity to elect her Senator; the INEC imposed beneficiary having been forced out of the contest. That alone is a massive victory for democracy.

Within the next 90 days, INEC shall conduct a fresh election in Ebonyi South and the decision as to who becomes the Senator shall be yours. The forthcoming election represents our collective victory and opportunity to permanently bury the primitive push for a selfish family dynasty!

Happily, critical lessons have been learnt by all stakeholders from the February election and should be collectively applied to improve the electoral outcome this time around. By so doing, the people will ensure that the rightfully elected candidate is declared after the re-run election. My humble appeal is that we remain motivated, active and vigilant to protect the will of the people when the re-run eventually holds.

I have been inundated by many who want to know my next line of action, whether or not I will participate in the forthcoming re-run.
My answer remains the same: being a product of the people’s will, it is the people that will determine my next move. I have commenced appropriate consultations, the outcome of which will determine my eventual decision and shall also be made public.

Let me reiterate also my total lack of desperation in the ongoing political contest. But even at that, I stand strongly that the Re-run should center on justice, equity and fairness. These are cardinal ingredients of democracy. From the current power equation in Ebonyi South zone, it's just and fair that it's the turn of Onicha to produce the next Senator of the zone.

Importantly, I will never succumb to any form of intimidation, persecution or manufactured challenges so long as I continue to enjoy the backing of the people.

Finally, whatever position you adopt in the forthcoming re-run, remember that Ebonyi South belongs to all of us, our children and coming generations.
It has never been and should not be allowed to become a family dynasty or the fiefdom of any self-styled political tin-god; while other families and their descendants are condemned to eternal slavery and servitude.
The foundational essence of democracy is the intrinsic opportunity for the son of a nobody to become somebody, in contrast to monarchial tyranny where servitude to the King and his narrow lineage is the perpetual affliction and inheritance of the majority population.

Let us be wise and alert to the dangers of acquiescing to the scheming plots of neo-colonialists simply because we are too scared to either confront them or speak out against budding evil.
In the words of Prof. Wole Soyinka, “the man dies in him who keeps silent when it matters most.” Speak out for democracy in Ebonyi South, nay Ebonyi State and Nigeria.

A DIVORCED SINGLE MOTHER WROTE

I am writing to you in order to make someone understand that it's good to appreciate our partners despite their flaws.

I am 32 years of age.
My ex husband and I dated for 6 years.
We where best of friends.

I waited until he completed college and started work. My family and his family then met.
We got married and had a son. (7 years old now).

My husband was short tempered at times but our problems started when I wanted to make him feel he couldn't control me. Every time we argued, I would pack my bags, go to my family and explain.

My sisters would phone my husband and shout at him. If he was controlling me I would always dare him that if he wished, he could divorce me.

I never wanted divorce.
I just had pride and I never wanted to look like a loose woman in his eyes.

One day I pushed him so hard that for the first time he beat me and locked me outside.
I went to my family, my family took him to the police, every time I looked like I was being abused!

But to be honest, I used to abuse my husband emotionally. He was arrested and detained.
I was asked by his family to withdraw the case.
I felt that what I was doing was wrong.

My husband was never a violent man, he did what he did because I pushed him to the wall of which he openly knelt down and apologized.

I withdrew the charge, and we reconciled.
After three months, I packed my bags after a small issue and he remained alone. After two days, I received a call that he was in the hospital.

My family told me that I shouldn't go there because it would look like I was begging him and my sisters believed he was feigning the illness.
All this time, people felt sorry for me like I was the one being abused.

He spent a week in the hospital, after he came out, I just received a divorce summon. I wanted to say no to divorce, but because I felt this pride, I wanted him to change his mind and beg me.

I called him and said he would get the divorce because I lived like I was in hell.
When we went to court, I wanted to make him pay, so I told the court that I needed his properties to be shared.

To my surprise he openly told the court that whatever he and I acquired together should be given to me, all he wanted was divorce.
We were divorced in 2009 July.

Now, my husband is married, whilst l am here wasted! My family members are gossiping about me. I depend on what my ex husband gives to my son for survival.

I know I wasted my
marriage. I am here telling all wives that they should be careful how they get advise.
Don't be cheated, don't entertain family interference in your marriage my dear reader.

Even my young sisters are much more respected than me. Those who encouraged me to get divorced are always teasing and bad mouthing me.

Please ladies, be vigilant in your marriage.
Thought it wise to share my story to save your marriage. There is no benefit in pride for nothing.

This was a fifteen year old boy.... He was caught stealing bread from a store.
On trying to escape from the hold of the guard, a shelf of the store was also broken.

*The judge heard the crime and asked the boy, “Did you really steal something, a loaf of bread and cheese?”*

The boy responded by looking down.;- *“Yes.”*

*Judge:* - “Why?”

*Boy:* - “I needed it.”

*Judge:* - “Couldn't you have bought?”

*Boy:* - “There was no money.”

*Judge:* - “Take it from the family.”

*Boy:* - “There is only a mother in the house. Sick and unemployed.

*Judge:* - “You don't do anything?”

*Boy:* - “Used to wash a car. When I took a day off to take care of my mother, I was fired.”

*Judge:* - “Don’t you ask someone for help?”

*Boy:* - “Had left the house since morning, went to about fifty (50) people, but no help; so, I decided to take this step at the very end.”

*When the arguments ended, the judge began to pronounce the verdict;*
.. “the theft and especially the stealing of Bread by a hungry boy is a very shameful crime and we are all responsible for this crime."

*Every person in the court, including me, is guilty and a perpetrator, so every person present here is fined ten dollars each. No one can get out of here without giving ten dollars.”*

Saying this, the judge took ten dollars out of his own pocket and then picked up the pen and started writing name accordingly:

*- ‘In addition, I fine the store a thousand dollars for handing over a hungry child to the Police.’*

*‘If the penalty is not deposited within 24 hours, the court will order to seal the store.’ also the Police is fined the same amount for charging a hungry boy to court.*

'By giving the full amount of fine to this boy, the court asks for forgiveness from that boy.'

After hearing the verdict, tears were pouring from the eyes of the people present in the court, that boy's handcuffs were also untied. The boy was watching the judge again and again, who came out hiding his tears.

*Are our society, systems and courts ready for such a decision?*

*if a hungry person is caught stealing bread, then the people of that country should be ashame.*

That Nigeria’s democracy is currently under threat is an understatement. It is apparent from the excessive machinations of some political actors who have exhibited the penchant for greed and avarice, particularly in the way and manner they appropriate every available gains and dividends of democracy to themselves.

These persons who desire exclusivity do not bother about the well-being of other citizens within the political space. And, in spite of efforts by many patriotic Nigerians to encourage those who felt cheated at the recent controversial 2023 general elections to seek redress in the tribunals and law courts, some mischief makers have resorted to all kinds of manoeuvers to undermine the legal process. They have invaded various Tribunals set up for the judicial interrogation and resolution of the disputed polls.

This piece is therefore intended to draw attention of Nigerians to some recent ugly developments in Ebonyi State, where the immediate past governor, Mr. David Nweze Umahi has decided to play as a tin god.

It should be noted that Umahi has been making very provocative statements concerning the conduct of the Ebonyi State Governorship and National/State Assembly Tribunal currently sitting in Abuja. Ebonyi State was no exception to the electoral fiasco, which characterized the last general elections. Opposition political parties were violently muzzled by Umahi’s militia organization, Ebubeagu.

In the run-up to the elections, Umahi issued an abhorrent “Executive Order,” which barred opposition political parties from the use of public schools for their campaigns in the state. The parties were compelled to resort to the use of make-shift open spaces for their campaigns in order to escape Umahi’s draconian and shamelessly anti-democratic policy.

Several people were killed during the elections, just as the electoral umpire, INEC, allegedly facilitated the manipulation of the elections, ranging from the National Assembly to the Governorship and the State Assembly elections.

Piqued by the ugly development, candidates who were robbed of deserving victory decide to approach the Tribunals in search of justice and rederess while expecting fair-hearing.

That the Ebonyi State Election Petition Tribunal were re-located from Abakaliki to Abuja, was ostensibly to guarantee the safety of the Jurists based on reports that Umahi and his gang, with their terrible history of organized violence, could use subtle or open threats to put the lives of the Judges and Witnesses in danger.

Recall that on 14th February, 2023, after the Federal High Court sitting in Abakaliki disbanded the dreaded Ebubeagu Militia created by Umahi, following a case of abduction and torture brought against the Ebonyi State Government and Ebubeagu by a former Commissioner for Information in the state, Mr. Abia Onyike, the former Governor mobilized his goons to hold demonstrations in and around the Court premises.

The demonstrations which took the hoodlums to the premises of the state and Federal High Courts in Abakaliki was coordinated by the Ebonyi State Chairman of APC, Stanley Okoro Emegha, who equally doubles as the Commander of the disbanded Ebubeagu Militia.

Umahi had boasted almost one month ago that he would use his contacts in high places to ensure that the Ebonyi State Tribunal is relocated back to Abakaliki the state capital. On the 13th of May, 2023 during the burial of the father of the Minister of State for Health, Mr. Joseph Ekumankama at Amangwu in Edda LGA, Umahi boasted that he must do everything within his power to influence the rulings and judgements of the Ebonyi State Tribunals sitting in Abuja. He equally told the audience not to worry as he had concluded plans to have the Tribunal relocated back to the state.

Umahi had every reason to be agitated about the on-going trials at the Elections Petitions Tribunal, because everybody in the state knows that he was the brain behind the election crises in Ebonyi State. Even at that, his election into the Senate exposed monumental fraud. The results of the two federal constituencies making up the Ebonyi South Senatorial zone serve as a ready clue to the political realities on ground. Umahi and his APC lost the two Federal Constituencies to the Labour Party and the PDP.

Umahi lost election in his own polling unit in Umunaga, Uburu in Ohaozara LGA and was roundly defeated in all the five Local Government Areas of Afikpo North, Edda, Ivo, Onicha and Ohaozara. He later became jittery and compromised the Returning Officer who illegally announced him winner despite the fact that over 33 polling units results were cancelled.

There are over 13,000 registered voters who collected their PVCs in the cancelled polling units while the margin of lead in favour of Umahi after all his manipulations stood at a little above 2000 votes. In other words the election in that Senatorial District remains inconclusive but Umahi is jumping all over Nigeria with a stolen mandate. What Umahi did in his own election was exactly what he perpetrated in all the other elections in the state. Herein lies Umahi’s desperation and the basis of his restless machinations to compromise the Election Tribunals.

As if to bring Umahi’s threats to fruition, rumours were rife some weeks ago that many of the cases at the Ebonyi Tribunal would soon be struck out based on flimsy technicalities. True to predication, on Friday, 9th June, 2023, the Ebonyi State National and State House of Assembly Petition Tribunal went ahead to dismiss the petition filed by Dr. Ezeh Emmanuel Ezeh, the Labour Party(LP) candidate for Abakaliki/Izzi Federal Constituency against the election of Emmanuel Uguru of the All Progressives Congress(APC). The Tribunal Justices, A.D.Odokwu and S.S. Ogunsanya, decided to strike out the very meritorious petition by relying on “Time of Filing as against time of service ” as reason for perfecting the obviously pre-arranged verdict. Evidence of deliberate sabotage is obvious when the tribunal chairman on 25th May adjourned hearing on the petition to 3rd June only to call the case for hearing on 27th June in a deliberate ambush of the Petitioners.

Lawyers and interested observers who had seen Dr Ezeh's Petition know that Mr Emmanuel Uguru would not have any defense on all the grounds of the petition. Emmanuel Uguru came a distant second when all mutilated results from most of the polling units perfected by INEC staff are removed. To worsen their defense, Emmanuel Uguru has no educational qualification, didn't even bother to attach any in his form EC9 and EC 13. Furthermore, the total number of PVC collected from about 15 polling units INEC cancelled stood at about 11,000 which ought to have made the election inconclusive.

However, some legal experts have argued that even the consideration by the Tribunal was out of tune with Paragraph 18(1) of the First Schedule to the 2022 Electoral Act. Following this ugly development, it is quite apparent that Umahi may have started making incursions into the operations of the Ebonyi Tribunals with the implication that justice may have been compromised or could indeed be compromised if Umahi’s boasts are anything to go by worsen by the ghost of Sen Bulkachuwa's admission of judicial quid pro quo.

Already, many civil society organizations have raised alarm over the activities of the Ebonyi State Elections Petition Tribunal. The groups in question include, Oganihu Ebonyi Movement, Ebonyi Peoples Vanguard, Eastern Renaissance Movement and Worried Nigerians Citizens.

The groups have jointly and severally urged the Tribunals in Ebonyi State to uphold the Rule of Law. While restating the legal maxim that, “justice should not only be done but should be seen to be done”, the groups also appealed to the Tribunals to, “keep to the facts and law without recourse to vague technicalities so as not to set wrong precedent that justice is up for sale to the highest bidders in the eyes of the people.”

Let me end this opinion article by calling on the National Judicial Committee(NJC) to monitor the conduct of its Judicial Officers in the field, especially those currently handling the on-going Electoral Petitions meant to resolve the controversies arising from the 2023 general elections.

Judges who work to undermine the objectives for setting up the Tribunals should be sanctioned, while reckless political actors such as David Umahi should be subjected to legal censorship to curtail their capacity for orchestrating acts capable of lowering the lofty image of our sacred temples of justice. Umahi's plan to torpedo the cases at the Tribunal must fail like the counsel of Ahitophel.

As for Dr Ezeh's petition, he must not allow himself to he discouraged. It is expected that by now, his lawyers should be perfecting the processes to appeal against the heavy-handed and hasty decision of the Tribunal.

Interestingly, Ezeh's team seem to understand that all the gimmicks are intended to destroy his petition, weaken the resolve of those who were cheated at the polls and use time constraint to deny them justice. Little wonder that state government had already commenced propaganda to celebrate the chicanery.

But, the question remains, can these electoral bandits sustain their thievery?
