A Federal court eeked out a wee bit of justice today, or to use the word of the defeated defendant, Ret. Virginia Beach Sherrif Ken Stolle, a “minuscule” bit of Justice.

Former VB Sherriff Deputy Dave Fowler was awarded just $10,000 in damages, a far cry less than the $1 million requested.

The retired Republican sheriff, who terminated Fowler’s appointment after his wife Kelly Convirs-Fowler was elected as a Delegate and who had verbally volleyed with the Delegate repeatedly on social media, was found by the federal jury to have violated the former deputy’s First Amendment Right of Association (being married to and supportive of the delegate and her views) but did not violate his free speech.

The. $10,000. Award. Is. Too. Low.

Dave Fowler and the damage to his career and his life are worth more than that. Your/Our First Amendment is worth more than that.

Yep. Seemed evident to us from the beginning. This man likely abused power and VB citizens were no safer for it. Party-line hiring and firing in public safety doesn't keep the public very safe at all, does it?

Chesterfield’s Commonwealth Attorney Stacey Davenport is bowing out and a special prosecutor is being appointed to take a look. But at what? New evidence or a revealed conflict?

Here goes… we weren’t going to share this, but gosh darn if it doesn’t perfectly illustrate the toxic environment our city provides for its residents. If you can’t lick the boot, they’ll just shovel dirt in your mouth. Cat was willing to believe this meme was posted without knowledge by the VBPD of what it actually represents. She alerted them and what happens next is just, go see for yourself. And share this far and wide, please, so the rest of the world can see yet another example of the TOXIC. The police department has been allowing this to go on since noon yesterday — no apologies. THIS IS NOT OK!

Joint Statement from the City of Virginia Beach and the Estate of Donovon Lynch

​The City of Virginia Beach and the family of Donovon Lynch have agreed to a $3 million settlement in the officer-involved shooting which resulted in the tragic loss of Donovon Lynch’s life in March 2021.

As we have learned more over time about the facts of that fateful night and encounter, we have come to understand that a series of unfortunate occurrences led to Donovon’s death that night – which in hindsight should never have occurred as it was later determined that neither Donovon nor the officer set in motion the events that transpired.

We understand that the settlement will in no way lessen the grief and loss for the Lynch family. The City’s ongoing support for its public safety personnel and its investment in officer education and technological advancements underscores the City’s commitment to providing greater transparency.

We will continue to do the work necessary to keep everyone safe and serve the best interests of our community. The City and Lynch family have mutually reached this agreement and will move toward healing and closure. We also hope this resolution will elevate our common humanity and how we all treat each other in Virginia Beach, the Commonwealth of Virginia and throughout our nation.

So our property has been crawling with danger noodles over the last couple of days and I have been riddled with anxiety over it. I found this article that came from UVA about a year ago and it’s so informative. So we only have three venomous 🐍 in Virginia — somewhat comforting, but still. Read this. If we've been absent lately it's been because of quiet contemplation and thoughtful discussions about how we move forward with the Project Toxic podcast between now and November 8. If you were not aware, Cat has stepped up to run for City Council in the new District 6. See what we mean about thoughtful conversations! There are considerations and implications, especially in a city where local politicians and journalists would make pretty strange bedfellows. So the talk has been mostly about what is the ethical thing to do with the podcast while Cat has this dual role of candidate and podcast co-host. So, while we strive to always do the right thing, we are reaching out and asking you -- those who listen and look forward to the next episode, what is the best way to handle the podcast until the election?

As we are sure you are aware by now, the scanner channels that broadcast the Virginia Beach Police were fully encrypted as of 1 p.m today. Many police agencies across the US have done the same. The argument for encryption is that it helps keep officers safe and doesn't allow criminals a chance to get a step ahead of law enforcement by listening in -- the scanner apps have grown in popularity since the pandemic and the apps make it easier than ever to listen in on law enforcement activity.

If you argue that the move reduces transparency -- they'll argue back that YOU don't support law enforcement and are somehow willing to endanger the lives of officers for your own listening enjoyment. (Note: the scanner feed we hear is already almost two minutes behind the actual air time -- maybe more)

There is another large group of people out there who also listen to the scanner -- and it's because it helps them with determining what parts of town are safe and how to avoid encountering traffic caused by an accident. Those people are delivery drivers and they are more likely to die at work than a Law Enforcement Officer.

"According to the U.S. Bureau of Labor Statistics (BLS), a pizza delivery driver is at a higher risk of injury and death than a construction worker or police officer. While most pizza delivery drivers are hurt and killed in traffic accidents, many others are attacked, assaulted, and even shot while out on delivery."

But don't take our word for it -- dig into "why" on your own. And for goodness sakes, don't head over to the VBPD page and ask them -- as you can see by this photo, they don't want your opinion.

Another continuation! He won't be back in court until nearly a year after his Oct. 29, 2021 arrest! Does this annoy you as much as it does us? Well at least we can still count the continuations on one hand. If this keeps going we are going to need two. The accused pastor was set to appear again, for the fourth time on June 23… and you guessed it, it has been continued again until 9 AM on July 26. And it’s still in Chesterfield Juvenile and Domestic Relations Court.

Trigger warning: This is a tough video for any survivor of s*xual abuse to watch -- and even more so for those who survived abuse in their church by the hands of their pastor. But it is also a revelation and the beginning of healing -- at least for this woman, her family, and this congregation. And we hope this may give some strength to the victims out there who have remained silent to start speaking up. We believe you. They are going to believe you.
