Commercial Product means any and all products in Final Pharmaceutical Form comprising Lead Compounds and any and all formulations, mixtures or compositions thereof emanating from the Research Program pursued pursuant to this Agreement, the making or use of which embodies any of Sepracor Technology, Oncogene Technology or Joint Technology and in respect of which Sepracor and Oncogene each has rights to commercialize pursuant to this Agreement or any other agreement executed between the Parties in furtherance to this Agreement.
