Min of Lands Kickstarts Media Orientation on New Land Laws

Deputy Minister of Lands Hon. Deus Gumba, M.P yesterday opened sensitization meeting on the amended land laws for Senior Editors in the media in the Southern Region. This is the first in the series of engagements which the Ministry of lands will hold to sensitize the people on the amended land related laws.

The land related laws were enacted in 2016 by parliament and were implemented on a pilot basis in eight districts in the country. However, many people, including Traditional Leaders, felt that the pieces of legislation passed had some grey areas which needed clarification.

Government will soon roll out the implementation of the laws nationwide following the approval of the National Roll Out Plan by the Land Reform Steering Committee. I believe that for the smooth implementation of the laws, there is need for awareness raising among Malawians for them to understand the key provisions in the amended laws.

Gumba said his ministry has commenced sensitizing the media in this regard considering the fact that the media play a critical role in disseminating messages to the public. He said the Ministry is doing this because it considers the media as a key partner in the implementation of land reform agenda.

He therefore appealed to the media help government to allay fears that are being propagated by some sections of society because of the wrong perception of the amended laws.

The amended land laws are;
The Land (Amendment) Act, 2022;
The Customary Land (Amendment) Act, 2022;
The Land Survey (Amendment) Act, 2022;
The Land Acquisition and Compensation (Amendment) Act, 2022;
The Physical Planning (Amendment) Act, 2022; and
The Registered Land (Amendment) Act, 2022

Last night MISA Malawi delivered a petition on law reforms to the Legal Affairs and Media, Information and Communication Committees of Parliament. Among the petition points, we are calling for the repeal of criminal defamation laws and review of the Electronic Transactions and Cyber Security Act of 2016 which the state is frequently using to arrest internet users.

We developed the petition together with 8 local partner organisations in partnership with the International Center for Not-for-Profit Law (ICNL).

On Friday, 2nd December, 2022, Deputy Minister of Lands Hon Deus Gumba, MP presided over the launch of the Communication Strategy on land laws in Mzuzu. The Strategy is meant to facilitate the implementation and raise awareness of recently amended land related laws across the country.

The land laws were amended in 2016 to ensure that they are in line with the aspirations of Malawians and it remains the desire of Ministry of Lands that the general populace is aware of the land related laws.

Gumba said this is a very key document in the implementation of the land reform agenda because it provides the implementation plan to guide the ex*****on of all communication activities and it has feedback mechanism which will help the Ministry to assess the impact.

He therefore appealed to the media who formed part of the participants to use the strategy in disseminating messages relating to land governance for the betterment of the country’s land reform agenda. He added that to ensure that the media understands the nitty-gritty of the amended land laws, his ministry would soon orient the media regarding the same in all the regions of Malawi.

"The aim of the orientation is to ensure that no one is left behind in the land reform agenda," said the Deputy Minister..

Philip Pasula - 2022 Mzuzu City and North Education Division Best Teacher

In addition to numerous awards he has amassed over the years as sports journalist for Malawi's flagship online newspaper Nyasatimes, Philip Pasula who is also an English teacher at Mzuzu Government Secondary School was on 25th of February awarded as best teacher in Mzuzu City and the best of the best secondary school teacher in the Northern Education Division (NED).

Pasula was given the award by deputy minister of education Monica Chang'anamuno during this year's celebrations of world teachers day held at Mount Soche Hotel in Blantyre.

Responding to the awards the usually talkative Pasula was loss for words for this feat but attributed everything to God.

"Now this can only be God and nothing or nobody else. It's all about Mark 10:27 ( Jesus looked at them and said, 'With man this is impossible, but not with God; all things are possible with God')," said Pasula.

MISA Malawi and Malawi Network of Older Persons Organisations (MANEPO) have signed a Memorandum of Understanding (MoU) which will see MISA Malawi awarding excellent news reporting and programming around human rights issues of the elderly in Malawi.

The signing ceremony took place at Mtolankhani House in Lilongwe on Monday, October 10, 2022.

MISA Malawi Chairperson Teresa Ndanga said the partnership with MANEPO accords journalists an opportunity to access information including data on issues affecting older persons; motivate journalists to investigate and write more around these issues as well as improve journalists' capacities on the topic.

MANEPO Country Director Andrew Kavala said the organisation expects the media to be more aggressive in fighting for the rights of older persons in Malawi.

Significant number of older persons in Malawi live in abject poverty and are often abused. Some have been killed on accusations of practicing witchcraft.

MANEPO DECRIES RISE IN ELDERLY PERSONS ATTACKS

Civil Rights Movements in the country have bemoaned the country’s failure to fight against those violating the rights of the elderly.

A consortium of Civil Society Organisations helping older men and women to claim their rights led by the Malawi Network for Older Persons Organisation (MANEPO) has condemned in strongest terms the rising in number of mob justice cases in the country.

The condemnation comes in the wake of three deaths resulting from mob justice in which the victims were accused of practicing witchcraft just because they were of old age.

MANEPO’s Executive Director, Andrew Kavala said it is disheartening to see the country degenerating into lawlessness resulting into violation of the rights for the elderly.

This month alone three mob justice cases in Dedza North have been reported forcing a number of CSOs and police to conduct an interface meeting with chiefs, religious leaders and villagers in the area.

β€œI am deeply saddened to hear about this shocking news in Dedza. My heart bleeds. I wish to strongly condemn this barbaric action and call upon the police to bring the perpetrators to book for this,” Kavala said.

Meanwhile, MANEPO and Malawi Human Rights Commission (HRC) have also called on government to establish a commission of inquiry to find out reasons behind continued mob justice in the country.

In a joint communique the CSOs state that time has come for the government to minimize the talking but take serious action to end the senseless killings of the elderly once and for all.

In an interview with Northern Region Police, Maurice Chapola said, police will increase community policing members in all villages across the country as one way of strengthening security to protect people

Malawi Attorney General (AG) apologises on journalist Gregory Gondwe’s detention

For immediate release

Wednesday, April 6, 2022
The Malawi Attorney General (AG) Thabo Chakaka-Nyirenda has apologised for the arbitrary detention
and confiscation of electronic gadgets of Platform for Investigative Journalism (PIJ) Managing Director
Gregory Gondwe.
On Tuesday, April 5, 2022, Police in Blantyre detained Gondwe for about six hours over a story about the
AG’s decision on government’s contracts with businessman Zuneth Sattar, who is under the AntiοΏΎCorruption Bureau (ACB) investigation. PIJ published the story on March 30, 2022
MISA Malawi and Chakaka-Nyirenda held a meeting in the office of Attorney General at the Capital Hill in
Lilongwe on Wednesday, April 6, 2022.
During the meeting, the Attorney General also made a commitment that the government will repeal or
review some archaic laws that restrict media freedom, freedom of expression and violate right to privacy.
The laws in question include sedition laws and sections of Protected Flag, Emblems and Names Act which
are usually used to punish government critics and are inconsistent with the Constitution of Malawi which
guarantees freedom of opinion, freedom of expression and media freedom.
MISA Malawi delegation to the meeting comprised MISA Malawi Chairperson Teresa Ndanga, Vice
Chairperson Mandy Pondani, National Director Aubrey Chikungwa and journalist Golden Matonga of PIJ.
Police released Gondwe on bail but held on to the computer and phone they confiscated overnight before
returning them in the morning of Wednesday, April 6, 2022, raising Gondwe’s privacy concerns.
Section 21 of Malawi’s Constitution provides that every person shall have the right to personal privacy.
Police officers are forcing Gondwe to disclose source of a document the platform used in the story.
Forcing a journalist to reveal sources of their information is against the protection of legally privileged
information and whistle blower protection provisions of the Access to Information (ATI) Act.
It is unfortunate that we are retrogressing instead of defending and building our nascent democracy.

05/04/2022

Journalist Gregory Gondwe has just been released by police amid heavy criticism from different sections of the society.

Both Misa-Malawi and Human Rights Defenders Coalition released statements calling for unconditional release of the investigative journalist.

Police have detained Platform for Investigative Journalism (PIJ) Managing Director Gregory Gondwe over a story about Attorney General that the platform published on March 30, 2022.
Police officers are forcing Gondwe to disclose source of a document the platform used in the story.
Information reaching us indicates that police officers have confiscated gadgets including computers and phones from Gondwe.
MISA Malawi position is that forcing a journalist to reveal sources of their information is against the protection of legally privileged information and whistle blower protection provisions of the Access to Information (ATI) Act.
We are following up the issue and we will keep you updated.

The Malawi Bureau of Standards (MBS) is conducting a media workshop from 21st March to 22nd March, 2022 for some members of the Nyika Media Club in Mzuzu to elaborate the role of the MBS.
The Chairperson of Nyika Media Club, Mr. Joseph Mwale said due to the geographical location of the MBS headquarters, most media houses in the North find it difficult to acquire information on important issues like standardization. He indicated that this widens the information gap for practitioners in the North and this makes it difficult for them to write quality articles.
Speaking during the opening function, Mr. Thom Senganimalunje, who is the Director of Metrology Services, said the MBS realizes that a good section of the Malawi population do not understand the role of the MBS and its existence. As such, through media workshops like this, the media can acquire facts about MBS and then interpret those facts to their various audiences some of whom are also MBS target markets.
In realizing the information gap that exists the MBS organizes media briefing workshops every year to explain the role of MBS to members of the press.
