Commercial Product means any Licensed Product that is not a Research Product. For example, a Licensed Product will be a Commercial Product if (a) pursuant to applicable regulatory approvals or rules it may be sold for diagnostic or therapeutic purposes, (b) as offered for sale or sold, it is identified or labeled for use for diagnostic or therapeutic purposes, (c) it is offered for sale or sold to an entity, such as a commercial laboratory or hospital, that primarily performs diagnostic or therapeutic services, or (d) it is the provision of services.
