You are hereby cordially invited to join us on Thursday 12 October 2023 for the “17th Annual Investment Treaty Arbitration: A Debate & Discussion,” hosted at Crowell & Moring in Washington DC!

Come meet Conference Co-Chairs: Kabir Duggal, Ph.D., Camilla Gambarini, and Todd Weiler along with conference esteemed keynote speaker: Abby Cohen Smutny (delivering her address at 2:45pm) for what promises to be an engaging program!

Panel 1 – “This coming December, the withdrawal of France, Germany, and Poland from the Energy Charter Treaty will take effect. Leaders in each of these states claimed withdrawal was necessary because ECT obligations were hindering efforts to combat anthropomorphic-driven climate change. Was this stated justification correct as a matter of international investment law?”
Lauren B. will argue that it is correct; Dominique Jones that it’s incorrect.
Melida Hodgson, Rahim Moloo, Caline Mouawad, and Todd Weiler will discuss; with Ian A Laird maintaining order as moderator.

Panel 2 – “Earlier this year, two judges in the District of Columbia issued seemingly contradictory opinions on the enforceability of intra-EU awards post Achmea/Komstroy; which one was right and how do you think the District of Columbia Court of Appeals or SCOTUS would eventually decide?” (Blasket Renewable Investments, LLC v Spain and 9REN Holding S.A.R.L. v Spain)'
Tyler Jankauskas will argue against the idea; Nika Madyoon in favor.
Preeti Bhagnani, Marinn Carlson, Charles T. Kotuby Jr. FCIArb, and Sarah Vasani FCIArb to debate the issue further, with Martin Valasek keeping all in line as moderator.

Panel 3 - “Did the Paris Court of Appeal decide the jurisdictional question in Kiram et al v. Malaysia correctly?”
Anika Havaldar will explain why it is indeed correct; Allan Cerim will argue the opposite.
Fahira Brodlija, Grant Hanessian, Jose Antonio Rivas, SJD, and Guled Yusuf will explore the issue further, under the watchful eye of moderator: Michael Nolan.

Panel 4 - “Will investor-state mediation emerge as the preferred mechanism to resolve investor-state disputes? What are the pros and cons as opposed to investor-state arbitration?”
Tom Whip will argue for mediation; Rodrigo Aguilar Guízar for arbitration.
Miriam Harwood, Emma Lindsay, Frauke Nitschke and Borzu Sabahi will have the final say with Timothy Nelson in the driver’s seat as moderator.
