The following are some highlights of the report relevant to the present advocacy:

Virginia State Crime Commission 2018 Annual Report S*x Trafficking in Virginia
S*x trafficking as defined in the Victims of Trafficking and Violence Protection Act of 2000:
“The recruitment, harboring, transportation, provision, obtaining, patronizing, or soliciting
of a person for the purpose of a commercial s*x act”
A commercial s*x act defined:
“any s*x act on account of which anything of value is given to or received by any person”
Trafficked Person/Victim* defined:
“engages in s*x acts in exchange for some item of value”
Trafficker defined:
“exhibits some form of control over the victim and receives at least some portion of the
item of value provided in exchange for the s*x acts performed by that victim”

*Commerical s*x trafficking does not involve consenting victims or consensual s*xual acts. ... Due to the dynamics of the commercial s*x industry, individuals may fluctuate between involuntary and deliberate participation in the industry at different times.

A little bit about our page, we as MSW students of Radford University are advocating for “Safe Harbor” laws in Virginia. Right now, Virginia allows for child victims of human trafficking to be charged and prosecuted as criminals (i.e. prostitiutes). Some states have “Safe Harbor” laws that prevent child victims of trafficking from being treated as criminals, but rather they are regarded as victims of a crime and of severe trauma. Instead of being prosecuted, we believe that these children should be able to receive services that help them to heal and reintegrate safely into society. We believe that the “Safe Harbor” laws are important to ensure that these victims get the justice they deserve after suffering. We also believe that these laws will be instrumental in changing the public attitude toward these individuals from criminals/delinquents in need of punishment to victims in need of healing. After all, minors cannot give consent to s*xual relationships with adults, so why should they be held accountable for engaging in s*x work at the hands of adult traffickers? While the main point of these laws is to prevent victim prosecuting, these laws may also be instrumental in promoting better screening practices and more treatment options for victims.
