Mexico filed a lawsuit Aug. 4 in Boston U.S. District Court for damages against seven gun manufacturers and a Boston-area wholesaler: https://bit.ly/3mfHJkd

Mexico brought “this action to put an end to the massive damage that the defendants cause by actively facilitating the unlawful trafficking of their guns to drug cartels and other criminals in Mexico,” the complaint noted. "Almost all guns recovered at crime scenes in Mexico—70% to 90% of them—were trafficked from the U.S.,” it added.

We have made our way to the final element of our Export Compliance Program (ECP). This element can be placed last in the steps for its maintenance function, or in the event of a newly established export compliance manual, it can be the first element. You will need to ensure there is management support to start building the manual and that management agrees to set a positive example within the organization by acting in compliance with existing policies and procedures.

Handling violations is not often included in an ECP or considered by management. Some management teams believe that because an export team exists, and a compliance program is in place that it will prevent violations from occurring. Let’s set the tone straight: this is NOT reality in any company. The truth is that your company is expected to have violations. Early detection and quick reactions will be the key to reducing exposure. All the previously discussed elements will aid in early detection of violations, and time is of the essence.

To read more about how you can take action and handle violations, make sure to read our article at the Exporting Source: https://www.exportprac.com/sites/exportingsource.com/ht/display/ArticleDetails/i/76561

03/08/2021

As we begin to get closer to the last of our Export Compliance Program (ECP) elements, we turn our focus from how to implement the ECP to how to ensure the elements are properly aligning with our business. This can be accomplished by performing audits against your ECP.

Audits will allow the ECP to be dynamic to the business needs, adjusting aspects of the ECP to better fit where needed. It is best to assemble an audit team to assist the export compliance manager, selecting individuals to represent different areas of the business. This team should have full autonomy and flexibility to carry out audit functions so that they may fairly identify inconsistencies and risk areas. Two of the most common methods of an ECP audit are at the function level and at the program level.

Our last discussion was on the recordkeeping element. One of the most critical points of recordkeeping is the proper training of who, what, when and where. In order to properly record and store documents, the appropriate individuals need to be trained on their responsibilities and how to accomplish them.

Naturally, we understand how an Export Compliance Program (ECP) cannot succeed without an effective training element.

In our last discussion, we reviewed the third element of Export Authorization. Once you have determined your path to exporting an item in a legal, compliant manner, you must keep the supporting documentation. Recordkeeping is mundane, I’m sure we can all agree upon that, yet is critical in protecting you in the future. If an issue arises but you have documentation to support your decision, you face a much easier path than had you been “winging” it!
